Project Introduction 1.1. Project general introduction The overall objective of Rural Distribution Sub-project is to contribute to the poverty -alleviation program of the State for rural mountainous regions by supplying the basic infrastructure system such as electricity system... Main development objectives of RD Phu Yen province aim to help Vietnam State implement the objective on supplying power for HHs living in rural mountainous regions by the following works: a/ Upgrade and improve the existing rural power network at 11 communes and 1 town of 03 districts Dong Xuan, Song Cau and Tuy An - Phu Yen province. bl Enlarge the power network at remote and inaccessible areas, rural areas being without difficulties and areas without electricity. cl Implement the state policy of rural electrify which focus on supplying power for mountainous areas, and remote and inaccessible areas, etc., improve administrative ability of Phu Yen province and NPT. 2. This project uses WB's loan for upgrading and improving the existing rural power network at 11 communes and 1 town of 03 districts Dong Xuan, Song Cau and Tuy An - Phu Yen province. Project is established and implemented into many periods. Project includes 11 communes and 1 town at rural mountainous regions: Ph6 Ma, Xuiin Long, Xuiin LZnh, Xuiin Phumg, Xu2n L2m, Xuiin Tho 1, Xuin Tho 2, An Thach, An Ninh Tiiy, An Ninh DGng and An Hai communes, and La Hai town. 1.2. Ethnic minority development plan (EMDP) 1. Unnecessary compulsory resettlement will be minimized, the negative impacts on the ethnic people should be also limited in project design process, construction measures and construction schedules because the project is implemented in .the areas of the ethnic minorities. However, the lost land is inevitable. In 11 communes and 1 town in the project area, only Phu Mo commune belonging to Dong Xuan district has EMSimpacted by the project. 5 HHs (26 people) of total 246 PAHs are EM who are Bana. 2. In fact, constructing the power network only creates individual influences and at a low level. Almost impacts on the land of the ethnic minorities are temporary, only a few HHs will loose their land permanently due to building tower and substation (pole mounted substation). Therefore, the work items of the project will not cause serious cultural impacts to the affected EM HHs and also not cause serious impacts on socio-eco aspects of the whole community. 3. To RD Phu Yen province, WB's policy on EM requires to make EMDP to ensure the following: +The project implementation should respect the human dignity, the human rights and cultural specific characteristics of the ethnic groups. EMDP report of this project is established according to guideline OP 4.10 of WB and the constitution of the Socialist Republic of Vietnam about the ethnic minorities. Establishing this report is simultaneous with the feasibility study report to ensure to meet the objectives of WB's OP 4.10 policies. Establishing EMDP is based on the results of wide investigation, interview and discussion with the relevant authority and organizations, and the project affected EM people at Phu Mo commune to collect their information and feedback for the project, the potential impacts, especially the negative impacts to EMS, and the recommended measures being against the negative impacts and increasing eco-social benefits for EMS. Ethnic Minority Development Plan (EMDP) 6 Rural Distribution Project -RDPhu Yen Province Feasibility Study 11. Socio-economic situation of EMSin the project areas 11.1. Population and population structure 11.1.1. Ethnic minorities in the project areas According to Annual Statistic Data in 2007, the total population of Phu Yen province is of 880,713 people, in which, there are 437,802 males (occupy 49.71% of the total population) and 442,911 females (occupy 5.29%). Population density is 174 persons/km2.In province, many Ethnics live together, in which the Kinh occupies 97% of the total population, three Ethnic Minorities (the Bana, H'Re and Cham) only occupy 3%, .they locate at the mountainous hamlets, villages belonging to the mountainous midland districts. Principal characteristic of the EM communities is base on the rural communities, their organizational structures in cultivating and residential regions with social institutions are nearly like the Kinh. Almost population still produce according to the local authority's arrangement and plan, people's intellectual standard is still at low level and many obsolete common practice still exist. Although they have particular language, traditional culture, common practice and mode of living, but they socialize harmoniously with the Kinh on many espects. Almost their children go to the same schools with Kinh children. They participate in most of cultural activities, share the economic opportunities and get the public interests. In all EMS communities, the Bana, Cham, H're have their particular lettering system, common language of EMSis Vietnamese. The affected EMSin project communes: The Bana: (Project impacts directly to Bana HHs) -Mode of living andproduction of theBana Almost population of Phu Mo commune is the Bana and Cham, in which the Bana lives mainly in Phu Dong and Phu Hai hamlets. They live in separate place with the Kinh, so they have no harmony with the Kinh in many aspects such as production, living activities and have the differences of language, cultural tradition and life style. Many old and obsolete living habits still exist. +Livingpractice: Their living organizations in residence, agricultural production region, and social organizations are nearly like the Kinh. Habitation: The Bana's typical house is the short house on stilts made with timber frame wall, thatching or metal roofing, wood floor. Now, many changes has occured in this house style. HHs having no conditions live in normal house made of wood with metal roofing, cimment floor (traditional houses with thatching, wattle wall, soil floor don't exist). Ethnic Minority Development Plan (EMDP) 7 Rural Distribution Project -RDPhu YenProvince Feasibility Study Each village has a large and nice public activities building in the hamlet centre called communal house. The communal house is a remarkable high, large and nice, it is village's headquaters which village patriarchs meet and talk, and it is also the place for inhabitants to gather. Social relations: HHs living in village have neighbour, blood and spousal relationship. There are often about ten HHs in each village, specially large villages can have several ten HHs. The remnant of matriarchy is still showed in family, kinship and in marriage. Disappearance of Matriarchy here has enhance the position of male but mother is still often closer. After marriage that married couples often live in wife's house. Public activities: The Bana dignify, respect and preserve things belonging to their national character and have confidence in village patriarch. Inhabitants concentrate in the communal house for activities under the lead of village patriarch on festival days or on time when village has special events Marriage: Monogamy is the basic principle of marriage. After marriage, the couple living in the wife's house then move to .the husband's is very ~o~rnmonlyhere. When they have the first child they will separate from their father and mother to set up a new family, a new cell of village community. Funeral: When someone dies, all people in village are off work to help burial. Digging a hole and filling soil to bury the dead is the only way in burial, it has no reburial. All the dead is buried with their own properties with thought that he may use them in the world of the dead. Then they hold a ceremmony to leave tomb alone. Letters and arts: folks songs are very abundantbut Hmon and Roi tune is common here. Musical instruments are very varried, including strings, drums and clarinets. In Ba Na's folk dancings, dances perform in ceremonies and festivals are liked by many people. Epics, legends of the Bana are also original and valuable works of Vietnamese folk literature treasure. Education: Bana children are educated their own language and culture by their parents and old people (by the method of directly showing, presenting an example to them, aping). Now, when they are old enough to go to school, they will go to school to learn both Vietnamese and Bana letters. They are activities together and received the equal treatment in learning and other interests. +Production: The Bana earn their living mainly by agriculture production: farming on the field, kaingin, in addition they plant some fruit trees in the garden and fields in the mountains; raise cattle (cows, pigs) and poultry (chickens, ducks, etc.), knitting, weave fabric, etc to serve their life. Almost the EMS are cu.ltivating comply with the local authorities' advise on what and how to plant (crop kinds, mode of production). Means of transport: EMS use dossers (many sizes) to carry things. Heavy goods are now carried by small vans, ox-carts rarely appear nowdays. Handicraft: The most popular handicraft in family scale is knitting household appliannces from bamboo, sugar cane, leaves. Another job by the women is weave cloth of cotton. Blacksmith has nearly disappear due to the development of the modem tools nowdays. Ethnic Minority Development Plan (EMDP) 8 Rural Distribution Project -RD Phu YenProvince Feasibility Study The Cham: (There is no Cham HHs affected by theproject) Common practice: The Cham trust in Islam and BaLaMondisn-I. Maintaining Matriarchy, the girls take her mother's last name. Bride's family take the initiative in - marriage, after married husband lives with the bride's family. Daughters have the right to inherittheir parents' properties, the youngest sister has to support the parents. Culture: Houses face south or west. The Cham like dancing, singing. Cham's traditional dancings are very famous. Economy: The main crop is rice, secondaryjobs are trade and weave. Almost EM elder is illiterate. 11.1.2. EMSin the affected communes According to the result of the screening survey of losses, only 01 commune (Phu Mo - Dong Xuan district) in the project area belonging to Phu Yen province has the affected EMS(lose land temporarily or permanently). In 8 districts and city of Phu Yen province, almost villages, communes and EMS who migrate to here have had electricity. In this project, only Phu Mo commune has EMDP (view table 2-1) Table 2-1: Categorizing project affected ethnic people to communes/districts (Phu Mo commune) commune The affected EM HHs only occupy 0.82% of total HHs in Phu lulo commune (604HHs) and 0,83% of total EM HHs. The average number of persons/HH of EMS is 4.67 persons/EMs HH (while that of the Kinh is 3 personsKinh HH). General Situation Phu Yen province is located in South Central Vietnam. During the last years, thanks to change in economic structure and the development of technology of the entire country, Phu Yen province has had a remarkable development in economy. Now, the living standard of EMSat Phu Mo communes is more and more stable and improved. Many investment sources has been given to it to build up the basic infrastructure (electricity,roads, schools, infirmaries, irrigation system...).Phu Mo commune has basically completed the program which aims to take-down shelters, public order and security are maintained. However, many dificuties still remain, the service infrastructure is still in low level, some built works do not give the effect as proposed, lack of fresh water, restriction of transportation and communication, Phu Dong and Phu Hai hamlets without the national electricity network system, change in economic structure slowly, hardly service and handicraft sectors development.So EMS' life here has many difficulties. Phu Mo commune has had the inter-central road, roads to every villages, production yards but their quality are low. About 70% of total HHs are using electricity for production ar,d life from the national grid. Infirmary, post office, cultural house, primary and secondary school has been built. Almost villages have baby-farming house, Communal house and domestic water supply work. These work have an important part in improving the living standard of inhabitants in every aspects. According to the survey, the Bana at Phu Mo lives in groups at villages. Because the transport difficulties the autarky economy still remain; however, goods turnover quitely develop (transportation service system by trucks). Ethnic hfinority Development Plan (EMDP) 10 Rural Distribution Project -RD Phu YenProvince Feasibility Studv Now, almost all EMS at Phu Mo commune still wear traditional clothes and use their own language. However, many young people could understand and speak VietNamese because of their learning, only few elder could not. Patriarches play an important role in the EM'S spirit life and are respected. He is the psychologer, mediator and take part in deciding every activities in commune. He is always asked when someone intend to build a house, get married, including all other things happen in family. In order to implement the state policies, development plans and the local authority's functions and responsibilities, they should cooperate and discuss with the patriarchies. On the other hand, study production experiences, enhance cognition and acquire modern technology is a popular trend of EMS at Phu Mo. From that, EMS obtain many benefits such as the enhanced knowledge about society and economy, the improved production skills. 11.3. Land use rights According to the land law issued in 2003 of the Socialist Republic of Vietnam, EMS are on equal land ownership with the Kinh. They are granted the Land Use Right Certificate for land they own. 11.4. Production - All affected EM HHs in ROW at Phu Mo are agriculture HHs: they earn their living mainly by cultivation and raising - Food trees are dry rice, wet rice, corn, manioc, been and several kinds of vegetable. - Most perennial plants are fruit trees: mango, jack-hit and cashew. - Buffaloes, cows, pigs, and poultry (chicken, duck,...) are traditional domestic animals in these communes. However, breeding is scattered and small here. 11.5. Living standards and conditions - In general the transportation system at Phu Mo commune is convenient. From the provincial road 642 drive to the inter-district road to reach to Phu Mo commune. Inter-village roads reaching to every village to serve travel and transportation also develop strongly. - Public works: Baby-farming house, primary school, secondary school, commune culturalhouse, post office, infirmary at the commune center. - Health care: During the last few years, investment on health care has a remarkable increase. There is 01 infirmary with 4 wards and a phamacy at the commune center. Medical personnels can primary examine and treat medically for patients. - Business and services: exchange, trade in the commune is done by small business household,monger and agricultural product dealer. - In Phu Mo commune, inhabitant's income is main from agriculture (cultivationand raising).Average per capita income: 2,160,000 VND/person/year. Living conditions: - Household goods: in general many HHs have had motors for moving; cassetts for entertainment, only a few HHs have TVs. Number of HHs has water pump for irrigation rare. Ethnic Minority Development Plan (EMDP) I I Rural Distribution Project -RD Phu Yen Province Feasibiliy Study - Water supply: 36.24 percent of HHs at Phu Mo use fresh water (from wells); the others almost use water from springs. - Electricity: All inhabitants in Phu Dong and Phu Hai hamlets belonging to Phu Mo commune have not been used electricity for life and production. The following table 2-3 shows some figures on EMS' living conditions at Phu Mo commune. The percentage of children at school age going to school is fairly high due to the advantage of road system. The percentage of illiterate children is low and will be zero in the near future; however, the percentage of illiterate people is high in adults. Education infrastructure has been cared by commune/district, baby-farming houses, primary schools are built near residential area; EMSchildren are mobilized to go to school at the right age so almost children at school age are gone to school. Law structures EMDP is based on WB's guideline OP 4.10 and Vietnam's policies on ethnic minorities. 111.1. Vietnam's law According to Article 5 in the Constitution of the Socialist Republic of Vietnam (1992) states that the Socialist Republic of Vietnam is a united nation consisting of all peoples living in Vietnam. The government issues the policies on equality, union and assistance together of peoples. Discrimination and separation are forbidden. All peoples have the rights to use their particular languages and separate writing systems in order to keep the characteristics of each people, to develop their customs, habits, tradition and beautiful culture. The government performs the all-aspect development policy to improve the standards of the EMS' mental and material life. Article 94 in the Constitution says "The EM people committee has the rights to submit the relevant proposals, plans or problems to the National Assembly and to supervise and manage the implementation of the national policies and the development programs in may aspects such as education and health service". The presence of EM People Council in the National Assembly and the Committee for Ethnic Minorities and Mountainous Areas (CEMMA) in the Government together with many programs on socio-economic development and natural resources - in remote and inaccessible areas and mountainous areas inhabited by ethnic minorities is an evidence on consistent policy of equality for and resistance to discrimination against ethnic minorities, and in company with commitments to improve situation for its ethnic minorities pursued by the State of Vietnam. According to the Government of Viet Nam, ethnic minorities have the following characteristics: - An intimate understanding and long stay in the territory, land or area of their ancestors, a closed attachment to the natural resources; - Self-identification and recognized by neighboring members by their distinctive culture - A language different fiom the national language - A long traditional social and institutional system - A self-provided production system The most important government policies in relation with ethnic minorities issued from the prior years to now consist of Decision No.327 dated on September 15, 1992; Regulation No.5251TT dated on November 2, 1993; Decision No.556/'TT dated on September 12, 1995; Decision No. 661lQD-TTg dated on July 29, 1998; and finally Decision 13511998lQD-TTg. Since 1968, the Government has promulgated resettlement policy for ethnic groups, reducing migration trends of the ethnic people. The Regulation No.5251TTG dated on November 2, 1993 by GOV concerning the detailed regulations on Ethnic Minority Development Plan (EMDP) 14 Rural Distribution Project -RD Phu YenProvince Feasibility Study implementation of development policies in highland areas and ethnic minority areas consists of the main following points: - Develop infrastructure, especially transport and fresh water supp1.ysystem - Step by step overcome the lack of food - Consolidate an education system; adjust education program based on characteristics of each province; create the advantageous conditions and support the irregular education program and develop economic internal forces. Decision No.13511998lQD-TTg focus specifically on poverty alleviation for ethnic minorities, based on promoting construction of small-scale infrastructure in poor ethnic minority villages. Decision's general objectives are: a) Rapidly improving not only the material life but also the mental life of ethnic minorities in extremely poor villages in mountainous and remote and inaccessible areas; b) Creating better conditions for these rural areas in order to escape from poverty, backward and slow development, c) Integrate the EM people into the general development of the whole country; and d) Contribute to social security and safety, and state security. 111.2. WB's OP 4.10 on EM People The World Bank's objective towards ethnic minorities is to ensure that the development process foster a full respect for their dignity, human rights, and cultural character. The focus of this policy framework is to ensure that EMS aren't impacted during development process, especially due to projects using WB's loan, simultaneously ensure that EMSwill be received eco-social benefits corresponding. WB's strategy for problenis resolution relating EMS is based on themselves EMS' participation when supplied sufficiently information. Determining the local habitants' expectation by directly consulting, appling the knowledge of EMS to the project's alternatives, inviting experts having many experiences is the focus activities of all projects having impacts to EMSand their interests on natural resources. Legal policy of the Government of Vietnam relating to EMShas the same contents as WB's policy OP 4.10. Ethnic Minority Development Plan (EMDP) 15 Rural Distribution Project -RD Phu Yen Province Feasibility Study IV. Project impacts on the EMS IV.l. Impacts on land and resettlement The sub-project of power network in the rural area in Phu Yen province does not cause the serious, wide and deep impacts on the EMS' residence and production. This project when being executed will mainly cross eucalyptus land, only 10m2 production and garden land are permanently lost and 196m2production land within ROW (6m in width) are temporarily affected. These lands belong to 05 Bana7sHHs in Phu Dong and Phu Hai hamlets. The positive impact of the project is great and it provides electricity for production and life of EMSwithout national grid in these hamlets. No household of above 05 households is impacted house and structures on the land The temporary affected land area is small in comparison with the total possession land area, thus resettlement is not required. Due to all the project affected HHs have a desire to be compensated by money for the affected land, crops, structures in order to arrange themselves the residential and productive land which are suitable for every household's real situation,thus the project will compensate for PAHs by money at replacement price. On the other hand, according to regulations of Decree No.l06/2005,/ND-CP dated on August 17, 2005 of the GOV of Vietnam and according to norm on design, 22kV transmission line is designed wire suspension at the height ensuring safety at health and life of inhabitants. Tables 4-1 and 4-2 summarize data on the land l o s and the influences to the EMS. The detailed impacts to EMSare shown in RP Report. IV.l.l Impacts on EMS - There are a total of 05 EMS' HHs (26 people) impacted because of (permanent or temporary) land and crops (on land) loss .Included: - 05 households (26 persons) are lost land permanently (due to tower foundation construction). - 05 households (26 persons) are lost land temporarily (due to wire scatter, construction service). - There are no households lost their houses. - There are no households lost the auxiliary works (walls, fence). - There are a total 206 m2 productive land belonging to EM HHs' ownership impacted, in which only 10m2land are permanently impacted, the remaining 196m2land are temporarily affected (when scattering wire). All these EM HHs have long the rights to use he affected land. - No EM HHs is impacted so seriously that they have to replace, or lost more than 10% of productive land, or lost the business place. - There are no impacts to the worship land and sensitive marks. As a result, the loss of a proportion of the productive land compared with benefits the project creates is insignificant. The U'B funded RD Phu Yen Province's project to improve living conditions in rural areas including the poorest and the most disadvantaged EM communes, through the provision of a basic infrastructure - power supply, which is supposed to According to the results of the public consultation and discussions in groups, all of EM people as well as the Kinh express their views that they fully support the project investment, even if they are lost a proportion of their productive land. In their opinions, the improved power supply would rather bring benefits to them and positively impact to their living and economic conditions more than cause negative impacts, which are very small in fact. Public consultation and participation - Information dissemination and public consultation had been carried 3 times during project preparation time at all affected communes +The First: carried in July 2007 (minutesof meetings are enclosed in appendixNo.7) + The second: carried in March 2008 (minutes of meetings are enclosed in appendix No.7) + The third: carried in December 2008 (minutes of meetings are enclosed in appendix No.7) - Methods of implementation: + Discus and consult the local authorities, woman association, inhabitants in the affected sites about project impacts to HHs, compensation policies, implementation plan, positive impacts of the project. + Interview some PAPSabout their affected land area, RP to collect their opinions about the project. + To Phu Mo commune, where has the affected EMS, some discussions and consultations with the local authorities and the affected EMSare also implemented. To EMS, village patriarch (or head of village) are respected the highest, thus village patriarch (or head of village), Woman and Farmer Association's Representative, Fatherland Front's Representative will be invited to take part in a meeting of information dissemination of project, RP and EMDP. People who carry out consultations present the selected project site and compensation and resettlement policy. Then people taking part in a discussion present their opinions of the project impacts and recovery measures, the project's benefits, compensation and resettlement alternatives and development programs. The local authority, some members of the local authority are the EMS,has participated actively in collectingdata about the projectpossible negative impactsto the EMS. The affected EM people in Phu Mo commune fully support the project. Both the local authority and EM people engage in the discussions about their needs, difficulties, and desires relating to the project in order to take full advantage of and uphold project's benefits to increase imcome and improve social cultural economic life of EMS. The EMSand the local authority's feedback will be transferred to the development plan described below. Recovery measures and development plans The EMDP is not only for the direct affected people due to land loss but also for the EMSliving in the project impacted areas. EMDP report is base on the results of information dissemination, public consultation and participation of the EMSand the local authorities. Special compensation, assistance and resettlement provisions for ethnic minorities ensure the consideration of ethnic people's views of various issues and their legal rights. As the result of consultation with the local authorities and EMS' participation in the affected site, they present their opinions about the project possible negative impacts as below: - Potential electric shocks - Accidents in the construction time - Disorder and obstruction is caused by works construction and concentration of workers in the project areas All of their feedback will be transferred to the EMDP, in company with mitigation measures against the negative impacts on environment. VI.1. Policies for PAPs lost land 1. All PAPs lost permanently or temporarily land and properties on land will have an entitlement to compensation,assistance and resettlement programs as mentioned in RP. 2. All of the affected HHs having a desire money compensation for all of the affected land area, structures and crops on the acquired land in order to self-rearrange their producing on the remaining land area which isn't impacted 3y the project to be suitable for every household's real situation 3. All HHs whose land are impacted will be granted a land use right certificates for ownership land and newly bought land (or compensated land at the resettled agriculture area. 4. Besides compensation and assistance money as regulated, all of the serious affected HHs (if necessary) will be considered to loan from banks or local credit funds and welfare state with an amount of 1 to 3 millions VNDIHH, short or medium terms, to develop their production. All these issues will be fully conducted by the local authorities in order to inhabitants to know how to use and manage the money in right ways. W.2. Development plan to the EMSin the project area A development plan, set up for the ethnic people who are acting or living in the project area, consists of the following parts. VI.2.1. Project information dissemination Disseminatingproject's objectives, negative impacts, the affected HHs, resettlement and compensation plan and project implementation plan has been implementing as a part of RP and EMDP implementation. Project information dissemination will be carried out in common with EMP, RP implementation by project manager. Ethnic Minority Development Plan (EMDP) 20 Rural Distribution Project -RDPhu YenProvince Feasibility Study To ensure explicitness and publicity, information dissemination has carried out as below: + Consultants arrive at the project communes and surrounding area meet inhabitants to supply information of the project, and consult them about project implementation. -t Post up public consultation document about the project (project's objectives, impacts, EMSdevelopment policies) at Phu Mo CPC, cultural houses of Phu Hai and Phu Dong hamlets. + Arrang meetings of public consultation consists of representatives of PAPs, the local authorities, woman associations and village patriarch (or head of village). During meetings, consultants and all delegates discuss PAPs' eco-social problems; compensation, allowance and resettlement; and EMSdevelopment policies, etc. + Disseminating project infomation to the EMSwill be carried out simultaneously with RP implementation. Consultants and representatives of project manager, building contractors will combine with Phu Mo commune's authorities in order to implement these works. Cost for these activities is included in total budget of the project and will be deliverered by Central Rural Energy PMB. VI.2.2. Propagation, training in the electric network safety Almost HHs at the project communes have had electricity from the state electricity network except Phu Dong and Phu Hai hamlets belonging to Phu Mo. Inhabitants at Phu Hai and Phu Dong hamlets haven't electricity before the project is built, thus a power safety-training course may be very necessary for the EMSto ensure the power safety. To have a successful training program, Central Rural Energy PMB and PC3 should cooperate with Phu Mo commune and the concerned communes to define the training needs to propagate the electric safety for Ems (if required). It consists of as below: Leaflets which introduce the safety rules to the high voltage network and methods to discover the warning signs of the high voltage transmission line and give first aid to people get an electric shock, will be disseminated to every household, school in the project area. Guide the local people and the primary and secondary pupils identifj the scope of ROW of the high voltage network and methods to give first aid to people get an electric shock Guide inhabitant methods to define the scope of ROW of the high voltage network, activities which they can and can't be carried out within ROW. The local people and the primary and secondary students will be .trained about power- safety-training rules and electric shock emergency guidelines. Cost for these activities is included in contingency cost. See table 9.1 for more details. Ethnic Minority Development Plan (EMDP) 21 Rural Distribution Project -RDPhu YenProvince Feasibility Study VI.2.3. Financial support policy Support the serious affected EM people is granted the preferential credit loan in small scales. Financial support program also contains a training program of method to write an application, use and manage funds, and funds supply. So far, until the feasibility study has completed, no EM households has lost more than 10%of possessive productive land. However, in the next stage, if the technological design has to be modified it will cause the serious influence to the EMS,then this policy will be implemented. The project Central Rural Energy PMB and PC3 should define the affected people groups and works, study their credit loan needs, discuss with the bank of social policies so that the bank commit to give a priority in credit loan in small scales to the affected ethnic people, simultaneously a basic training in loan procedure, rules, requirements, use and management. Central Rural Energy PNIB and PC3 consult the bank of social policies about technical aspect to assist EM people in making an application for the loan, as below mentioned: 1) Credit loan program's objectives 2) People given a priority in credit loan: Target candidates are EM people whose incomes are seriously impacted. 3) Mechanism of loaning credits: the bank of social policies will provide the funds for loaning through the present bank network by basing on the borrowers' examined application form. The fund will be transferred from the bank of social policies of Phu Yen province to the banks of the concerned districts, then the fund will be transferred directly to the legal ethnic borrowers from these banks, or from some delegated-organizations. The names of organizations will be stated clearly at the beginning of the project implementation. 4) Refbnd: A credit loan application should include the main points such as the borrower's economical status, repaying capacity, and saving plan. 5) Loaning conditions: Legal borrowers are ethnic people who are lost more than 10% of their productive land and have fund-loaning needs. They should state clearly amount of money they need, purposes for use, repayment time, interest rate and loaning conditions (one or more times, times, loaning time, to whom money is repaid, amount of money repaid each time). 6 ) Implementation arrangement: Central Rural Energy PMB and PC3 should participate in the campaign as an intermediary to connect the bank of social policies with the affected ethnic people. Then, these households should contact directly to the credit network of the bank for the credit loan, and then the procedure for the credit loan will be implemented as stipulated. Then the bank states their duty to manage the fund clear after consulting the EMSand the local authorities. 7) Expenses and budget: The total cost of this program consists of two parts. Credit management expenses The over mentioned costs must comply with the bank's rules and inculded in cost of hnds 8) Supervision and appraisal: Central Rural Energy PMB and PC3 will be responsible for internal supervision and EM'S organizations will be responsible for external supervision of this program implementation and give an assistance to solve potential problems. VI.2.4. Training program in agricultural production extension (cultivation and animal husbandry) The EM households whose income are seriously influenced can need the technical support to rehabilitate the productive capacity due to almost HHs earn their living by agricultural production (their income is main from cultivation). The professional or specific topics, the contents of the program will be defined in the project implementation phrase based on public consultation and participation of the EMS, their representatives and their local authorities. In feasibility study stage, no HHs severely impacted is defined in the project area (as above mentioned, so the project won't carry out training in agricultural development. If the need of the credit loan and agricultural production development emerges, then assistance in developing agriculture will be carried out for both the ethnic people and the others not being impacted in the project areas who have the needs of the credit loan to develop their cultivation. The EM households whose heads are women should be come high in the list of participants in this training program Central Rural Energy PMB and PC3 should cooperate with the local authorities and the public organizations (farmer associations and women organizations) to explore their needs, then, cooperate with Rural Development and Agriculture Department - Phu Yen province to set up a training program in details. VI.3. Recovery measures 1. Construction will be implemented after harvesting crops (by scheduling a reasonable construction progress). 2. PC 3 sets up the traffic and labor safety regulations (for Central Rural Energy PMB and project construction units). 3. Warning signs should be placed at building areas and dangerous places. 4. Provisions minimizing the negative impacts caused by the project implementation should be stated in the contract with construction contractors. In these provisions, PC3 (or Central Rural Energy PMB) should state clearly that the contractors must compensate for the damages to the EMS' property which they cause at the replacement value. 5. Supervise strictly for EMDP implementation. Ethnic Minority Development Plan (EMDP) 23 Rural Distribution Project -RD Phu Yen Province Feasibilitv Studv VII. Organization and implementation The detailed organization and implementation is shown in chapter 5 and 6 of RP. To perform EMDP effectively and continuously, PC3 and Central Rural Energy PMB should cooperate together closely or work independently to the following issues: - decide suitably number of people implementing the plan, - hire the experienced experts to implement EMDP well, - arrange the experienced staffs to implement EMDP well, - set up the office in the project area to work well, - periodical supervise: the independent and internal supervision, - ensure that compensation, assistance and propaganda, training i:n the electric network is implemented well. - ensure that all of the head of village (village patriarch), associations' representatives (farmer association, woman association, fatherland front committee, etc.) participate in RP and EMDP implementation. Supervision and appraisal - Supervision of EMDP implementation is a part of supervision of RP implementation. The general plan of RP implementation supervision is stated in RP report. - Independent supervision organizations: PC3 hire monitoring agencies having the experienced experts in demography and sociology to carry out independent supervision. These organizations have to check and appraise the RP and EMDP implementation schedule set up by PC3 and Central Rural Energy PMB; examine the information at Rural Development and Agriculture Department - Phu Yen province, agricultural expansion encouragement centre, Trade and Industry Department - Phu Yen Province; interview the EM and PAPS' representatives; consider the local development indicators at the EM cornmunes/hamlets (Phu Hai and Phu Dong hamlets - Phu Mo commune; evaluate the EMDP implementation; and the ability of people working for EMDP. - PC3 and independent supervisory organizations will strictly supervise RP, EMDP implementation process in order to assist in dealing with all possible matters. - After PR and EMDP are implemented of 6 months (of one year), PC3 and Central Rural Energy PMB or independent monitoring consultancy hired cbr assigned by PC3 will interview PAPS' representatives, examine EM development indicators, evaluate the RP and EMDP implementation. WhenDPs will be received compensation cost and displacement? - DPs will be compensated for land, houses, structures, trees, crop at least 3 months before they deliver land to the project. - People who are impacted house partially or totally and must rebuild their house on the remaining part will be compensated for the affected land, houses, structures, trees and crop at least 2 months prior to the date of land acquisition. - People having the project affected trees and crop will be compensated at least one month prior to project construction. 9. To DPs, besides entitlement to compensation, what they have other entitlements? Yes. Besides land and relevant assets compensation, DPs being resettled are still be entitled to transportation and rehabilitation allowances. All assistances and rehabilitation allowances is shown clearly in RP. 10. PAPs must relocate or clear their land when just received a part of money compensation and allowance? PAPs deliver land or clear land when received all money compensation and other entitlements. 11. When receiving money compensation, PAPs are required to contribute amount of money to any organization by RC? Nobody has any entitlement to collect or diminish money compensation and other interests of PAPs. If this case happens, PAPs must notify just to DRCs, Phu Yen provincial PMB or the authorized people of the professional agencies at locality. 12 Who is responsible for informing DPs of the schedule of compensation, land acquisition, site clearance and other related information? In case, DPs disagreed with .the settlement of District Peop1e"s Committee, complaint will be solved by court. Local inhabitants who have complaints will not be responsible for paying any administrative fee for their complaints at all levels. 14. Whosupervises compensation implementation? Patterns of ownership of EM people Land ownership of EM groups is individual possession and regardless of sex. All affected HHs (above mentioned) have the residential and production land use right certificate. 5. Informationon social conditionof EM groups a. Social - cultural system of Ba Na: almost Ba Na acts in community (festival, marriage ceremony,. ..) at communal house (cultural house), they often visit to relatives living other places. b. Ba Na men are responsible for hard works such as field work, while almost women do housewife and look after their children. c. Community association: in project area, EM people participate in all activities such as participate in farmer association, women association, agricultural expansion encouragement association and veterans'organization and etc. However, in EM community, village patriarch is a person having the highest influence. B. Impacts to eco-cult- society 1. Potential positive impacts: a. Jobs created during sub-project construction process or job opportunity when sub-project is constructed. - When project construction the contractors can hire the local labors. - When the project is completed the power network is expanded, inhabitants can trade or open services. b. Increase opportunity to using electricity - 100%HHs will be connected with the electric network. c. Other active impacts to eco-social development Feasible project doesn't only satisfy electricity demand for people's life and production, satisfy demand for infrastructure and small industry development (road, school, substation, etc.) which increases continuously but also improve the mental and matter life of inhabitants in the project area. 2. Potential negative impacts: a/ Electric safety: - Risks in electricity when using electric equipments in family such as fan, light, television,... b. Specific and social issues concerning sub-project. - EM people in the project area are interested in unit price which they have to pay for using electricity and environmental sanitary because of concentration of worker. c. Land acquisition for sub-project construction - There are 05 EM HHs acquired land acquisition for tower foundation construction in project site. Total acquired land area is of 10 m2, it is insignificant in comparison with Iand area every HH owns. There is no EM HHs impacted more than 10%of total existing land area. - PAPSdesire to be compensated at replacement price. Risks on cultural heritages and natural resources such archaeological area and historical temples, sacred area, reserve, museum,...in the project area: there is no risks. - In the project area, there is no cultural heritages and reserved forest. el Other negative impacts: When the project is completed, the project's effect can't equal 100% as desired. Thus, the negative impacts to HHs and communities without electricity can happen. C. Proposals and recommendations to the project * Male's recomrnendations - Information dissemination of project construction schedule should be carried out early. - Creatjobs for the local labors. - PAPSdesire to be compensated at replacement cost - They contribute readyly small valuable assets such as fence, banana tree, papaw, annual tree... * Female's recomrnendations - Workers will not cause any troubles for community during construction process. D. Other recommendations - Cost for connecting electricity into the family can caned out many times. Framework policy Laws and regulations of the government and OP 4.10 of WB will be applied. 2. Mitigation measures Thepotential negative impacts: - Permanent land acquisition for tower foundation; temporary; and acquisition in ROWS when scattering wire and constructing pole; temporary impact to perennial trees and harvest. - Risks in electricity when using electric equipments in family such as fan, light, television, rice huller,. .. - Cost of living and food at the project areas may increase because of concentration of workers during construction process. Mitigation measures: Information from "Assessment of social impact" and feedback from meetings with EM communities will be used in designing, scheduling for construction, selecting construction measures for the sub-projects, and estimate the cost for works by Project Engineers . Include as follows: a) Recommend changing in the direction of the transmission line route, tower foundation location, construction measures and construction schedule for the sub-projects in order to satisfy demands and priorities of the EM communities.] Public consultation has been done during the preliminary line route design stage, selection of towers foundation position, in combination with consideration about priorities of EM communities in the project areas. Construction schedule has been proposed to avoid crops. Although the project construction time is proposed of 15 months, but increase in labor to work in 2 shifts is also considered in order that construction can be implemented immediately after harvesting crops and completed before sowing for the next crop The temporary crops loss will be compensated at market price. b) All of the ecological, spiritual and cultural and other sensitive areas need to be considered in the project design and construction. The sensitive areas are careful considered during the design stage. To this project, the sensitive areas are far from ROW of TIL. c) Develop a communication program, disseminate information arid train ELM community in the affected areas in the electric safety, health and social issues. Special propagation and training programs for EM communities in the affected areas have been worked out as follows: Ethnic Minority Development Plan (EMDP) 37 Rural Power Distribution Project -RDPhu YenProvince Feasibility Study - Propaganda, train in the electric safety for pupils and villagers in the project areas - Train in using small credits which loaning Erom the bank of social policies (if there are any HHs loaned credits). - Train in developing agricultural production for the EM HHs in the project areas (when required by the serious affected HHs). d) Land acquisition and compensation: project land acquisition which EM HHs occupy have to ensure that their entitlements are not violated and they will be compensated by way which is suitable with their culture for any land part affected by the project. The compensation will be carried out according to compensation, resettlement policies for the affected people. The village leader (village patriarch) will help to consult the affected HHs and the compensation activities. - Compensate the permanent acquired land at replacement will be defined in RP. All affected EM HHs have land use right certificates for the total land area t:heyown. EM people also have right to complaint and monitor the project: construction process. 3. Identify technical aspect of development allowances By regular development programs to aid EM people living in the project areas, for example, priority people living in the affected areas in jobs which created in project construction, operation and maintenance process. They are also prioritized in loaning the medium or short-terms credit from Bank of social policies to assist to agricultural production development to improve output. . Training: The project will assist training in electric safety for EM people in the affected areas (pattern: propaganda by commune's communication system, leaflet, etc.). These also includes training courses, workshops for local EM leaders (village leaders, village patriarch in the project areas) in assessment of social impacts, compensation, and monitoring EMDP implementation.
