Annex 2 - Basic information..............................................................................................71 2 Introduction Trung Son Hydropower Project is a multi-purpose project. This project will build a new 84,5- meter dam, create a reservoir with the capacity of 348 million m3, at the normal water level of 160 m. With the capacity of 260 MW (including 4 plant units, each unit of 65 MW), the project will provide 1,019 GWh each year to the national grid, contributing to the electricity shortage reduction and economic development. The project includes 4 components as follows: ï‚· Dam construction. This component includes the construction of main dam, spillway, intake, pipeline, machine compartment (room) and tailrace canal, supplying and installation of electric equipment and machine. Investing auxiliary structures includes access road and bridge, roads within the construction site and worker camps will be included in this component, like construction design consulting. ï‚· Construction of transmission lines, one from supply station to the connection point of Hoa Binh – Nho Quan 220kV line and one 110/36kV line from Mai Chau to construction site. ï‚· Compensation and impacts minimization, including the implementation of resettlement, livelihoods restoration, ethnic minority‟s development, environmental management and community health management plans. ï‚· Providing technology assistance to support the preparation of other hydropower projects and improving capacity to meet the demand of international best practices for hydropower development. The total cost is USD 386 million of which USD 35.1 million is for resettlement and livelihoods restoration for people (of which about USD 2 million is for livelihoods development of people in affected area) and about USD 2.3 million for environment management. Vietnam Electricity has officially proposed World Bank a loan of USD 330 million. The project affects 27communes and 02 town, 5 districts of 3 provinces of Son La, Thanh Hoa, and Hoa Binh. According to current estimate, the total number of households affected by land acquisition of all project‟s items are 2,327 households ( 10,591 persons), of which 1,516 households ( 7,012 persons) having land recovered. There have been many consultation batches carried out from 2004 to present by different consultant unit. There were two consultation batches with the communities and communes carried out in 2008 to (i) inform the households and communities who likely to be affected by the project about impacts likely to happen, (ii) collect information and initial feedbacks from them that can be used as input data to prepare for the project, particularly RLDP and EIA/EMP reports. The first consultation batch was carried out in 14 villages in the reservoir area of which the households had to relocate. The second batch was carried out in other 34 villages affected by the project including the villages along the road, villages affected by agricultural land in reservoir area and villages affected by downstream environment toward Co Luong district 3 town, Mai Chau disrict, Hoa Binh province. The total number of villages affected by the project and consulted is 53 (including additional villages that were found during this consultation batch). The consultations were carried out at all levels including: ï‚· Community level with 53 (adding 05 villages) villages and 29 communes in project area. ï‚· District level : 5 districts affected directly by the main project construction and auxiliary structures are Tan Lac district, Mai Chau district of Hoa Binh province, Muong Lat and Quan Hoa districts of Thanh Hoa province, Moc Chau district of Son La province ; ï‚· Provincial level : the province consultation was carried out in Thanh Hoa and Son La provinces; ï‚· Consultation with NGOs throughout the country ; The consultation was also opened to anyone who care about the project. Consultation process from 2004 to 2008 has contributed to adjust the plans and designs of the project to minimize environmental and social impacts which the project construction would cause to the area and communities. The mitigation measures have been integrated and built into two management and implementation tools which are the Resettlement, Livelihood and Ethnic Minority Development Plan (RLDP) and Environmental Management Plan (EMP) ; This consultation batch was conducted in early 2010 (i) to inform affected households and communities, local authorities and social organizations about the possible impact that project caused and suggest measures to minimize such impacts. Information provided in RLDP and EIA / EMP must be published in advance in the area affected by the project, VDIC and Infoshop VDIC at least three weeks prior to the consultation, (ii) to collect comments / feedback to complete RLDP and EIA / EMP, and (iii) to have the initial agreement / commitment collaborating with local authorities in the implementation phase. To have good consultation results, the consultant team performs consulting work to follow the consultant rules, to ensure openness, transparency, voluntary and they are informed to the people consulted in advance. The preparation of consultation document is based on the results of the Social Evaluation and the results from previous consultations. There were 10 types of documents built and announced to the households, communities, people's committees at all levels 21 days prior to the consultation time. Communication materials were published in the form of short, easily understood and diversified. There were posters and paintings to attract people‟s attention. The documents has also been translated and published in languages of ethnic minority communities affected, which are Thai, Mong, and Muong. In order to increase the effectiveness of communication and consultation, cassettes and propaganda audio tapes in ethnic languages need to be delivered so that people (especially vulnerable groups) can easily access the project‟s documents. 4 The consultation was informed in advance with wide participation of local people, including women, the youth and the elderly. The local, domestic and international NGOs have been facilitated to participate in the consultation process. Consultation activities have gained many ideas from all level including community, commune, district, province and NGOs. The comments focused on the proposal of supplementing mitigation measures for environmental and social impacts of the project on the area and the community based on the reality of each region. ï‚· At community level, ideas of people focused on details and practical aspects in the process of resettlement and receiving compensation. Comments on livelihood improvement and livelihood restoration plans are proposed to add to the completion and clarification of activities in the report. ï‚· Consultation results from the districts focused on solving problems likely to happen during implementation process. Coordination measure is used to ensure security, and clarify the responsibilities of all parties involved. ï‚· The opinions of NGOs helped to complete the reports of the project. NGOs‟ concerns focused on monitoring mechanisms of contractors in the implementation process; ï‚· Ideas at district and provincial levels focus on measures and coordinating methods between the Project Management Unit and other levels in order to implement the project, with the best results. 5 Trung Son Hydropower Project 1. Objectives of the Project Trung Son Hydropower Project is a multi-purpose project. This project will build a new 84,5- meter high dam creating a reservoir with the capacity of 348 million m3, the normal water level is of 160m. With the capacity of 260 MW (including four plant units, each of 65 MW), the project will provide 1,019 GWh per year on average to the national grid, thus contributing to the power shortage reduction and economic development. Hydropower reservoir will regulate the flow regime of the Ma River basin in Thanh Hoa province, thus contributing to reducing flood in Ma River basin. The dam will also provide water to meet the demand of industrial, agricultural, tourist, waterways and aquacultural development. The construction of 20.4-km long access road from the Co Luong of Hoa Binh province to the dam. The transmission lines will be built to supply electricity to the site during construction process and transmit electricity from the project to the national grid during the plant operation. 2. Scope of the Project Trung Son Hydropower plan includes components as follows: ï‚· Dam ï‚· Concrete gravity dam ï‚· Spillway in river-bed ï‚· Intake on the left bank of the dam ï‚· Pressure steel pipe with crack model; ï‚· Power generation plan ï‚· Outdoor Power Distribution Station ï‚· Concrete gravity dam Besides, the project also includes other components as follow: ï‚· Access road and construction roads ï‚· Dyke used to serve the construction implementation ï‚· 35Kv line supplying electricity to the plan during the implementation process ï‚· 220Kv transmitting electricity to the national grid when the hydropower plan come into operation ï‚· Rock dumps ï‚· Resettlement area for households who have to relocate ï‚· Auxiliary structures: worker camps, construction site operator, stores, material storage yard. The total cost of the project is USD 386 million, of which USD 35,1 million is for resettlement and livelihoods restoration for people (of which about USD 2 million is for livelihoods development of people in affected area) and about USD 2,3 million for environment management. 6 3. Position of the project Trung Son Hydropower Project will be built on Ma River, which is 700 m far from the confluence between Ma River and Quanh Stream branch in the direction of lower section. The main construction of the project will be built in Trung Son commune, Quan Hoa District, Thanh Hoa Province - Viet Nam. Project area is defined as areas influenced by social or environmental impacts in Trung Son Hydropower Project. This region includes communes in the upstream area of the water reservoir, communes contiguous with either the water reservoir above the dyke or along the river below the dyke as far as the confluence with Luong river which is about 65 km to the direction of lower section. This region also includes communes which are expected to have entrance and electricity lines going through. Table 1 shows the number of communes pursuant to administrative location and type of impact and defines all communes in the scale of RLDP. Map 1 presents communes and types of impact. Map 1: The area of Trung Son Hydropower Project The construction of the dyke and the reservation of water in water reservoir will affect 5 communes and 1 town of Thanh Hoa Province and 2 communes in Son La Province. In Thanh Hoa Province, the water reservoir will make Trung Son commune in Quan Hoa District, communes such as Muong Ly, Trung Ly, Tam Chung, Ten Tan, and a part of Muong Lat town in Muong Lat district flooded. In Son La Province, the water reservoir will influence on Tan Xuan and Xuan Nha communes in Moc Chau District. 7 It was totally defined that 39 current mountain villages (and one hamlet) under 7 communes (and one town) will be affected on livelihood by the water reservoir and construction site. The three districts affected by the construction are just the mountainous districts which have poor infrastructure and are difficult to access to social services. The means of support of the people here are mainly agriculture including cattle breeding and forest product exploiting. There are few households having additional income from handicraft and small business. The travelling from affected mountain villages to the centre of the commune is very difficult; the price of agricultural products here is rather low compared to other places while the price of necessities for life is really high because of bad transportation. The climate in this region is rather severe. Almost all people live on their land with agricultural plant cultivation. In districts such as Quan Hoa or Moc Chau, luong plants bring a source of income for people who work in agriculture. And Luong currently has become the main products since 2000 in these districts, especially the two communes affected by the project: Trung Son commune where the dyke is constructed and Tan Xuan commune which is affected by the water reservoir. Outside the area flooded by the reservoir-bed, the project will take the land in some other places of Hoa Binh province and Son La province to built the construction executing entrance and electricity lines. The construction executing entrance influences on 5 communes of two districts which are Quan Hoa district of Thanh Hoa province and Mai Chau district of Hoa Binh province. The execution of electricity lines will affect 11 communes of 3 districts under two provinces. These are Quan Hoa district of Thanh Hoa province, Mai Chau district and Tan Lac district of Hoa Binh province. For the impact of the lower section, the project is evaluated to cause some impacts for the lower section of this region which is at the confluence of Luong river and Ma river. The communes in the lower section of the dyke are in the area of Quan Hoa district, Thanh Hoa province. Like this, the executing items of Trung Son Hydropower Project will have impacts on 27 communes and 02 town in 5 districts under 3 provinces which are Son La, Thanh Hoa and Hoa Binh. After moving, the total number of 34 places (in which there are 12 resettlement places including 6 moved places and 23 current mountain villages) in the main region of the project will need support to recover their 9 livelihood. There are about 2,700 householders in this region. Some of households living in mountain villages at the lower section of the dyke may be suitable to be compensated according to RP of the main project, and some of these mountain villages will need support to improve their livelihood. The ability of harmfulness in affected mountain villages which have to move due to the main project is really high. The general poor and hungry level in these mountain villages is 79%, and 41% of households is reported to be ill-nourished within 3 months. The ratio of “poor householdâ€? pursuant to criteria of Ministry of Labour, War Invalids and Social Affairs (MOLISA) reach 100% in all mountain villages which are all in Muong Lat district. The ability to cope with livelihood of ethnic minorities with little integration is also lower. Other groups which are easy to be harmed include households having female householder with dependants, households having disabled or illiterate householders, and households without land and stable means of support. 4. Consultation in planning In 2004, the consultation unit 4 carried out activities in order to built temporary regulation and make general planning for migration - resettlement serving the NCKT report of Trung Son Hydropower Project (Uon mountain village). The consultation unit implemented the investigation in land lost (forest, cultivated land, plant, fruits ...), houses, constructions, architectural things of households and public properties, quantified the value of the lost and assessed the impacts on socio-economic development and environment of the Project area based on expected measures and defined the demand of resettlement for households which have to move due to the flood, the number of households which have land flooded but do not have to move. In 2005, the consultation unit 4 carried out consultation activities with local authority and heads of resettled mountain villages in order to define the location of resettlement for mountain villages such as Ta Ban, Xuoc, Nang 1, Tai Chanh, Muong 2, Ta Lao Dong and Ta Lao Tay. ï‚· Ta Ban is arranged with 3 resettlement places (Co Tong - Ta Ma area; Ban Poi area and Na Phuc area to accept all peole in Ta Ban) ï‚· Xuoc moves to Puon. ï‚· Nang has 2 plans: Hinca resettlement area and Chalan resettlement area ï‚· Tai Chanh: resettle in new Tai Chanh ï‚· Chieng Ly is expected to move to the way from Ban Lin to Chieng Ly ï‚· Lin moves to Lin inside. ï‚· Tay Ta Lao is expected to have 2 plans: Plan 1: Move to the way towards the centre of the commune. Plan 2: Move to Na Hang - Pien Dien ï‚· Dong Ta Lao: Move to Na Hang - Pien Dien. 10 After investigating the resettlement area, the consultation unit 4 adviced with 3 districts which are Moc Chau, Quan Hoa and Muong Lat. The resettlement areas are basically approved by the People‟s Committees of districts, except Ta Ban People‟s Committees which chose Pieng Pong Ta Ban mountain villagers (this is the area on the left bank of Ma river - Ta Ban is on the right bank of Ma river). In Tan Xuan, very few people wants to move to Na Hang - Pien Dien for not having enough land to cultivate. In 2007, the representative of consultation unit 4 together with Project Managing Unit 2 had an appointment with mountain villagers to inform the area of resettlement and compensation policies for Trung Son Hydropower Project. In 2008, as requested by EVN, the Project Managing Unit of Trung Son Hydropower Project was established and was required to implement activities in social, environmental assessment, socio-economic investigation and consultation for the project area. This aims to prepare a good reality for the development of international standard hydropower project. Pursuant to the requirements and policies of WB, the consultation activities were carried out together with other activities in this time. Social assessment The social assessment was carried out in 2008. The purpose of social assessment is (a) to assure that ethnic minorities and all other beneficial parties have their own voice in making decision for all matters related to their benefits, (b) to minimize negative impacts caused by forced resettlement and (c) to avoid disputes which can happen during the time of the project. It is necessary to notice at leading forms and religion as well as tradition while reflecting ideas from small groups in communities. The internal consultation group worked in 6 communes (Trung Son, Tam Chung, Trung Ly, Muong Ly, Xuan Nha and Tan Xuan) who are affected by the main construction and 3 communes (Trung Thanh, Thanh Son and Thanh Son) which are affected by the entrance. The consultation used the fast assessing method with the participation of community (PRA) and deep interview (community leaders, village patriarches, and people having religious role in the mountain villages), group discussion (in gender, age groups). The social assessment defined beneficial parties, official and unofficcial public organizations, and challenges in compensation and local culture conservation. Socio-economic investigation The socio-economic investigation activities combined with an assessment on livelihood was also carried out to specifically defined opportunities and challenges in recovering the livelihood. This contributed to the community CLIP strategy. The health consultation aims to support the preparation of managing plan in public health for workers, and supplemental methods for ethnic minorities. The consultation with mountain villages is carried out based on the affecting level on households in the project region. Damage investigation This activity was implemented with 100% of affected households in order to support the resettlement plan. The consultation activity on choosing resettlement methods was also carried out. 11 Other consultation Assessment activities on environment, health, cultural properties, ecological variety, fish and fishery were also implemented combined with the consultation for affected communities, the Managing Units of Hang Kia - Pa Co, Pu Hu and Xuan Nha Nature Reserve. Healthcare, education organizations, ethnic unit of the locality, local banks and local CBO were also consulted. The consultation during the plan making used many different measures including meeting, individual interview and group discussion. The participation of communities was assessed to be active. The mountain villagers were ready to discuss and share points of view. Especially, the participation of women was rather active; however the women in Mong community had little participation in the discussions. Minimizing measure Due to factors which are easy to be harmed by ethnic minorities in the Project area and based on the impact level of the project on environment, it is recognized that plans to minimize impacts of the project on the environment and people‟s life are needed. There were efforts to minimize social and environmental impacts on the process of planning and preparing the project. A plan of Environmental Management and Social Security were carried out. Based on the results of different researches, RLDP was built and included: ï‚· Plan for resettlement; ï‚· Plan for developing ethnic minority; ï‚· Plan for improving and recovering livelihood; and ï‚· A part of information technique support to enhance ability. Adjusting the design and planning There are 4 designs given to choose. In correlation with normal water levels of the reservoir- bed and the calculation for the impacts of land taking and resettling, the measure in which the normal water level is 160m is chosen. This measure not only assures the economization of the project construction but also minimizes impacts on the society and environment in the region. Through the consultation process, the adjustments of resettlement areas planned in Trung Son commune and Tan Xuan commune were carried out pursuant to the people‟s desire and choice. The new resettlement areas with smaller area which were reviewed and chosen meet the water requirement for manufacture and daily activities. These areas also have fatter land although the number of householders which can reside is less than the old ones. In Tan Xuan commune, the adjustment of resettlement area was also carried out and the new resettlement area was defined pursuant to the desire of mountain villagers in Ta Lao Dong and Ta Lao Tay. All resettlement areas chosen in 2008 (i) meet the desire of people in places where they have to leave; (ii) are near the old places; (iii) have enough water and better land; (iv) do not arise any affected households because these are the old lands and the military areas which are transferred to arrange the resettlement for the project. Moreover, these chosen new resettlement areas also do not have pressure on the forest resources as well as the initially chosen measure. Investigations in alternative prices for compensation of affected properties were also carried out and a new, additional amount for the affected areas of Luong plant was proposed to be higher than the initial estimation. 13 Livelihood The consultation process also resulted in a making a plan to Improve and recover livelihood for local community - according to the livelihood development strategy based on land and assure the stable development which were carried out. Plans for improving infrastructure in receiving and affected mountain villages and the transportation into those areas were made. Activities to improve the land in order to compensate for lost land area which can assure the food and verify people‟s income were studied and designed in the plan for livelihood improvement and recovery. Activities to train, built capacity for households as well as related parties of CLIP were also built. Non-agricultural activities such as various breeding activities, forestry (luong tree, types of woods, rubber tree, and eucalyptus) and aquaculture inside the reservoir, the support to access credit and create market for the outcome of agricultural products were carried out. For training activity, the creation of employment for the youth and reception of local human resources into the project were also built in this plan. Plan for developing ethnic minorities and other joined matters Due to the fact that affected communities are ethnic minorities, the activities of the project must be suitable with the culture of these communities. Through the consultation, a plan for developing ethnic minorities was formed with activities designed to be suitable with the custom of each ethnic minority. For ethnic minorities which have to move, the support to carry out religious ceremonials was concerned and physical culture heritage was assured to be researched with suitable measures. The access to healthcare services and activities to enhance the ability, awareness were also designed to support ethnic minorities (especially women and youth) to cope with social evils, drug abuse, HIV/AIDS prevention, diseases infected through sex relation and also through water ... Assessment of environmental impact and plan for environmental management Based on the Assessment of Environmental Impact of the project which was approved, a lots of supplemental researches were carried out in the Project area in order to consider, review thoroughly the impact level of the project construction on the regional environment. The following researches were carried out with enough concern on different impacts including social factors. The report on Analyzing the economic efficiency of Trung Son Hydropower Project describes the hydrographic conditions and estimates the electricity generation capacity of TSHP and checks potential affects of climate changes to hydrographic conditions. The report also considers potential benefits from increasing metal and carbonic absorption of Trung Son Hydropower Project. The economic analysis was completed pursuant to the standard of World Bank and finally, analysis of alternatives, consideration of policy choice in case of using gas or coal process jointly to replace Trung Son Hydropower were carried out. 14 Assessing impacts caused by Trung Son Hydropower Project on Terrestrial diverse biology and reservation zone shows a large number of flora, mammal, amphibian and various types of birds in three Nature Reservation Zone in Trung Son. Currently, the project area are facing with significant outside pressure (such as hunting, laying traps, ...) and reservation efforts which do not meet standards due to the lack of awareness on reservation and managing ability. Methods of decreasing were mentioned to process impacts directly and indirectly related to the project on the biological diversity on natural areas. The plan of cleaning vegetation covering the reservoir describes the vegetation on the flooded area of the reservoir. This report describes the current landscape in TSHPP area, defines the volume of luong tree and the social and environmental impacts related to people living in this area. The results of clearing and flooding related to the increase of fragments and the nutrition of rivers in the reservoir were also discussed. Report on Investigating physically cultural resources in the area of Trung Son Hydropower Project filing archaeological landscapes, important history and culture in TSHPP area. Some burial grounds, sacred land and antiques will be affected directly by the project and resettlement requirements. Findings of the report summarize possibly excavating measures and proposing following research ideas at important cultural places which are chosen. The assessment of impacts of Trung Son Hydropower Project on Fish – biological diversity and the proposal of decreasing measures in 2008 reports briefly on five spaces of a river system: headwater of the reservoir; flooded areas; the river fragment between the dyke and electric plant; the river fragment between the electric palnt and the confluence of the largest river branch; and the lower section of the project. This report defines great effects and describes their possible affects on different environmental processes. Reports of investigation results nd Analysis of biological diversity data on Fish ad Maritim products illustrate the diversity of maritime products in TSHPP area and describe the economic roles of fish for local people who are now living near Ma river. The purpose of this report to assess the value of biological diversity of fish in the affected areas of the project, the headwater and lower section of the dyke in order to define socio-economic conditions and the importance of aquaculture activities for local people. The protein in fish plays an important role in the nutrition of local people; however, the economic benefits from fishing are rather low and depend on each position on Ma river. The report on assessment of impacts on health and public healthcare activity plan for Trung Son Hydropower Project assesses the health of people living in the proposed area of the project, huts and related areas. Public Healthcare Activity Plan (PHAP) connected with describing local healthcare and resettlement programs in the prevention and decrease of useless impacts on health. The report has two purposes: complete the preparation and build hydropower project with high quality and meeting the international healthcare standard; and combine different assessment methods in one project to assure the stable and improved life of people affected by the project. The report on Improvement research of construction activities and huts for workers in Trung Son Hydropower Project defines, analyzes and estimates the number, components and characteristics of waste and other impacts related to waste. The report also mentions in details the methods to minimize impacts on the environment and describes some programs, plans and executing activities in order to manage reasonable these confluences. 15 A report on Hut management and Construction assesses impacts of activities related to construction and activities of about 4,000 workers in the construction huts. Decreasing methods were designed to minimize potential impacts on the surrounding environment and the livelihood of local people. The results of these reports help to build an assessment on Supplementally social and environmental impacts of the project and thereby build an Environmental managing plan as a tool to minimize unbeneficial impacts of Trung Son project construction on the environment and people‟s life. 6. Communication and information tools The third consultation is carried out in order to (i) inform potential affected households and community and recommend methods to minimize its impact. The information provided in RLDP and EIA/EMP must publicized in the affected area, VDIC and Infoshops at least 3 weeks before the consultation; (ii) collect ideas/ feedbacks to finalize RLDP and EIA/EMP, and (iii) have the initial/ cooperative agreement with the local authority in the implementation process. The communication and information tools for consultation sessions are designed and used for each group of different target beneficiaries. Basing on the Report on social assessment and results from previous consultation periods, the building and publishment of materials, tools for information dissemination and community consultation have to meet the requirements as follows: ï‚· Materials have to be printed out and delivered directly to households, villages, communes, districts and province and other organizations. ï‚· These materials have cover and involve all aspects that the project can have impacts on, such as, environment, society, ethnic minorities and residents‟ livelihoods. ï‚· Materials have to meet the requirements of the consultation, they are as follows: (i) overcome the language barrier, (ii) pay attention to the illiteracy percentage in residents in especially difficult villages; and (iii) the diversity of ethnics. ï‚· It is sure that all residents in the affected area can approach the project‟s materials with the attention to sensitive groups and possibly illiterate ones, in this case, materials must be in the forms of audio, readable, visible; and therefore, comprehensive and interesting to participants so that they can give feedbacks. In order to meet the demand of materials, the consultation unit, under support of international consultant in community consultation, WB‟s staffs, staffs from EVN, Project management Unit of Trung Son Hydropower Plant have discussed and come into an agreement in terms of content, forms and also the quantity of the project‟s document types. Audio materials (recording) Language used in the information dissemination in audio materials is Thai, Mong, Muong and Vietnamese. However, ethnic groups are divided into geographic regions and there is difference 16 in local language, the production of audio materials should pay attention to this aspect. The results of previous consultation periods show that: i. Language of Thai people in this area widely used is the pronunciation with innovation and some words belonging to white Thai in the western areas of Thanh Hoa and Nghe An province, therefore, the speaker in the audio materials must be white Thai in these area otherwise, residents cannot comprehend the audio materials if the speaker is black Thai from Son La province; ii. Mong community in the project area are mainly from Lao Cai, Cao Bang province migrating to this area recently, so the pronunciation and the intonation are mostly the same with red Mong group from Lao Cai province. iii. Both types can meet the following demands: (1) provide main project‟s information – including main contact addresses of Project management Unit of Trung Son Hydropower Plant; (2) colorful and attracting audience and (3) have short and comprehensive notes. Printed materials Materials for reading and reference include: ï‚· Summary report – delivered to all levels. ï‚· Information sheets – used for being read on the loudspeaker systems at commune, village and kept in the village leader‟s house; ï‚· Questions and answers – delivered to all levels and read by residents and used in the consultation process; ï‚· Full reports include: (a) Report on environmental impact assessment; (b) Report on environmental management plan; and (c) Report on resettlement plan, livelihood recovery and improvement plan and Ethnic minority development plan. 17 Materials delivered to village level must ensure to: (a) be short and comprehensive; (b) avoid using technical terms; (c) avoid using abbreviations and foreign words; (d) be enough with the main information and (e) be with pictures and easy to use. Materials – full reports - are publicized at commune and district level have to ensure (a) to have enough information; and (b) to be easy to use. Materials are advised to publish include: ï‚· Summary report on RLDP and EIA/EMP – materials are designed in 30 pages and with colored pictures and can provide main information on environmental, social and community impacts residents. This materials also provide name, address and phone number of main relevant parties those are in charge of the project implementation; ï‚· Information sheet (PIP) with the length of 02 pages – is to serve at loudspeaker systems at communes, districts and provinces; ï‚· A set of Frequent answers and questions (FAQs) 05 pages – is delivered to all levels from village to province to serve for inforamtion dissemination and consultation. This materials is also translated into 3 languages of 3 ethnic minorities living in the project area, including Thai, Muong and Mong group; ï‚· A set of tapes, disks recording FAQs in 4 languages (Vietnamese, Thai, Mong and Muong). These tapes and disks are recorded by speakers from the Voice of Vietnam and ethnic minority specialists in the consultation group. ï‚· Sole calendar sheets (1 page - 4 colors printed) of Trung Son Hydro-power Project consist the map of the project area (including all main components) which are published to deliver to affected households with the names, addresses of main units in charge. ï‚· A set of poster (A1 size) which is printed in 4 colors includes 3 sets pictures to disseminate environmental impacts, livelihood improvement and recovery activities and the project‟s map. The posters are delivered to all lelvels, from the village level to above levels and are requested to sticked at crowed, public places and cultural houses at villages; ï‚· Enough RLDP Report to deliver to commune, district and province level; ï‚· Enough EIA/EMP Report to deliver to commune, district and province level; The amount of all materials (calendar sheets) is calculated to sufficiently deliver to affected households and interested people can approach the information. Tools used in the consultation process under the form of pictures in small size (A4 size) which are printed colorfully and illustrate the environmental and social impacts and methods to minimize these impacts. Diagrams on complaint process and implementation are drawn in Ao size with different shapes to illustrate the community more easily. 18 7. Consultation process 7.1. Community consultation: Affected scope in 53 villages and 4 communes includes construction site space, lake-bed, resettlement areas, and lower sections of the dam. The consultation at community defines that: ï‚· Subjects are ethnic minorities, including: (i) affected peoeple; (ii) people who are interested in this project; (iii) women in ethnic minorities who may not understand Vietnamese and be shy in communication; ï‚· Potentially affected communities (i) are people who have to move due to construction of the main projects; (ii) are people who lose their land due to the project construction; and (iii) are people who are affected by the downstream of the dam. Therefore: ï‚· In consultant group, there should be specialists in ethnology and information should be broadcasted in ethnic languages with translator‟s assistance. The division in groups to carry out the consultation should apply to different ethnic groups; ï‚· Information provided to target groups have to be prepared in advance and be appropriate with affectedness types. The consultation process at community is carried with: Group 1 – Villages/ communes affected by the downstream, input road, transmission line and the construction of the main projects are where Thai, Muong and Kinh people are living in; Group 2 – Villages/ communes affected by the establishment of water reservoir are where Mong people are living in; Group 3 - Villages/ communes affected by the establishment of water reservoir are where Thai and Muong people are living in; To ensure the publicity so that interested parties can join the consultation process, the information announcement has been done 21 days before the consultation date. All project documents have been delivering to communities. Posters have been stuck on public places; such as community house of village, markets, commune People‟s Committee and densely populated places where are near traffic roads. Leaflets are delivered to commune People‟s Committee and village leaders. The leaflets‟ content has been broadcasted on local loudspeaker systems. 19 In case of audio materials, tapes are delivered one tape player and the village leader plays it in meetings held at villages before the consultation commencement. In order to prepare for all interested parties to join the consultation sessions, detailed schedules of consultation sessions at villages have been sent to village leaders with detailed guidelines showing how to approach these documents at village leaders‟ houses, commune and district People‟s Committee, and some other places including the clear addresses and phone numbers. 7.2. Consulation at district level The consultation at district level is carried out at 5 affected districts. Affected districts have different affectedness levels and different social and environmental impacts, in which: ï‚· Quan Hoa, Thanh Hoa province is affected by the construction of the main project, the water rising of the lake-bed, building of execution road and transmission line and the downstream impact; ï‚· Muong Lat district, Thanh Hoa province is affected by the water rising at lake-bed and raw materials mine; ï‚· Moc Chau district, Son La province is affected by the water rising at lake-bed; ï‚· Moc Chau district, Hoa Binh province is affected by the lower section, the input road and transmission line; ï‚· Tan Lac district, Hoa Binh province is affected by the construction of transmission; Regarding the district level, the preparation for consultation process is carried out at the same time with the consultation at village level. All documents and consultation schedules for each district are informed to district level attached with lists of representatives from communes‟ and districts‟ functional units and social organizations. A request to extend representatives is announced to district level on participants‟ demand and posters are stuck at head office of district People‟s Committee and district cultural house. 7.3. Consultation with NGO The consultation with NOG is carried at Hanoi city. To prepare for this consultation, all documents relating to Project management Unit of Trung Son Hydro-power Plant have been sent to representatives of Ngo and posted on the project‟s website. Besides these documents, NGOs are also provided with additional materials on their demand. Representatives of NGOs are invited to join with the consultation group throughout consultation process carried out at village, commune and district level in the project area. The letters of invitation to consultation sent to representatives of NGOs are also posted on World Bank‟s website and at Project management Unit of Trung Son Hydro-power Plant‟s website. This consultation involves the participation of local NGO groups at Trung Son, Muong Ly, Tan Xuan, Trung Ly and Tam Chung commune. These representatives from local NGOs are ones working at villages‟ and communes‟ Women Association, Farmers Association, Youth Association and are Muong, Thai and Mong people. 20 7.4. Consultation at province level Provinces participating in the consultation process are Thanh Hoa province and Son La province with different impact level as follows: ï‚· Thanh Hoa province – is affected by the construction of main projects, input road, transmission line, downstream and upstream; ï‚· Son La province – is affected by the water rising at lake-bed. Documents are delivered to and announced at province level 1 month in advance of consultation commencement and attached with schedules. Besides, documents relating the project are delivered to Service of Culture and Information at provinces and the head offices of Border Departments at provinces. Before the consultation commencement at province level, consultants have delivered summary reports to representatives and provincial NGOs. Documents relating to the project have also been delivered to the office of provincial People‟s Committee for relevant parties‟ convenience and reference. The Project management Unit of Trung Son Hydro-power Plant has assigned staffs to participate the consultation process and have sent request to broadcasted leaflets on loudspeaker systems at affected provinces and districts. Consultation activities are carried out at all levels in accordance with the planned schedules with the participation of relevant parties. Vietnamese NGOs have sent delegates to join the consultation process at community, district and province level. The content of consultation sessions is according to a preset order. The consultation group, with support from Project management Unit and consultation tools available, presented all information on Trung Son Hydro-power Projects and positive, negative impacts on the society and environment in affected area. Method to minimize environmental and social impacts also included in the presentation. Participants discussed and raised opinions, comments on the minimization methods mentioned by the Project management Unit. Throughout the discussion, the consultation group and representatives of Project management Unit made explanations and collected feedbacks from participants. Depending on levels and quantity of participants, discussions are held in groups, in age and in gender in order to collect all comments from participants. After discussions, comments were listed and summarized and read loudly to participants. The synthezation of comments at the end of discussions helps consultants and the Project management Unit understands interested issues from relevant parties and makes adjustment and addition in the reports. Agreements in which show comments, adjustment, addition to RLDP and EIA/EMP have been made by the Project management Board . Consultation activities are held in public with participation of affected households. Interested parties can join consultation process, such as teachers from primary schools at affected villages, residents who are not directly affected by the land withdrawing, representatives from the 21 Management Units of natural reserve zones and staffs from Forest management Station (Ta Com, Nang 1 village). 8. Main issues Through discussions, main issues and questions raised from consultation levels are noted as follows: 8.1.
