It locates in the north of Anhui province and is crossing section of Jiangsu, Henan and Anhui provinces, where the land slopes gown from northwest to southeast and its main characteristic is plains. The total land area is 2725km 2 , among which the downtown area is 371km. There are 33 towns in total including Suixi County, Xiangshan district, Duji district and Lieshan district and a population of 2.01 million. According to the general plan of Huaibei city, Huaibei will accelerate its transforming force from a single coal-electricity city to a multi- functional and modern comprehensive city. Currently, the traffic congestion and blocking is very serious so the traffic condition is very bad. The construction of road infrastructures lags behind the city economic development and far cannot satisfy the sustainable economic development and living level being improved in Huaibei – a center city in north of Anhui province and its surrounding areas. In order to deal with the requirements to accelerate urbanization and its functional transformation and urban development, solve the conflicts of traffic supply and demand in internal old district and between the old and new districts in Huaibei, it is urgently to improve the urban traffic network under strategic guideline of general development of urban traffic and improve the operation efficiency of urban traffic system in aspects of perfection and public traffic of established road networks so as to adapt the development of Huaibei downtown and its surrounding areas. Huaibei city plans to apply loans from the World Bank and introduce internationally advanced traffic concept and mature experience to improve urban infrastructure and public traffic service. The traffic construction project in this period includes municipal infrastructure of roads and bridges, traffic management, public facilities, municipal facility maintenance and repair and other sub-projects. The estimated total investment Page 4 2 of this project is RMB 398,000,000.00 (among which USD 14,000,000.00 is planned to lend from the World Bank). As for certain influences will be caused to surrounding social eco-environment, natural environment, social economic environment and public living quality during construction and operation period, a necessary environmental management plan (EMP) should be made during the construction and operation period of the road and bus stations so as to timely adopt efficient environmental protection measures to relieve or remove unfavorable influences. The main objective of the EMP are to ensure and supervise all environmental protection measures of this project to be implemented; timely and accurately supervise true influence brought about by the project to the environment and the effectiveness of environmental protection measures; and inspect whether the forecast result and evaluation conclusion of Report on Environmental Impact are right. Entrusted by Huaibei Public Utilities & Assets Operation Co., Ltd., Anhui Environmental Science Institute takes charge of the evaluation of this project on environmental impacts, based on which, the sub-project environmental management plan of public transportation was finished in May of 2008, mainly including the project introduction, environmental management & supervision institute and mechanism, environmental protection measure and its implementation plan, environmental supervision plan and training plan, etc. This environmental management plan will be included in bidding documents and provided to the construction supervision unit, environmental supervision unit and other relevant units during construction period and operation period as environmental protection text after being reviewed by the World Bank. 1.2 Project composition The project construction contents of this sub-project refer to Table 1-2-1; the project location diagram refers to Table 1-2-1. Page 5 3 Table 1-2-1 Project Works Type Construction Content and Nature Road Project Three new and expanded main roads: reconstructed Huaihai Road, Suixi Road and newly-built Tuohe Road with total lengths respectively of 2.35km, 4.46km and 5.89km; one newly-built sub- road Cuifeng South Road with total length 1.2km; one re- constructed branch road Liyuan Middle Road with total length 0.86km. as for these five roads, the total length is 14.75km, and total area is 595582 m 2 , among which the motor vehicle lane covers 266795 m 2 , non-motor vehicle lane covers 98216 m 2 , the sidewalk covers 96093 m 2 and the greening area is 134478 m 2 Bridge Project Four bridges in total, among which Xiliu River Bridge with a span diameter 3x20 60m , a width of 45m and an area of 2700 m 2 ; Longdai River Bridge with a span diameter 5x25=125m, a width of 45m and a construction area of 5625 m 2 ; Zhaqiao Bridge with a span diameter 4x30=120m, a width of 45m and a construction area of 5400 m 2 ; Suihe Bridge with span diameter of 20+4x20+20=120m, width of 35m, and construction area of 4200 m 2 ; Drainage Project The total length of rainwater pipe is 15.00km, and the total length of the sewage pipe is 12.97km. The pipe diameter is d300~d2000mm. 11 intercepting wells. Thereinto, rainwater pipelines along Liyuan Road, Cuifeng South Road and Tuohe Road; lay sewage pipelines in Suixi Road, Cuifeng South Road and Tuohe Road and in the west of Xiangshan Road. Road Lightening The newly-built road lightening project to support five roads and four bridges Infrastructure Project Greening Project The area for greening belt and non-motorized isolation zone of five newly-built and expanded roads (Tuohe Road, Cuifeng South Road, Suixi Road, Huaihai Road and Liyuan Middle Road) is 134478 m 2 . Transportation Management Re-construct 164 bus-stop stations in this city to bay-like stations and one bay-like bus stop station is set every 500-800m; signal lights for vehicles are set in six main road junctions along Huaihai Road; except for annular island to be kept at Renmin Road junction along Suixi Road, the signal lights for vehicle and sidewalk are set at the remaining road junctions and expand inlet road at the junction. Besides, set signal lights for sidewalk at Suixi Road Primary School, etc.; make channelization design and add signal lights at the junction of Liyuan Middle Road-Xiangshan Road and Xiangyang road-Cuifeng Road. Public Transportation Newly build one public maintenance yard and four first-terminal bus stations, among which: 1) The public maintenance yard locates in the southwest of Xiangshan Road and Tuohe Road (under planning) with an area of about 50 Mu, including the parking lot, maintenance yard and Page 6 4 repair yard. The construction field is divided into three parts, parking lot, repair area and office area. The parking lot is 14000m 2 , comprehensive office building is 850m 2 , repair workshop is 900m 2 , dispatching room is 100m 2 , power distribution room is 45m 2 , material warehouse is 600m 2 , fuel/gas station is 580m 2 and car-washing platform is 117m 2 ; can hold six bus lines and 150 buses in total; 2) Four first-terminal bus stations are respectively those of Huize Park with area of 1.65 Mu, Xishan Road with area of 15 Mu, Cuifeng South Road with area of 10 Mu and Nanhu North Road with area of 10 Mu. Land Requisition and Movement This project plans to take 588 Mu collective land permanently, transfer 5 Mu state-owned land permanently; 31571m 2 houses to be removed, among which the rural houses to be removed are 26845 m 2 , urban residence houses to be removed are 2864 m 2 and enterprises and units to be removed are 1862m 2 ; 567 households, totally 3002 people are influenced. Borrow pit This project plans to set the borrow pit in Zhuzai village, which locates in the coal-mining subsidence, east of Huaibei city and belongs to a subsiding block, so the surrounding residents have moved out and the total area is about 150 hectares. The wastewater discharge executes Grade-III standard of Integrated Wastewater Discharge Standard (GB8978-1996). 3. Air Environment (1) Environment Quality Standard According to the functional division of Huaibei Ambient Air Quality, all areas involved by and in this project are Type-II areas and common pollutants PM 10 , NO 2 and CO execute Grade-II standard Ambient Air Quality Standard (GB3095-1996). The specific standard values refer to Table 1-3-3. Based on the above pollution control targets and site investigation, this evaluation mainly screens and selects some sensitive points such as school, hospital, kindergarten and collective residence buildings (take the first row of buildings along the road as primary) along the project as main environment protection targets refer to Table 1-4-1. 1.4.2 Protection Target of Water Environment The environment protection targets of surface water in this project are respectively Longdai River, Zhahe River and Laosui River, where Longdai River and Zhahe River execute Type-IV Standard of Environmental Quality Standard for Surface Water (GB3838-2002) and Laosui River executes Type-V Water Standard of Environmental Quality Standard for Surface Water (GB3838-2002). ENVIRONMENTAL IMPACTS AND MITIGATIVE MEASURES The public traffic sub-project promotes the urban traffic development of Huaibei city, satisfy demands for the city expansion and relieve traffic pressure of road networks in central district. Although certain environmental impacts will appear unavoidably during the construction and operation period, unfavorable impacts of this project will be under effective control after proper environmental protection measures are adopted. We summarize mitigative measures for environmental impacts during design, construction and operation period based on Environmental Impact Report of this project. Specific mitigative measures refer to Table 2-1-1. In addition, the project implementation should fulfill the relevant domestic requirements and code on construction, as specified in Rules of Project Construction Site Management (No. 15 Order of 1991). INSITUTIOANL ARRAGEMENT FOR ENVIRONMENTAL MANAGEMENT This section describe the insititional arrangement for the EMP implementation, clarify the responsibilities and functions of related parties involved in the project environmental management and supervision.and propose the communication channel and method of all departments. According to related regulations and practical demands of project, the public transportation sub-project shall be set with special environmental management arrangement. For details, refer to Table 3-1. Page 31 29 4 ENVIRONMENT MONITORING PLAN The environmental monitoring plan is made to monitor the implementation of all measures, timely adjust environmental protection plan according to monitoring results and provide reference for the implementing time and plan of environmental protective measures. The principle is to take consideration of the predicted main environmental influence in different periods (construction period or operation period). The environmental monitoring in the construction period and operation period will be borne by Huaibei Environmental Monitoring Station. The bearing unit shall be certified by national environmental quality monitoring, has complete equipment, strong technical strength and can finish the accepted monitoring task. 4.1 Environmental monitoring plan According to the features of the project, the environmental monitoring plan will be made according to the construction and operation periods, refer to Table 4-3-1. According to the national regulations related to the environmental management of construction project and industrial business policies, the debtor (the owner unit in the sub-project) shall be responsible to prepare the Evaluation and Monitoring Report on the Implementation of Environmental Management Plan (usually twice per year), so as to ensure the implementation of the related requirements and measures of all approved environmental management plans, to timely find out problems and analyze and make conclusion, so then to control the bad environmental influence in following works of the project. The evaluation and monitoring of environmental management plan mainly include: Page 33 31 1 The implementation situation of environmental management plan: any change in environmental management system, main contents of construction in this stage, problems existed in the implementation of EMP and causes, and the next improving measures; 2 Environmental monitoring result: make simple notes on data, explain the existed problem, non-standard phenomenon and the causes, suggest improvement measures; the complaints from residence and solutions shall be included when necessary; 3 General conclusion on the environmental monitoring and evaluation of this stage and the suggestions and plan on the works of the late half year; Besides the above monitoring report, the construction unit shall prepare daily and month reports and submit them to upper competent department and local public sanitary department. (2) Environmental Report after the Completion of the Project After the planed project being put into operation, the environmental monitoring unit shall prepare periodically usual Environmental Monitoring Report, mainly including setting of environmental management institute and the operation of project, the implementation of the approval opinions of Public Sanitary Department on prior reports, monitoring system (including time, frequency, point site, applied instrument and equipment and applicable standard, etc.), statistic analysis on monitoring data and planed preventive measures for further pollution, etc. The Environmental Monitoring Report prepared by environmental monitoring department shall be submitted to Huaibei Environmental Management Project Office, and will be submitted to the World Bank, Anhui Provincial Environmental Protection Bureau and Huaibei Municipal Environmental Protection Bureau by the Immigration & Environmental Evaluation Department of the Loan Program Leader Team of the World Bank of Huaibei to report the implementation of environmental protective measures. 4.3 Environmental monitoring expense The cost of environmental monitoring should be included in the overall budget of the Monitoring and Evaluation (M&E) program of the project to ensure its implementation. After approval, the acceptance and monitoring of the completion can be made. Before the acceptance, the basic data to be prepared include Environmental Impact Report, Acceptance and Monitoring Report for the Completion of Environmental Protection Facility and Executive Report of Environmental Protection, etc. Page 35 33 5 .TRAINING PLAN To ensure the effective implementation of the environmental management plan of the project, all personnel, especially the construction personnel shall be trained with the contents and requirements related to environmental management plan and knowledge and skills related to environmental protection and safety production. Besides the importance and significance of the project to be built, trainings with different focuses shall be made to personnel in different positions. The training will be taken in different methods according to different management levels and environmental protection positions. The concrete training plan refers to Table 5-1- 1. It should be integrated into the overall training program of the project. ENVIRONMENT PROTECTION INVESTMENT ESTIMATION According to the related national requirements, a serial of effective environmental protective measures are adopted in the project and the environmental protection investment is initially estimated as RMB 18.73 million, covering 4.71% of the project investment. Article 2 The project construction site hereby refers to the approved site occupied by housing construction, civil engineering, equipment installation, pipe laying and other construction activities of industrial and civil projects. Article 3 All construction activities and construction-related units and individuals must comply with these provisions. Article 4 The State Council administrative department in charge of construction is responsible for management of the project construction site nationwide. The State Council administrative departments are responsible for management of project construction site conducted by respective subordinate entities directly. The administrative departments in charge of construction of local people's governments above the county level are responsible for management of the project construction site within their administrative range. Chapter II Common Rules Article 5 The licensing system is established for ground breaking of construction project. Construction units should submit the application for ground breaking permit according to the plan to the concerned administrative departments in charge of construction of local people's governments above the county level where projects are located. Construction permit applications shall meet the following conditions: 1 The design drawings are available. Page 40 38 2 Land acquisition has been completed 3 The Contractor has been finalized; 4 Funds, materials, and construction services for municipal public facilities have been settled and assured 5 Other requirements have been reached. Construction units without permits are not allowed to organize ground breaking of the construction at will. Article 6 Construction units that have obtained construction permit shall start construction within two months from the date of approval. Construction units could apply for extension prior to the expiry in case they are not able to start construction on schedule for some reason. The construction permits are invalidated with neither ground breaking on schedule nor application for an extension. Article 7 Prior to construction, the construction unit or contracting unit shall designate its representative, and the contractor shall designate its project manager. A separate written notice covering the name of the representative, the project manager and corresponding authorized tasks should be submitted to the other party and reported to that permit license issuance authority concerned with the provisions of Article 5. In case of variation of the representative or the project manager during construction, the relative information should be noticed to the other party and reported to the concerned authority in accordance with the preceding paragraph. Article 8 The project manager has overall responsibility for construction site management and organizes implementation. The responsibility system of construction site management should be established corresponding to the project size, technical complexity and the specific circumstances of the construction site. Page 41 39 Article 9 In terms of the contractor and subcontractor, the contractor is responsible for the overall package of construction site management, supervision and inspection of construction site activities of the subcontractor. The subcontractor should set up site management responsibility system and organize the implementation within its contract range under the general management of the contractor. The contractor might be entrusted by the construction unit to be responsible for coordination with other contractors regarding site activities. Article 10 The contractor must prepare project implementation organization design. In case of contract and subcontract, the contractor prepares project implementation organization design or designs by phase while the subcontractor prepares corresponding implementation organization design under general management of the contractor. The construction organization design shall get examined and approved by levels in relation to its administrative jurisdiction, the engineering nature, scale, technology complex. Specific examination and approval limitation are explicated by the administrative departments of the State Council, the provinces, autonomous regions and municipalities in charge of construction. Article 11 The construction organization design should cover the following contents: 1 Construction tasks 2 General construction scheme, working methodology, project progress schedule, major components progress schedule, construction mobilization, machines and arrangement; 3 Various technical measures concerned with quality, safety, environment protection; 4 General layout plans of construction; 5 Contract and subcontract tasks and intercrossed construction arrangement. Page 42 40 Article 12 Construction shall be implemented in accordance to the approved construction organization design. Any major modification shall be confirmed by concerned authority. Article 13 Construction shall be carried out within the approved site. Approval should be obtained in need of temporary use of land or road for construction. Article 14 A report should be submitted to the concerned administrative department in charge of construction of local government in case that construction unit or contractor has to stop construction over two months for some reason. Article 15 Blasting operations in construction should be examined and permitted by relative authority. The application for "Permit of the Use of Blasting Materials" shall be submitted to the municipal or county public security bureau, stating the use of blasting materials, location, name, quantity, intended purpose, the distance of its neighbors and security procedures. Blasting operations shall be conducted strictly according to blasting operation requirements. Article 16 Approval should be obtained in need of temporary power grid and telecommunication cables in construction. Concerned works should be processed under special technicians after approval. In need of shutting down tap water, electricity or closing roads that might affect surrounding entities and residents, approval shall be achieved from the concerned authority and relative notice should be announced to affected entities and people beforehand. Article 17 In case that any cultural relics, ancient fossils, explosives, or cables are discovered in construction, works should be suspended and that site should be well protected. Information should be immediately reported to concerned authorities. Works would be continuous after adequate measures are undertaken. Article 18 Upon completion of construction, the construction unit shall organize the designers and contractors to prepare construction completion plan together, conduct Page 43 41 assessment on project quality, file a variety of technical information and documents, timely complete previous examination and submit inspection reports to the relative administrative authority. The qualified individual works can be transferred to the construction units when inspection is completed. After passing the acceptance of all the works, the contractor in order can disarm all of the construction site management responsibility. Chapter III Civilized Construction Management Article 19 The contractor should meet civilized construction requirements, carry out modern management methods, scientifically organize construction, and well manage construction site. Article 20 The contractor should be in accordance with the general layout plan of construction in need of temporary facilities. Internal roads and security facilities could not be occupied to place bulk materials and finished products, semi-finished products, machinery and equipment. The subcontractor could not vary the general layout plan of construction before obtaining agreement from the contractor. Article 21 Signs must be set clearly on construction site, indicating the project name, construction units, design units, contractor, project manager’s name and construction site representative’s name, date of construction commencement, the completion date, and approval document number of construction permits. The contractor is in charge of protecting signs on the construction site. Key management personnel at the construction site should wear their identity card. Article 22 Installation and operation of power lines, electricity facilities at construction site must comply with relative norms, procedures and construction organization design. Arbitrary lines are prohibited. The construction site must be equipped with night-time lighting to ensure the safety. Lighting facilities as well as Page 44 42 hand-held lighting appliance in the damp places must meet the safety requirements regarding voltage. Article 23 Machines should be located in the places and lines required in the general layout plan and are prohibited to occupy internal roads. Machines can only be operated on site after security check. Concerned operators should set up machinery responsibility rules and wear identity cards. Those without identity cards are not allowed to operate machines. Article 24 The contractor should ensure roads and drainage systems of the construction site in good used condition, maintain field clean, and clear up construction waste at any time. Signs related with covers of wells or grooves and construction should be properly set up in the access of vehicles and pedestrians. Article 25 The contractor must apply laws and regulations regarding safe production and labor protection, establish safe production responsibility system, strengthen education and safety awareness, and strictly enforce safety technology program. A variety of safety facilities and labor protection equipment at construction site are subject to regular inspection and maintenance, and timely elimination of risk to ensure safety and efficiency. Article 26 The construction site should be equipped with all kinds of necessary facilities for employees’ life, which should reach requirements in aspects of hygiene, ventilation, lighting and others. Employees’ diet and drinking water supply should comply with health requirements. Article 27 The construction unit or contractor should do well in security protection, and take necessary anti-theft measures by erecting fence around the site. Enclosing fences would be built around the construction site in urban areas. Enclosing facilities should be set up for scaffolding structures along the street. Non-construction workers are not allowed to enter the construction site. Page 45 43 Article 28 In case non-administrative departments in charge of construction take inspection on site, agreement shall be achieved through concerned administrative department in charge of construction of local government. Article 29 Contractor should stick to the "Fire Services Ordinance of the People's Republic of China ". Corresponding provisions of fire safety management system at the construction site should be set up and implemented. Fire prevention facilities are required to be installed and well maintained. Special fire safety measures should be adopted at construction site in the fire-prone areas, or in storage or use of flammable and explosive materials. Article 30 Major accidents taking place at construction site would be processed according to " Reporting and Investigation Procedures Regarding Major accidents". Chapter IV Environment Management Article 31 Complying with national legal provisions on environmental protection, the contractor shall take measures to control a variety of dust, gas, waste water, solid waste and noise and vibration at construction site, Article 32 The following measures shall be applied to protect environment. 1 Properly handling the slurry water. Slurry water can not be directly discharged into the urban drainage facilities and river before treatment; 2 It is forbidden to burn molten asphalt, linoleum, paint and other materials that produce toxic and harmful smoke and odor gases at construction site, except for those with qualified devices. 3 Using closed loop of the tube or taking other measures to deal with waste at height. 4 Adopting effective measures to control dust in the construction process; 5 Prohibiting toxic and hazardous waste to be used as backfilling earthwork; Page 46 44 6 Taking effective control measures to alleviate noise and vibration of operating machinery. Article 33 In case that pollution can not be controlled within the stipulated range due to limitation of technology or economic condition, prior approval should be acquired from the administrative department in charge of construction of local government. Chapter V Penalty Article 34 Related penalties involved with warning, notice of criticism, rectification within limited time, suspending construction, cancellation of construction permits, together with imposition of fines are levied by administrative departments over county level according to degree of mistakes in terms of following anti-regulation activities. 1 Starting construction without construction permit; 2 Security facilities at construction site unqualified or under poor management compared to the standards of regulation; 3 Living facilities at construction site unqualified with standards of sanitation requirements; 4 Site management unqualified with standards of security and scene requirements; 5 Other actions violating regulations. Article 35 Violation of these provisions that constitutes public security penalties would be handled by the public security organs in accordance with the "Administrative Penalties for Public Security Ordinance of the People's Republic of China ". Violation that constitutes a crime would be handled by the judicial organs to judge the criminal responsibility according to law. Article 36 The party not satisfied with the decision of the administrative penalty may apply for a reconsideration to the higher authority within fifteen days from the date of Page 47 45 the punishment decision made by the authority. The party not satisfied with the decision on reconsideration may apply directly to the people's court on the date of receiving that decision. In case that the party does not apply for reconsideration or to the people's court, nor implement the decision of punishment by the authorities, the authority department may apply to the people's court for enforcement. The treatment would be processed in accordance with the "Administrative Penalties for Public Security Ordinance of the People's Republic of China" in case of actions against administrative penalties for public security. Chapter VI Supplement Article 37 State Council administrative department and departments in charge of construction of the provinces, autonomous regions and municipalities might develop and implement detailed rules in accordance with these provisions. Article 38 The State Council administrative department in charge of construction is responsible for interpreting these rules. Article 39 These rules will come into effect on January 1, 1992. The articles of the rules prevail if incompatible with "Provisions Regarding Construction Management" of the former State Administration of Construction released on May 11, 1981.
