ESS10: EITI Albania Stakeholder Engagement Plan (SEP) 1 The purpose of the present Stakeholder Engagement Plan is to explain how Stakeholder Engagement will be practiced throughout the course of the project and which methods will be used as part of the process; as well as to outline the responsibilities of AlbEITI and contractors in the implementation of Stakeholder Engagement activities. 1. Introduction The project purpose is to assist Albania to improve capacity to mainstream EITI agenda, as measured by EITI compliance maintained. Mainstreaming in this context will mean to achieve standardized data quality of company disclosures around production data, licenses, payments, revenues, BO disclosers in the extractive and hydropower industries. Through the implementation of EITI, the government of Albania can demonstrate its adherence to an internationally recognized standard and practices of good, open and responsible corporate governance. Greater transparency in production data, licenses, and payments, revenues and BO discloser can boost prospective investor’s confidence and enhance competition. This will support Albania in consolidating its credibility with international public and private partners. The proposed project will use the EITI platform to strengthen the legal and institutional framework for investments in the mining, oil and gas sectors with the objective of enhancing the overall growth of transparency in the Extractives sector. Actually, the project has not begun so no public input is sought, the decision for the project at this phase will be made from the WB and the Government of Albania. Once the foreseen activities will commence the decisions will be made by the MSG and the EITI National Secretariat. The purpose of the present Stakeholder Engagement Plan is to explain how Stakeholder Engagement will be practised throughout the course of the project and which methods will be used as part of the process; as well as to outline the responsibilities of GSE and contractors in the implementation of Stakeholder Engagement activities. a. Project Description The project SUPPORT TO EXTRACTIVE INDUSTRIES TRANSPARENCY INITIATIVE (EITI) MAINSTREAMING COMPLIANCE PROCCES PROJECT will consist in the following components and sub components: 1. Component A. EITI Implementation Support (US$ 160,000). This component will support the activities essential to EITI implementation and to meet and maintain its EITI compliant status obligations, including: (i) Annual EITI report for Albania (US$ 160,000). Recruitment of an independent administrator to oversee the preparation of the annual EITI report covering all extractive industries for the calendar year 2019 and 2020. Production of this annual report is a fundamental EITI Standard requirement. 2. Component B. Capacity Building (US$ 65,000). This component will include provision of technical assistance and core training on EITI and natural resources management through: 2 (i) Training for MSG members, National Secretariat staff and stakeholders for their involvement in the EITI process; tailored training from well-known agencies, participation of stakeholders in international forums and workshops focused on natural resource governance (US$ 45,000) (ii) Participation of EITI and MSG members in events organized by International EITI and other implementing countries to share the Albanian experience, to connect with other implementing countries in order to share knowledge and effective ways of implementation. (US$ 20,000) 3. Component C. Communication and Outreach (US$ 70,000). This component will support the implementation of the EITI Communication and Outreach activities accordingly to his communication strategy for 2021-2022 including: (i) Communication and Outreach for 2021 – 2022 regarding media outreach campaigns, Internet and social media activities, awareness raising events (US$ 70,000) 4. Component D. Project Management (US$ 90,000). This component will support strengthening the EITI National Secretariat’s capacity to carry out Project management through: (i) Recruitment of the services of a procurement specialist on a contractual basis (US$ 10,000) (ii) Maintenance of the Open Data portal for EITI Data (US$ 10,000) (iii) Maintenance of the Mining Cadaster Portal (US$ 10,000) (viii) Financing of Incremental Operating Costs (including, inter alia, activities in support of civil society and academic world for their participation in EITI process) (US$ 60,000) 5. Component E. Assessment of EI Impacts on Local Content (US$ 165,000) This component will include provision of support for the improvement of access to EITI data through: (i) Consultancy services for assessment of EITI impact in the framework of EITI Transparency Week (US$ 30,000) (ii) Consultancy services for assessment of impact of the Albania Beneficial Ownership Law (US$ 20,000) (iii) Consultancy services on including renewable energy and gas in EITI reporting (US$ 30,000) (iv) Consultancy services for development of standards for local reporting (US$ 30,000) (v) Consultancy services for analyzing advantages and disadvantages of foreign investment in Albania; (US$ 25,000) (vi) Consulting services for analyzing the impact of oil industry in the areas where it operates; (US$ 30,000) 1. Component F. Revision of current Legislation and recommendations for improvement (US$ 50,000). This component will include provision of support for analyzing, assessing and identification of changes to be made in order to improve the current legislation: (i) Consultancy services for revision of current legislation for reporting on project basis (US$ 20,000) (ii) Consulting services for assessment of current legislation on work safety in extractive industries (US$ 30,000) 7. Component E. Gender and Extractives (US$ 100,000) This component will include provision of support on analyzing, assessing participation of women in EI and develop a strategy and stakeholder’s capacity building of women into extractives: 3 (i) Consulting services for participation of women in extractive industries (US$ 100, 000) 2. Stakeholder identification and analysis and methodology 2.1 Affected parties Direct project beneficiaries of the project include members of Albania EITI Multi-Stakeholder Group (MSG) (a list of MSG members could be found on Table 1 below)., staff of the Albania EITI National Secretariat, stakeholders like extractive industry operators1 and civil society organizations, part of the EITI Albania MSG members and their network/ representatives who will benefit from capacity building activities supported by this project. Trainings to be supported by this project will enable MSG members to better understand the key issues and challenges pertaining to extractive sector development. With enhanced capacity, MSG can influence positively decisions and sustainable management of the extractive sector in Albania. Further, disclosure of payment and revenue flows between the industry and the government through EITI Reports and analytical work related to the regulatory and legal framework reduces opportunities for corruption and such as the implementation of this project will benefit the wider public in Albania. Other interested and directly affected parties are LGU’s that have Extractive Industries activities in their territory juridiction. In EITI Reports has been selected 7 Municipalities to be reported in the regard of Extractive Industry activities ( mainly : Fier, Roskovec, Patos, Bulqiza Municipalities ) and the respective communities.; State Agencies like National Environmental Agency that is the structer in charge for the optimization of the extractive industries impact; Regional Tax Directorates etc. 5 2.3. Disadvantaged / vulnerable individuals or groups Non-discrimination principles will be reflected in this Project , embedded in the design of grant support programs and the proposed stakeholder engagement activities. As part of its visibility/communication strategy, the Project will promote and highlight activities that will have benefits for disadvantaged groups and individuals in the society such as the poor or people who lives in the affected area by the extractives, that may experience lack of information, lack of access to the internet or other media, about the benefits and a good governance of the natural resources from extractive industries, some of this people may be also disabled and socially excluded. For example Bulqiza, a typical mining region which lies in the northeastern part of the country and is included in the prefecture of Dibra is the biggest chromium mines region. 90 % of employment in Bulqiza is in the chromium mining and enriching processes. According to the MIE, by the end of 2019, the largest number of exploitations permits, 117 permits or 47% of all exploitation permits, is located in Bulqiza district. According to the concessionary company Alb Chrome, the highest salary for miners is 87 thousand ALL, then there are also contributions for food and other support. The payroll fund is nearly 1 million dollars. While the total value of the investment is around 55 million. Mining activities has considerable positive impact in increasing the employment and incomes at local and national level. However, the mining activities in Bulqiza resulted in some cases with negative impact caused due to conflicts between landlords and residents of the area for the use of resources, as well as conflicts can also arise between licensed companies and illegal miners. Another problem to be solved definitely in the Region is the formalization of mining labor activities. The gender issues have to be addressed more and optimized in the regard of mining activities. income inequality, ( i.e. an unfair distribution of the benefits coming from resource extractions ) and bad management of mineral wealth, as well as lack of fully transparent policies for reinvestment of revenues from mining resources to generate jobs and incomes for the mining area, can potentially trigger social tensions. 3. Stakeholder Engagement Program 3.1. Summary of stakeholder engagement done during project preparation The Project will continue to consult and engage all relevant stakeholders and interested parties in different stages of planning and implementing its activities as has been done continuously before with other projects as well. Below you can find some MSG meetings related to the project activities discussed during 2021 but here we need to specify that in general the MSG meetings are related to the project or part of the project activities. Summary of project stakeholder needs and methods, tools and techniques for stakeholder engagement during project implementation At Appraisal time, a list of Project activities has been agreed upon. Assessment of EI Impacts on Local content; 6. Revision of current Legislation and recommendations for improvement; 7. Gender and Extractives As mentioned above, based on past experiences, it is estimated that the project stakeholders will be: • Member of Multi Stakeholder Group (MSG) that will be engaged in all the project life cycle through being active part of preparing/ discussing and approving the ToRs for specific activities, discussing and approving most of the deliverables of specific activities, supervising the ongoing project and activities through emails, circulars, online meetings or in place meetings (when needed), phone calls etc.; • AlbEITI National Secretariat staff that in collaboration with the MSG will lead the project and project activities, will prepare all the documentation related to it , draft ToRs, to develop procurement procedures for project activities, to sign the contracts with various consultants, to follow the contracts, their deadlines, and their realization in time and with the highest possible quality. To approve the deliverables in accordance with ToRs. To collaborate and support the consultants and all the stakeholders when and whenever needed in order to assure a smooth and successful project implementation. Actually the Director of Directorate of Economic Development is member of EITI Albania MSG. MFE as always will contribute to the project implementation with information for the EITI Reporting and information for other activities when needed. Also MFE member in MSG will be active part of the implementation process as mentioned above in MSG`s section; • National Agency of Natural Resources (AKBN) is a permanent member of the EITI Albania MSG. Actually representatives of Directorate of Mining and Hydrocarbons are member of EITI Albania MSG. AKBN as always will contribute to the project implementation with information for the EITI Reporting, information about mining licenses and companies and their status, 8 hydrocarbons contracts and companies and their status, information for other activities when needed. Also AKBN members in MSG will be active part of the implementation process as mentioned above in MSG`s section; • General Directorate of Taxation (DPT), is a permanent member of the EITI Albania MSG. Actually the Director of Accounting Analysis Directorate is member of EITI Albania MSG. DPT as always will contribute to the project implementation with information for the EITI Reporting about EI companies, LGUs, government agencies incomes and taxation and information for other activities when needed. Also DPT member in MSG will be active part of the implementation process as mentioned above in MSG`s section; • General Directorate of Customs (DPC) is a contributor of the EITI Albania MSG. Actually the Director of the Directorate of Planning and Revenue Analysis of DPC is member of EITI Albania MSG. DPT as always will contribute to the project implementation with information about the export revenues of the companies and information for other activities when needed. Also DPC member in MSG will be active part of the implementation process as mentioned above in MSG`s section; • National Center of Business (QKB) is an important stakeholder in the process since all companies operating in the extractive industry in Albania have the legal obligation to register in the QKB, so the information for each extractive company, licenses, contracts, shares etc. can be found in QKB website and for a year and a half the information for the Real Owners is reported by the companies to the QKB. During the process of EITI reporting or other processes related to EITI implementation the Independent Administrator (which prepare the EITI Reports) and the National Secretariat staff consult continuously the QKB database to extract the necessary data for the work; • National Geological Service (SHGJSH) etc. is a permanent member of the EITI Albania MSG. Actually the Director of the Directorate of Mineral Resources of SHGJSH is member of EITI Albania MSG. SHGSH as always will contribute to the project implementation with technical information for the EITI Reporting about the national mineral resources and information for other activities when needed. Also, SHGJSH member in MSG will be active part of the implementation process as mentioned above in MSG`s section; • Albpetrol as the only one SOE that operates in the extractives at this moment in Albania and is an important stakeholder during the process of EITI reporting and other activities related to EITI implementation in Albania; Actually the Administrator of Albpetrol is member of EITI Albania MSG. Also, Albpetrol`s member in MSG will be active part of the implementation process as mentioned above in MSG`s section; • Local government of areas where the extractive industry operates such as Fier, Roskovec, Patos, Bulqiza etc. have always been and will be part of the EITI implementation processes through EITI reporting about the extractive companies that operates in their area of jurisdiction and 9 through information meetings, communication and outreach activities that will be held in their relative area, etc. ; • Companies that operates in the extractives will be involved in the project through EITI reporting and also inviting them to be part of communication and outreach activities, like meetings, discussion, round tables and conferences; • As mentioned above, in addition to CSOs part of the AlbEITI MSG important stakeholders that will be involved in the project are representatives of national Civil Society associations and also representatives of CSO in areas where the extractive industry operates like: Women for the protection of natural resources; The youth of URA; All green center; Young environmental experts Association; Zharrza Association; Runja Association; SHERM; The Ecologists Association; that are part of the Albnet EITI network and oversee all the issues related to the EI and good governance of natural resources. This stakeholders will be involved in the project implementation inviting them to be part of communication and outreach activities, like meetings, discussion, round tables and conferences in order that their voices regarding the good governance of natural resources in Albania and EITI implementation can be heard; • People who lives in the areas where the extractive industry operates and are affected by the EI will be involved in the process through questionnaires related to good governance of natural resources in the areas they live, EITI implementation and benefits and through communication campaign and communication activities that will inform them more about the benefits that come from a good governance of extractive industries and the EITI implementation; • Broader public who will be engaged through the communication campaign and communication activities that will inform more about the benefits that come from a good governance of extractive industries; 3.3. Proposed strategy for information disclosure and consultation process The MSG members will be active part of the process and decision making from the beginning approving the Work Plan which will be in line with the project activities, with the preparation and discussions, approval of the ToRs for the foreseen activities and throughout the duration of the relevant activities and of the entire project. The communication methods that will be used with the MSG, will be the same as always through emails and documentation sent by email, phone calls, meetings through the Zoom platform as they have been done during all these two years due to the measures taken to prevent the spread of COVID 19. Findings from different activities that will take place or documents that will be the final product of different activities as always will be made public on our website www.albeiti.org and Facebook page EITI Albania and as appropriate will be shared by email to interested parties. In terms of communication activities, based in our communication strategy finalized in 2019 but also from previous experiences and also for the other activities when communication with stakeholders will be needed, the methods used will vary according to the target group, audience or the specific topic. Will be used: 10 • Emails; • Online meetings; • Surveys; • Press conferences; • Press releases; • Online workshops; • Social media; • Webpage; • For a broader audience the national and local TVs or media; All the relevant procedures, relevant documentation will be extremely transparent and accessible to the key stakeholders as always. At this stage of the project is impossible define a precise timetable for the specific activities, but in a more advanced stage of the project all the timetables will be previously agreed with the WB, MSG or relevant key stakeholders. 3.4. Review of stakeholder comments The review of the stakeholder’s comments will be made in due time according to the relevant issue. For example, if comments will arise during the procurement procedures from the bidders the comments will be consulted with the WB staff or if MSG has comments during the phase of ToRs preparation or a specific activity process, the comments will be discussed in MSG meetings or with circular mail. If any comment or issue will arise during all the project life it will be treated according to the kind of comment or issue. 3.5. Future phases The future phases will be: • Preparing all the necessary documentation and following the procedures for the approval of the Grant; • Disbursement of the Grant; • Meanwhile preparing the Draft ToRs for the agreed activities; • Finalizing the ToRs and obtaining all necessary approvals and No Objections; • Starting and finalizing the procurement procedures; • Contracting the relevant Consultants; • Once the procurement procedures are finalized starting the activities; • Following and finalize any specific activity; 4. Resources and Responsibilities for implementing stakeholder engagement activities 4.1 Implementation Arrangements AlbEITI will mobilize human and material resources to implement the SEP and manage the Grievance Resolution Mechanism (GRM). SEP activities will be led by AlbEITI staff and MSG with relevant 11 responsibilities being taken depending on the activity. A core Community Liaison Team comprised of staff from these departments will take responsibility for and lead all aspects of the stakeholder engagement. The team will be supported by part-time and full-time consultants, as needed. Specific named personnel will be established for these roles as the project progresses. The proposed implementation arrangements are subject to change during the life cycle of the Project and depending on the specific activity. The material resources that AlbEITI will mobilize are: (i) a Project relevant information published in the website; (ii) an electronic grievance database; (iii) stakeholder engagement documents, like minutes of meetings, records, photos, videos; (iv) AlbEITI Facebook page; (v) printed documents (manuals, brochures, posters, etc.) that will be used, based on the needs of the SEP. 4.2. Management functions and responsibilities AlbeEITI staff and MSG members will take responsibility for and lead all aspects of the stakeholder engagement. However, to implement the various activities envisaged in the SEP, AlbEITI and MSG will need to closely coordinate with other key stakeholders – other national and local government departments/agencies, consultants, extractive companies, local government representatives, civil society representatives, etc. The roles and responsibilities of these actors/stakeholders are summarized in the Table below. 4.3 Estimated Budget A tentative budget for implementing the stakeholder engagement plan over the lifecycle of the project can be founded in the section “Project Description�. The AlbEITI Team with the prior approval of the World Bank will review this plan when necessary to determine if any changes to stakeholder classification or engagement are required. If so, the plan will be updated, and a new revision distributed and the budget will be revised accordingly. 5. Grievance Mechanism 5.1. Description of GRM The Grievance Resolution Mechanism (GRM) addresses grievances in an efficient, timely and cost- effective manner, that arise in the Project, either due to actions by AlbEITI or the consultants contracted by AlbEITI, or external stakeholders. Regarding the entire Project MSG discuss all the suggestions and comments and officially approve the final version of activities and Work Plan to be included in the Project. AlbEITI is responsible for managing the GRM, but many of the grievances on the Project will likely relate to the actions of the Consultants and so will need to be resolved accordingly to the procedures of WB . AlbEITI will administer the GRM process deciding in collaboration with MSG and WB (when needed) whether they or the Consultant is responsible and determining the best course of action to resolve the grievance ( max. 10 business days for the official decision and respond). 18 The project GRM deals mostly with the preparation of reports, and communication and outreach activities that do not leads with to any direct or indirect environmental and social impacts. Typical grievances for this projects may be related to: • Procurement phase; Timing of the Grievance Resolution during Procurement phase is calculated in full conformity with the WB Procurement Regulations terms. The complaints can be submitted by mail or electronically in the EITI Albanian National Secretariat official address in the attention of Director of EITI National Secretariat. The National Secretariat AlbEITI after evaluating the grievance send back respond to complainant by an approved form. AlbEITI will implement an effective GRM, with the objective of helping third parties to avoid resorting to the judicial system as far as possible. AlbEITI GRM includes consulting the MSG and the WB staff for review and resolution of the grievance. 6. Monitoring and Reporting At the end of each year of operation, the AlbEITI staff will prepare an annual summary report on the project performance for GoA which will include an update on project implementation phase and issues. Also a detailed annual report will be disclosed on the Project website www.albeiti.org and made available to the public. 6.1. Involvement of stakeholders in monitoring activities The Project provides several opportunities to stakeholders, especially Project Affected Parties to monitor certain aspects of Project performance and provide feedback. Members of CSOs are part of our MSG and they can bring in any moment the voice of the Citizen/PAP in the MSG meetings. Reporting back to stakeholder groups AlbEITI team will report back to PAPs and other stakeholder groups through minutes of meetings and by sharing other relevant documentation in our website and other channels for communication such as social networks. Feedback received through the GRM will be responded to in writing and verbally, to the extent possible. SmS and phone calls will be used to respond to stakeholders whose telephone numbers are available. Key Project updates will be posted on AlbEITI website. Social media, through the Facebook page will also be used to report back to different stakeholders. 19
