Compensation Financial/materialized coinpensation for DP, including cost estimate and loss compensation, support. Income restoration is the process to recover income, production activities and living standard for long time. Cut-of-date The date of announcement of component boundary to Displaced Persons and local communities, DP will be informed of the cut-off date for each Project component, and that anyone moving into the Project Area after that date will not be entitled to compensa.tion and support under the Project. Eligibility Any person who at the cut-of-date was located within the area affected by the project, its components, or other subproject parts ihereof, and would: (i) have formal legal rights to land (including customary and traditional rights recognized under the laws of the country); or (iij do not have formal legal rights to land at the time the census begins but have a claim to such land or assets - provided that such claims are recognized under the laws of the country or become recognized through process identified in the resettlement plan. (iii) Do nut have legal nor recognizable by laws right to the land they are occupying where they live orland have properties/assets, within the project area, before the cut-off date. Persons covered under (i) and (ii) are provided compensation for the land they lose and other support at full replacement cost. Persons covered under (iii) are provided resettlement support in lieu of compensation for the land they occupy, and other support, as necessary, to achieve the objectives set in this PF, if they occupy the project area prior to a cut-off date. Persons who encroach on the area after the cut-off date are not entitled to compensatiorl or any other form of resettlement support. Replacement cost is the term used to determine the amount sufficient to replace lost assets and cover transaction ccsts. When domestic laws (do not meet the standard of compensation at full replacement cost, compensation under domestic law is supplemented by additional measures necessary to meet the replacement cost standards. INTRODUCTION Viet Nam Urban Water supply developrnellt project - Stage I hati implemented in 16cornrnunes/towns in 4 provinces. There are 1 town in Hai Phong city and 15 tow~isin provinces of Thai Binh, Ha Nam and Bin11 Dinh. I11 2007, The project - stage I1has con[inously carry out in other provinces including Than11 Ha town (Thanh Ha District); Gia Loc town (Gia Loc District); lllanh Mien town (Thanh Mien District) and Minh Tan town (Kinh Mon District) in I-Iai Duong province. Main objects of the project are to expand coverage of clean water and sanitation and improve living standard and support poverty reduction activities to project town areas. Improvement of water supply and sa~iitationservice will be main factor for developing society and economy. The project includes four components: (i) credit for well-perfomting water supply co~npaniesfor investment (the Performance Route) to improve and expanding existing service; (ii) credit for water supply companies willing to procure new service delivery in currently unserved area through open competition (the Competition Route); iii) fund for small rotation credit to improve sanitation in the project's towns; (iv) technical assistance. The 04 sub-projects in Hai Duong province - stage I1are the competition route. The Resettlement Plan (RP) has been based on the Resettlement Pnj.it:y Framework that prepared during Pre-Feasibility Study and approved to the Prime Minister. Tjiis RP will comprise of all activities relating to compensation and land acquisition during the project implementation. In general, a number of subprojects affected from land acquisition are relatively insignificant. There are total of 79 households whose agricultural land is acquired for Thanh Ha, Than11 Mien, Minh Tan and Gia Loc sub-projects. No household has to be resettled. l'he project affected people (PAP) - Displaced (DP) are also the project beneficiary. The RP which is prepared during the Feasibility Study include: the compensation and resettlement policy framework; project displaced areas and people; institutional arrangements; budget; monitoring and evaluation. 2. LEGAL FRAMEWORK AND ENTITLEMENT POLICY The Resettlement Plan (RP) is based on the Resettlement Policy Framework made during the PFS preparation. This RP will apply the various laws, degrees, and circular regulating use of land in Vietnam as well as the World Bank policy. 2.1 Laws, Decrees and Circulars of Vietnam . List of regulations of the Socialist Republic of Vietnam have been applied as follows: constitution of the Socialist Republic of Vietnam dated April 15th, 1992. Land law dated November 26th, 2003. Decree No.l81/2004/ND-CP dated Octorber 29t11, 2004 on the implementation of Land law. Resettlement Plan 1 Viet Nam Urban Water supply development project-Stage 11, Sub-Project in 4 town in Hai Duong Province Decree No.l88/2004/ND-CP dated November 16th, 2001 on methods of determining land prices and assorted-land price brackets. Decree No.l98/2004/ND-CP dated December 03nd, 2004 on collection of land use levies. Decree No.l97/2004/ND-CP dated December 03nd, 2004 regarding Compensation, Assistance, and Resettlement Where Land is Recovered by the State. Decree No.l7/2006/ND-CP dated February 06th, 2006 supplementing and innovating the articles in the instruction Decrees on land law implementation. Decree No,84/2007/ND-CP dated May 25th, 2007 supplementing regulation on certification of land use; implementation of land use and schedule of compensation, support and ressettlement when the State recovers land. Decision No.l795/2005/QD-UBND dated May 5, 2005 for damages compensation, support and ressettlement when the State recovers land in province. Decision No.l322/2006/QD-UBND dated April 5, 2006 for price list for compensation when the State recovers land in province. Decision No.4615/2007/QD-UBND dated December 21, 2007 for prices of different types of land in province. The Land Law of 2003 provides for the assignment of land to people by land use right which bears close similarities to individual property. Some of the important issues relevant to land usage, acquisition can be summaries as foliows: a) The State reserves the right to allocate land and determine its usage. b) Families and individuals who have been assigned with land have the right to exchange their land for another piece; transfer their land use right to another party; and rent, bequeath, or use their land as collateral. c) The People's Committees at all levels (Province, District, and commune) are responsible for the administration of land use in their localities; the People's Committees at all levels are responsible for managing land within their domain. d) The State reserves the right to expropriate land when truly necessary, in cases of national defence or security, or national and public interests. In these cases, the land user will be compensated for loss of possessions. The "national and public interest" is defined in GoV Degree No 197/2004/ND-CP of 3rd December 2004 which includes infrastructure projects. Before land is recovered, the land users must be informed of the reason for expropriation, time schedule and plan for relocation, if necessary, and options for compensation. 2.2 World Bank policy on involuntary resettlement Involuntary resettlement under development projects, if unmitigated, often give rise to severe edonomic, social, and environmental risks: production systems are dismantled; damages on material and immaterial property (housing, land, forest resources, cultural sites, properties of commercial value, social and cultural activities) are inflicted. Such effects can be either temporary or permanent. Thus the World Bank policy regulated by OPBP 4.12 includes saleguards to address and mitigate these risks. The basic guiding principle of the World Bank resettlement policy is that: ResettlementPlan 2 Viet Nan1 Urban Water supply developrnent project-Stage 11, Sub-project in 4 town in Hai Duon_cProvince a) In\lolunt:lry rcse~rlemelirsliould be avoided where feasible, 01- minimized, explor-i~igall viable alternative project designs. b) Where it is not feasible to avoid resettlement, reset~lementactivities sliould be conceived and executed as sustairiable development programs, providing sufficient investment resources to enable the persons displaced by rhe project to share in project benefits. Displaced persons should be meaningfully consulted alld should have opportunities to participate in planning and implementing resettlenlent programs. C) Displaced persons should be assisted in their eficrts to improlre their livelihoods and standards of living or at least to restore them, in real tenns, to pi-e-disp:lacernentlevels or to levels prevailing prior to tlie beginning of project implementation, whichever is higher. 2.3 Policies to be applied by VUWSDP Resettlemeilt policy which is applied for VUWSDP (including sub-project) will be harmonious between World Bank requirements (Involuntary Rcsettlement Pol.icy OP 4.12) and Vietnam laws and regulations. Principles in the project resettlement policy include: a) Acquisition of land and other assets, and resettlement of people will bc minimized as much as possible. b) All PAPs residing, working, doing business or cultivatiilg land within the recovered area under the Project as of the cut-of-date are entitled to be provided with rehabilitatior~ measures sufficient to assist them to improve or at least maintain their pre-Project living stsndards, income earning capacity and production levels. Lack of legal rights to the assets 10s: will not bar the PAPs from entitlement to such rehabilitation measures. C) The rehabilitation measures to be provided are: (i) compensation at replacement cost without deduction for depreciation or salvage materials for houses and other structures; (ii) agricultural land-for-land of equal productive capacity acceptable: to the PAY; (iii) replacement of premise land (if any) of equal size acceptable to the PAP; (iv) transportation and subsistence allowances, and (v) business/incoine rehabilitation allowances. d) Replace premise and agricultural land will be as nearby as possible to the land that was lost, and acceptable to the PAP. In case of minor fractions of land cash compensation may apply. e) The resettlement transition period will be minimized and the rehabilitation means will be provided to the PAPs no later than one month prior to the expected start-up date of works in the respective Project site f) Plans for acquisition of land and other assets and provision of rehabilitation measures will be carried out in consultation with the PAPs to ensure minimal disturbance. Entitlements will be provided to PAPs no later than one month prior to expected starl-up of works at the respective project site. g) The previous level of community services and resources will be maintained or improved. h) -Adequatebudgetary support will be fully committed and be made available to cover the costs of land acquisition and resettlement and rehabilitation within the agreed implementation period. Physical resources for resettlement and rehabilitation will be made available as when required. Resettlement Plan 3 Viet Nam Urban Water supply development project-Stage 11, Sub-Project in 4 town in Hai Duong Province i) WB shall not approve of any civil works contract for ally subproject ro be financed from the loan proceeds unless rhe Government has completed satisfactorily and in accordance wirh the approved RAP for that subproject compensation payment and ensured rehabilitation assistance is in place prior starting civil work. Entitlements will be provided to PAPS 110 later than one month prior to expected start-up of works at the respecrive project site. j) Institutional arrangements will ensure effective and timely design, planning, consultation and implementation of the Resettlement Action Plans (RAP). k) Appropriate reporting, monitoring and evaluation mechanisms will be identified and set in place as part of the resettlement management system. Evaluation of the land acquisition process and the final outcome will be conducted independent of the executing agency. 3. COMPENSA'TION POLICY 3.1 Objectives for Resettlement The objectives of the Vietnamese legislation governing resettlement and rehabilitation of displaced persons, and that of the World Bank concerning involuntary resettlement, have been adapted for the preparation of the project Resettlement Policy Framework (RPF), which is senled as the basis for preparing this Resettlement Plan. The objectives are set out below. The entitlement matrix is shown in Attachment 1. The policies and principles adopted for the Project supersede the provisions of relevant decrees currently in force in Vietnam wherever a gap exists between the World Bank (OP4.12) and Vietnamese law. The main objective of the Resettlement Policy is to ensure that all Project Affected Persons (PAP'S) will be compensated for their losses at replacement cost and provided with rehabilitation measures to assist them to improve, or at least maintain, their pre-project living stanbards and income earning capacity. 3.2 Project Affected People (PAP) Project Affected People (PAP) who is entitled to coinpensation are: (a) persons whose houses are in part or in total affected temporary or permanently by the Project; (b) persons whose premise and/or agricultural land is in part or in total affected (permanently or temporarily) by the Project; (c) persons whose businesses are affected in part or in total (temporarily or permanently) by the Project; and (d) Persons whose crops (annual and perennial) and trees are affected in part or in total - by the Project. 3.3 Principles of Resettlement The principle for resettlement policy in the project will be as follows: Resettlement Plan 4 Viet'Nam Urban Water supply developnlent project-Stage 11, Sub-Project in 4 town in tlai Duong Province Acquisition of land and olher assets. and resettlen~cntof pcoplc will lx rninimlzed as much as possible. In case of minor fractions of lartd (les than 20% of total land holding), cash compensation may apply. The resettlement transition period will be minimized and the rehabilitation means will be provided to the PAPs no later than one month prior to the expec.:ecl start-up date of works in the respective Project site. Plans for acquisition of land and other assets and provision of rehabilitation measures will be caried out in consultation with the PAPs to ensure minimal disturbance. Entitlements will be provided to PAPs no later than one month prior to expected start- up of works at the respective project site. The previous level of community services and resources will be maintained or improved. Adequate budgetary support will be fully committed and be made available to cover the costs of land acquisition and resettlement and rehabilitation within tile agreed implementation period. Physical resources for resettlement and rehabilitation will be made available as when required. Evaluatioii of the land acquisition process and the final outcome will be conducted i!lidepe;&ent of the executing agency. 3.4 Compensation Policy for Loss of Agricultural Land PAPs will be entitled to the following types of compensation and rehabilitation measures: (a) The general mechanism for compensation of lost agricultural land will be through provision of "land for land" arrangements of equal productive capacity, Resettlement Plan 5 Viet Nan7 Urban Water supply development project-Stage 11, Sub-project in 4 town in Hai Duong Province satisfactory to the PAP. If land compensation size is s~nalleror lower quality, PAPs will be entitled to compensation on cash equivalent the differences. However, there is no available land for provision of "land for land", the PAPs will receive cash compensation then the following applies: Legal and legalizable lurzd users: (i) if the portion of the land to be lost represents 20% or less of the total area of the landholding, and the remaining land is still a viable economic holding, cash compensation for the lost land, at full replacement cost, may be provided to the PAP, or (ii) If more than 20% of a household's agricultural land is acquired, then in addition to cash compensation at full replacement cost fc~rthe lost land, the Project will provide a rehabilitation assistance of VND 3.000.000 Users with teinporary or leased rights to use land: (i) The PAPs will be compensated at the amount correspondiilg to the remained investment in the land or cash equal to 30% of land replacement cost; Laid Users Without recogilized Rights to Use Land (i) In lieu of compensation for land, the PAPs will receive assistance corresponding 60% of land replacement cost. (ii) For poor and vulnerable, including landless, severely affected farmers, if there no reserve land to compensate "land for land", a rehabilitation assistance package of 3,000,000 VND will be provided 1:o ensure the PAPs are able at least to restore or improve their income levels and living standards. In case when the affected persons utilizes the public land (of Right of Way or in protection areas of hydraulic works), that subjects to be recovered under the project, with conditions to return, on reque:st, the land to the Government, they (PAPs) will not be compensated for this public land, but will be compensated for crops and trees at full market pric:es. .(b) PAPs will be compensated for the loss of standing crops and fruit or industrial trees at market price. Productive trees will be compensated at replacement cost. 3.5 Compensation for loss of Standing Crops and Trees For annual and perennial standing crops, regardless of the legal status of the land, compensation will be paid to households who cu!:ivate the land, according to the full market value of the affected crops and/or at replacement c a t for affected perennial trees. 3.6 Temporary Impact during Construction For temporary loss of land and properties, PAPs are entitled to follows: For arable land that will be temporarily anected: (i) Compensation for one harvest of cropsltrees at full market prices Resettlement Plan 6 Viet Nam Urban Water supply development project-Stage 11, Sub-Projeci in 4 town in h'ai Duong Province~- (ii) Compensation for loss of net income from subsequent crops that cannot be planted for the duration of project temporary use, ,477 (iii) Restoration of land to its previous or better quality by providing measures to improve land quality in cases of land being adversely affected or acidified, AND (iv) If the duration of project's use the land exceed more than two years, then the PAPs have option to: 1) Continue using land, OR, 2) "Give it to the Project and be compensated as permanent loss For ternpoi-aryloss of 1-eside~ztiallaild: (i) Compensation for all affected movable properties at full replacement cost. (ii) Restoration of land to its previous or better quality. For tenzpoim-y inzpact on business: (i) Compensation for temporary loss of income, equivalent an average ~nonthly net income at least for three months (ii) Compensation for all affected movable properties at full replacement cost. (iii) Restoration of land to its previous or better quality. For damages caused by contractorstopi-ivate or public stmctui-es: Damaged property will be restored by contractors immediately, after c:ompletion of civil works, to its former condition. Under their contract specifications, the contractors will be required to take extreme care to avoid damaging property during their construction activities. Where damages do occur, the contractor will be required to pay compensation immediately to affected families, groups, communities, or government agencies at the same compensation rates that shall be applied to all other assets affected by the Project. In addition, damaged property will be restored immediately to its former condition. 3.7 Allowances and Rehabilitation Assistance During Transition Pcriod Reorganizing PAPs, who have to rebuild main house on remaining land, and relocating PAPs are entitled to: (1) trailsportation cost of 500,000 VND for the reorganizing PAPs and from 1,000,000-3,000,000 VND for relocating ones, and (2) subsistence allowance equivalent 30 kg of rice/person/month for 3 months if PAPs have to remove on the remaining land ,and for 6 months if they remove to a new site; (3) Incentive bonus not exceeding 5,000,000 if they demolish house/structures and transfer the acquired land to the project on time according to the project resettlement schedl-lle. (4) relocating and those organizing PAPs having to rc:build main house, who currently receiving social assistance will be entitled to special social assistance not less than 1,000,000 VND to rehabilitate their living standards Sverely affected people are entitled to rehabilitation assistance to restore their livelihood not below the standard before the Project, and preferable better than before. People loosing more than 20% of agricultural land and receiving compensation for land in cash will be provided with rehabilitation assistance of VND 3.000.000 per household. This should be adjusted annually with inflation. Resettlement Plan 7 Viet Nam Urban Water supply development project-Stage 11, Sub-Project in 4 town in Hai Duong province 4. PROJECT AFFECTED SCOPE AND INHABITANT STATUS The size of Water supply sub-projects (VUWSDP) is communeltown. 'The water intake, pumping station, water treatment plant and management house have to acquire land for construction. The delivery and service pipe system is planed to istall in road and there is no effect by land acquisition. Locations of the water intake, pumping station, water treatment plant and management house were considered carefully basing on appropriate technology solution and reducing the effect by land acquisition to household. Most of area of .rcco\~edland for construction is agricultural land in which the one under administration of commune authority is priority for selection. So, scale affected area by sub-project is small. There are total of 79 households in 04 communes whose agricultural land will be recovered. 4.1 Project affected area and displaced persons According to the proposed design of a sub-project at all communes, the water supply systems generally consist of: *Sub-projects of Thanh Ha, Thanh Mien and Minh Tan The pumping station 1 (raw water pumping station) is planed to be installed nearly water source in the area of 200m2.Raw water will be moved from the station to water treatment plant. Most of area of recoved land for pumping Station is public land and under administration of commune authority. These areas are either free or to be delivered to HHs every year. The water treatment plant is planed to be installed in the area of 6,300111~- 8,800m2.This plant coinprises a mixed tank, a lamell sedimmt tank, fast filtration tank, a clean water tank, the pumping station 11. Most of recovered land ?i~rconstructing water treatment p1.ants in Than11 ha, Thanh Mien and Minh Tan is agricultural land. A part of one belongs to households and the other is under administration of local authority. *Gia Loc sub-project Clean water will-be moved from Hai Duong city to clean water tank located in rasing pumping station in area of 4,838 m2.Clean water is dilivered to household by the second pumping station. The factual area of land recovery for constructing sub-projects is larger than area of technical area for designing. The project will recover the remains of area that is not enough for cultivating and agreed by household. On the other hand, it is reliable for boundaries of land that was made plan. Besides, total area of 67,000m2recovery land will be temporary during the construction period in which area of 12,000m2is Thanh Ha sub-project; 12,000m2is Than11 Mien, 25,000m2is Minh Tan and 18,000m2is Gia Loc. The land acquisition for the project is all agricultural land being used to cultivate rice and Peach. These surveys are carried out in cooperation with local authorities and affected households. The survey results have shown that 79 households (360 members) with 190 labors are affected by the agriculture land acquisition in 4 project Towns. Like in many other communes, the majority of the intenriewees said that they have "rather sufficient living conditions" so they regard themselves as the medium or poor ones. Few households admit that they have better- off, rich household living standards while the surveyors ranked them as the average and better-off households. Beside the income from agriculture, the HH's income is increased by temporary jobs which are done in free time of year. Only 5 households that are recovered over 20% of agricultural land are poor households. In addition to getting rehabilitation assistance package of 3,000,000 VND/HH, the labours/farmer in the affected households are granted expense of vocational training and creat a job chance such as instant programme - creating the conditions for affected employee by finding a simple job during project construction time); assisting loan for business - creating the favourable condition for PAH to get loan from economic development in local. Applying of detailed Income restoration program and object getting the benefit from this support program will be reviewed and carried out in the next steps by Council Compensation for losses in site cleaiing. Resettlement Plan 15 Viet Nam Urban Water supply development project-Stage 11, Sub-project in 4 town in Hai Duong Province 5. INSTITUTIONAL ARRANGEMENT Structures of implementation arrangement and an overview of key re~~ponsibilitiesfor/in every level/unit participating in implementation of project resettlement can be described as follows: 5.1 Provincial Peopie's Committee (PPC) The PPC is the Executing Agency (EA) responsible for overall implementation of the subproject, including implementation of Resettlement Plan (RP) for its subpl-oject. The PPC is responsible for following project's approved by Prime Minister RPF for as a condition to participate in the Project. It is of the highest administrative level the bocly responsible for approving RP for its subproject and making decisions related to project's resettlement issues, including compensation rates and rehabilitation assistances measures for PAPs. The PPCs are also responsible for providing budget for resettlement compensation. After detailed engineering designs will be complete, the number of PAPS will be revised, and compensation unit rates and allowances will be updated for all categories of lost assets, based on replacement cost surveys taken during project implementation. Following approval by the WB of the updated RP, the PPC will be responsible for directing and supervising R.P implementation, iilcludi~lgmaking speedy resolution of any grievances voiced by PAPs or townjdistrict authorities. 5.2 Project Coordination Unit (PCU) For overall project coordination, a Central Project Coordination Unit (PCU) will be established. The PCU comprises of two fulltime professional staff, with proficiency in English ianguage, together with administration and support staff. The PCU is responsible for overall project coordination, including liaison between the Government and subproject PPCs and the WB. Specific resettlement responsibilities of the PCU are: (i) Approved RPs from Project provinces will be forwarded to WB for concurrence. (ii) Overall responsibility for RPF's and RPs' implementation (iii) Consolidate project progress reports on land acquisition and resettlement for MOC and WB. (iv) Consolidate project accounts, and reviewing audited accounts; and (v) Recruit and supervise of consultants, including the external independent organization for resettlement monitoring. 5.3 Provincial Steering Committee (PSC) A provincial steering committee (PSC), on behalf of the PPC, will have overall responsibility for project implementation. The PSC consists of the PPC chairperson/vice- chairperson; directors of provincial line departments including departments of Construction, Finance; Planning and Investment, Land use management, Environment; cl~airperson/vice- chairperson of the DPC, chairperson of the Provincial Women's Union, and manager of the Project Management Unit (PMU). Key responsibilities include follows, not limited to: (i) Assist the PPC review to approve the updated by the PMU RP with revised compensation rates based on a replacement cost survey; Resettlement Plan 16 Viet Nam Urban Water supply development project-Stage I/, Sub-project in 4 town--in Hai Duong Province --- (ii) Advise PPC to issue decisions on acquisition and allocatio~lof land req~~iredfor development of subproject components, including allocation of land to poor and vulnerable PAPs; (iii) Advise PPC to approve resettlement budget and ensure timely release of funds; (iv) Advise PPC to review and approve resettlement documents submittzd by PMU for its approval; and (v) Advise PPC and PMU on ways to redress and resolve any PAPs grievances that have been appealed to the PPC, and refer all PAPSgrievances to the appropriate channels. 5.4 Project Management Unit (PR'IU) The PPCs set up PMUs at WSCs for daily project implementation. It comprises technical, institutional, social and resettlement, administrative management, and accounting divisions. The PMU will be responsible for the following key resettlement activities, not limited to: (i) Update RAP at time of project implementation when detailed design will be available, and submit the updated RAP to PPC for approval. (i) Integrate civil works with land acquisition and resettlement activities; (ii) Instigate information campaigns, including the public information booklet (PIT;), and stakeholder consultation with the PAPs in acccrdance with established Project guidelines. This includes prime responsibility for letters, forms and other relevant documents, which may be delegated as required; (iii) Develop the mechanisms tluough which resettlement disbursements and compensatiori payments for PAPs will be made. Prepare any relevant documents that may be required; (iv) Coordinate with other departments for effective implementation o:F the RP approved under the subproject, and in co~npliancewith the WB resettlement principles aild objectives. Ensure proper implementation of rehabilitation measures and supporting activities; (v) Ensure timely resettlement budget flow for delivery of compensation payments and rehabilitation of PAPs. Coordinate payment of compensation to PAF's; and (vi) Implement subproject accounting and auditing for resettlement implementation. Prepare and submit regular progress reports to PSC, PCU and WB on civil :;-orks and status of RP activities. 5.5 District Resettlement Committee (DRC) A resettlement committee will be established in line with arrangements outline in individual RP. Each will appoint its members and a chair. The resettlement committee will work closely with the-PMU on all resettlement-related issues. The DPC chairperson or vice-chairpe:rson will act as the resettlement committee chairperson, and representatives from district departments, including construction, planning and investment, land use management, urban management unit, members of Resettlement Plan i7 Viet Nam Urban Water supply development project-Stage 11, Sub-project in 4 town in Hai Duong Province Inass organization, representative of PAPs, and other mernbcrs as required. A PMU's staff should be a member of District's resettlement committee, unless otherwise requested. The resettleillent committee will assist the DPC/PPC in decision-making on resettlement issues. Key responsibilities of DRC are follows, not limited to: (i) Planning and implementation of for all resettlenlent activities in their districts; (ii) Finding adequate land for individual relocations; (iii) Being responsible for DMS, finalizing compensation forms, preparing compensation charts to submit to the PPC for approval and paying compensation directly to each PAPSafter receiving the funds; (iv) Establishing inspectors to redress PAPs grievances on resettlement policies and entitlements; (v) Establishing, if necessary, commune resettlement committees (CRC) and directing their operations during the implementation of the resettlement activities; (vi) Paying special attention to the needs and demands of specific groups (ethnic minority groups) and vulnerable people (children, the elderly, womanlsingle headed households); (vii) Cooperating fully with the external monitoring organization 5.6 DistrictICommune People's Committee District/Commune People's Committee (DPCICPC) will be responsible to coordinate with functional agencies in land and property certification; to cany out studies and campaigns that the inhabitants should adopt site clearance. Propaganda content includes land recovery purposes, policies on compensation; support and make good condition for payment and re.settlement. 5.7 Independent Monitoring Organization Independent Evaluation can implement by Research Organization, University or NGO that is specialize in social science. These agencies will implement surveys of economic social, monitoring, and evaluation of implementation of RP. Reports of Progresis Evaluation and suitability of RP and related proposals is needed to prepare period. 6. INCOME RESTORATION PROGRAM Besides works construction with major social economic significances, being interested in DP for their having a normal life ensure the sustai~x~bledevelopment of project. Objectives of income restoration program is to rehabilitate the income resource for income damaged households objects as implementation of project such as: (i) be changed occupation by losing agriculture production land (be recovered over 20% area of agriculture land); (ii) stopping manufacture, trade by losing production means... Income restoration policy needs to base on essential demands and income creating chances at local in order to ensuring for all of DP to the pre-project level or higher. There are 79 households affected by the agriculture land acquisition in 04 sub-projects in Hai Duong province. Resettlement Plan 18 Viet Narn Urban Water supply developnient project-Stage 11, Sub-project in 4 town in Hai Dc~ongProvince 'Ille survey resulrs have shown that main income of the PAHs is froin agricultural productiori activities (from rice make up 50 - 70%). 'Illere incollle is still completed by a numbers of works as: constructing, working far from house, etc. However, these incomes are not stable. The proposed income restoration methods are included: a) Where households and individuals directly engaged in agricultural production are not compensated in land, they should be supported for business change (in the foims of money or vocational training). b) Creat the conditions for affected employee by finding a job himself through supporting the occupation training. C) Solve job to orient support of necessary conditions for employee by finding a job himself such as help and introduce the suitable job with capacity ... d) Creat a job chance. e) Loan for trade production (combine with programes, acitivities for econlomic development in local). Some specific programme will be proposed such as instant programme - creating the conditions for affected employee by finding a simple job during project c~onstructiontime); assisting loan for business - creating the favourable condition for PAH to get loan from economic development in local. PUBLIC CONSULTATION, INFORMATION ANNOUNCEMENT AND GRIEVANCE . MECHANISMS 7.1 Objectives of information announcement and public consultation Ensuring participation of local authority, related organizations and displaced persons into the project in order to speed up project implementation conveniently. Announcing information for DP and involved agencies is an important part for project preparation and implementation. Consulting to affected people and ensure that they participate into the project positively. l'his will reduce the potential for conflicts and minimize the risk of project delays. This will also enable the Project to design the resettlement and rehabilitation program as a comprehensive development program to suit the needs and priorities of the displaced persons, and thereby maximizing the economic and social benefits of investments. The objectives of the public: information and consultation progrm are as follows: (i) To ensure that local authorities, as well as representatives of DPs, will be included in - the planning and decision-making processes. PMU will work closely with the City People's Committee and the District People's Committee during project implementation. DPs involvement in implementation will be continued thereafter by requesting each district to invite DPs' representatives to be a member of the Tile Council for Damages Compensation and Site Clearance- CCC: take part in the resettlement activities (property evaluation, compensation, resettlement, and monitoring). (iii) To obtain infonnation about the needs and priorities of the DPs, as well as receiving information about their reactions to proposed policies and activities. (iv) To ensure that DPs are ablc to make fully informed decisions that will directly affect their incomes and living standards, and that they will have he opportunity to participate in activities and decision-making about issues that will directly affect them. (v) To obtain the cooperation and participation of the DPs and commuilities in activities necessary for resettlement planning and implementation. (vi) To ensure transparency in all activities related to land recovery.,resettlement, and rehabilitation. 7.2 Co~lsultationduring Project's preparation Local authorities, relevant organizations, DPs and community will participate in all different stages since planning to implementation of the RP. At the early stage of the project preparation, local authorities and leaders of different administrative levels in each of the Project towns were informed about the project proposal, its objectives and proposed activities. The project resettlement policy described in the RPI;, reflecting both the Government and WB resettlement objectives and principles. Pre-Feasibility and RPF was approved by Prime Minister and adopted by WB. Consultation and Public Information in project commune were cortducted by public meetings and household visits combining the household socio-economic sui-vey. Community in project area and PAH were consuIted on positive impact and negative impact of sub-project. Social-economic survey was done for most of PAH in 4 towns (Thanh Ha, Mink1Tan, Gia Loc and Thanh Mien). All the people affected are not against the implementation of project:;. PAH's opinions were rec,orded in the minutes, and these opinions concentrate mainly on the following contents: a) Price for compensation: - PAHs proposed that compensation must aplly properly and timely for loss of farming land - The difference between the price compensation by the state regulations and market value mainly happened to residential land prices. Some projects have recovered agricultural land are carried out at town are applying the price by the provincial People's Committee regulations PAP agree with the price of land by state regulations. Illfor-nzatio~zanrzorllzcernel?tarzd corzs~~ltatiorz During project implementation, PMUs, assisted by the project consultants, will undertake the following: (i) Provide detail information on policies and schedule to resettlement committees and related organizations at all levels. (ii) Conduct information dissemination to and consultation with DPs throughout the life of the project. (iii) Update the city unit prices, and confirm land recovery and impact in properties through a Detailed Measurement Survey (DMS) in consultation with DPs. (iv) The District resettlement committees will then apply prices, calculate compensation entitlements, and complete the Coinpensation Forms for each affected household. Information on entitlements, and complete the Cornpensatiori Forms for each affected household. Informatioil on entitlements will then be: presented on an individual basis to DHs in the public meeting and visiting to each household. (v) DPs will be received the Compensation Form, showing the household's affected assets and compensation entitlements, will the need to be signed by the DPs to indicate their agreement with the assessment. Any complaints fo1.m DPs have about the contents of the form will be recorded and solved at this time. (vi) Consultation regarding DPs preferred option for rehabilitation su.pport.This applies to severely affected and vulnerable DPs. The CCB will inform IIPs of options and entitlement to rehabilitation support before asking them to indicate preferences for such rehabilitation support. B. Comrnrlizity meeting As soon as having decision of land recovery and before starting to detailed design, community meetings in every local will be hold to announce supplementary information's for displaced persons and make a chance to discuss publicly about policies and resettlement procedures in every affected site. All DP-relocated ill be invited to participate the meeting and give ideas. Information and documents will be delivered to DP in this meeting. Methods of meeting include of: (i) Explanations give verbally and in visual format, including written information and drawings of the proposed design for the different component of the Project. (ii) Adequate opportunities will be provided for DPs to respond with questions and comments, DPs will encourage contributing their ideas, Resettlement Plan 21 Viet Nam Urban Water supply development project-Stage 11, Sub-Project in 4 town in Hai Duong Province (iii) The CCB and DistrictIWard's authorities will establish a comp1e:te list of all PAPS present at the meetings. (iv) The CCB will make a complete record of all questions, comments, opinions and decisions that arise during the information/consultation meetings, and present a report of all the meetings to the PIPSand PC. Content of the meetings will be including: Project component information, project impacts: compensation entitlements and rehabilitation of DPs; grievance mechanism and procedures; participation & consultation entitlement; resettlement activities; implementation progress etc. Announcement letters will be sent to every DP including time, address and procedures to receive compensation payment. Affected pcople who are hardly affected and likely injured will be directly met in order to affirm their wishes for restoration support. By means of public communication such as broadcasting station - television, presses combined to use leaflets with simple content and easy to understand so that they can be imparted necessary information for the project, State policies to all DP. Besides, these Resettlement Policy Framework and Resettlement Plan are also announced widely in public information centres of the city, Site clearance and compensation Boards, Districts and Wards of Project areas. 7.4 Grievance Redress Procedure All DPs 'complaints regarding any aspect of compensation policy, rates, land acquisition, resettlement and entitlements relating to rehabilitation assistance programs will be received and resolved by line functional agencies. Local mass organizations, including Fatherland Front, Association of Farmers, Women's Union, mediator groups will be mobilized to actively participate in process of solving of DP's emerged complaints/grievances. A four-stage procedure for redressing grievances is proposed as follows: Stage 1.: Complaints forms DPs on any aspect of the resettlement program, or losses not previously addressed shall first be lodged verbally or written form to the people's committee at commune level. The complaint can be discussed in an informal meeting with the plaintiff and the chairman of the people's committee at commune level. The people's committee at commune level will be responsible for resolving the issue within 15days from the day it is lodged. Stage 2: If no understanding or amicable solution cannot be reached, or if no response from the people's committee at commune level is received by the PAPS within 15 days of registering the complaint, helshe can appeal to the District Resettlement Committee. The ClRC will provide a decision within 1month of the registering of the appeal. Stage 3: If the PAP is not satisfied with the decision of the DRC or its representative, or in the absence of any response by the DRC, the DPs can appeal to the Provincial People's Committee. The Provincial People's Committee together with the representative of the PSC will provide a decision on the appeal within 30 days from the day it is lodged with the PPC. IMPLEMENTATION SCHEDULE The Project Site Clearance Plan and Schedule will be included in the IU' of each sub-project. The implementation schedule is as follows: 1.Information Dissemination Prior to Detailed Design. Prior to the cornmencerneiit of detailed design, MOC will provide information 'about the Project througl~outthe project area. Information meetings will be held in all potentially affected communes to info~nlthe communities about (i) the project scope; (ii) impacts; (iii) entitlements for all categories of loss; (iv) schedule of activities beginning with the detailed design survey; (v) institutional responsibilities; and (vi) the grievance mechanism. The P I . will be prepared and distributed to all affected communities during the meetings. 2. Establishment of Resettlement Committees. All provinces will establish their resettlement committees at provincial and district level as soon as the Project has !been started. 3. Training for Resettlement Staff. Once Resettlement Committee have been established, all local resettlement staff at PMUs, PRCs, DRCs, and commune levels will be trained by the PCU assisted by resettlement specialists. Training subjects will include: (i) Objectives of RAP; (ii) Principles, policies, and entitlements of the RAPs; (iii) Consultation and information dissemination methods (iv) Implementation steps, procedures, and schedule; (v) Grevances redress mechanism and (vi) Powers and obligations of individuals1 agencies involved in the process of resettlement programs. 4. Updating Compensation Rates. During the preliminary detailed design process, the PPCs will update unit rates at replacement cost for all categories of loss and adjust allowances to account for inflation. This will be done in consultation with PAPs and local government agencies. 5. Detailed Measureme~~tand Census Survey. Before each new phases of the VUWSDP new DMS will be conducted in each subproject area after completiorl of the detailed design. These surveys will serve as a basis for compensation and updating RAPs. Data will be computerized by PMUs. 6. Pricing Application and Compensation to PAP. Resettlement com~mitteesat all levels will be responsible for pricing application and preparing compensation charts for each affected commune/district. These will be subject to verificatioli by PMU, PPCs, and E'CU of unit prices, quantity of affected assets, PAPs' entitlements, etc. before posting them at each commune for the people to review and comment. All compensation forms must be checked and signed by the PAPSto indicate their agreement. 7. Compensation and allowances will be handled at commune level under the supervision of representatives of DRCs and PMU. Guidance will be given by PMUs to aid local resettlement committees in making payments to PAPs. Resettlement Plan 24 Viet Nam Urban Water supply development project-Sfage 11, Sub-project in 3 townit7Hai Duong Province 9. MONITORING AND EVALUA-TION 9.1 Objectives Monitoring and evaluation activities should be carried out durin,a the imj:lementaion phase and after the resettlement phase in order to ensure that land recovery and resettlenent are carried out in accordant with regulations and guidelines which are showed in detail in resettlement plan. Monitoring provide all stakeholders with continuous reflects about implementing situation. This activity helps to asses real successful ability and difficulty which is occurrt:d immediately if possible in order to create conditions for dressing 111 time during the phase of project im~lementation. Objectives of monitoring and evaluation activities are to (i) reviewing project activities which are completed effectively or not, including quantity, quality and time; (ii) assessing these activities reach the goals and objectives of the proposed project or not and how is the level of achievements. Regular monitoring of the RP implementation will be conducted by the implementing agencies (PMU and PCU) as well as by an independent external monitoring organization hired by the PCU. 9.2 Internal Monitoring Internal monitoring of the implementation of the subproject RPs will be in charge of all internal supervision tasks of implementation of resettlement plan (RP) of the p;.oject with the consultant's support. The implementing agencies will oversee the progress in resettlement preparation and implementation through regular progress reports. The main indicators that will be monitored regularly are: (i) Payment of compensation to DPs in various categories, according to the compensation policy described in the RP; (ii) Delivery of technical assistance, relocatioc, payment of subsis:tence, and moving allowances; (iii) Delivery of income restoration and rehabilitation assistance entitiements; (iv) Public information dissemination and consultation procedures; (v) Adherence to grievance procedures and outstanding issues requiring management's attention; (vi) Priority of DPs regarding the options offered; (vii) Progress of land acquisition implementation and (viii) Coordination and completion of resettlement activities and award of civil wcj3;s contract. The implementing agencies will collect information every month from the different resettlement committees. A database of resettlement monitoring information regarding the Project will be maintained and updated every month. The implementing agencies will submit to the PCU a monitoring report on the progress on implementation of the RAPS. These reports will be forwarded to the World B.ank as part of their Resettlement Plan 25 Viet Nam Urban Water supply development project-Stage 11, Sub-project in 4 town in Hai Duong Province - - regular quarterly report to the World Bank. The internal monitoring reports shall include the following topics: (i) The number of PAPs by category of impact per component, and the status of compensation payment and relocation and income restoratioil for each category. (ii) The amount of funds allocated for operations or for cornpensation and the amount of funds disbursed for each. (iii) The eventual outcoine of co~nplaintsand grievances and any outstanding issues requiring action by management. (iv) Implementation problems. (v) Revised actual resettlement implementation schedule. 9.3 Independent Monitoring Objectives: The general objective of the external monitor is to provide an independent periodic review and assessment of achievement of resettlement objectives, the changes in living standards and livelihoods, restoration of the economic and social base of the affected people, the organizatioilal effectiveness, impact and sustainability of entitlements, the need for further mitigation measures if any, and to learn strategic lessons for future po1ic:y formulation and planning. Agency Responsible: In accordance with the World Bank requirements for consultant procurement, PCU will hire an organization for ihe independent monitoring and evaluation of RAPSimplementation. This organization, to be culled the Monitoring Organization (MO) will be specialized in the Social Sciences and experienced in resettlement monitoring. The MO should start their work as soon as the updated RAPShave been approved. The main indicators of independent monitoring and evaluation will include of: (i) Payment of compensation will be as follows: (a) full payment to be made to all affected persons sufficie~ltlybefore land acquisition; (b) adequacy of payment to replace affected assets. (ii) Provision of technical assistance for house construction to PAPs who are rebuilding their structures on their remaining land, or building their own, structures in new places as arranged by the project, or on newly assigned plots. (iii) Provision of income restoration assistance. (iv) Public consultation and awareness of compensation policy: (a) P,Ws should be fully informed and consulted about land acquisition, leasing and relocation activities; (b) the monitoring team should attend at least one public consultation meeting to monitor public consultation procedures, problems and issues that arise during the meetings, and solutions that are proposed; (c) ~ublicawareness of the compensation policy and entitlements will be assessed among the PAPs; ancl (d) assessment of awareness of various options available to PAPs as provided for in the RAPS. (v) Affected persons sbould be monitored regarding restoration of productive activities. (vi) The level of satisfaction of PAPSwith various aspects of the RAP will be monitored and recorded. The operation of the mechanisms for grievance redress, and the speed of grievance redress will be monitored. Any potential problenls in the restoration of living standards will be reported. 9.4 Monitoring rnetliodology and reporting A socio- economic survey is initial foundation of RP preparation, monitoring, and evaluation. The survey will be required before, during and after resettlemeut implementation to provide a clear comparison of success/ failure of the resettlement plan. PRA will be applied by project survey. Monitoring will be on a sample basis. The sample size should be 100% of relocating households and severely affected farmers, and at least 10% of all other households. A Post-Resettlement Evaluation will be carried out 6 to 12 months after completion of all resettlement activities. 8. Database Storage Project monitoring and evaluation is based on database system. It will contain drawing, figures and files on DPs surveyed and will be updated based on information collected in successive rounds of data collection. All databases compiled will be fully accessible by implementing agencies and the PMU. C. Reporti::g The MO will be required to submit the findings of the periodical monitoring every 6 months. These monitoring reports shall be submitted to the PCU, which in turn will submit the reports to the World Bank as an annex of its progress report. The report should contain (i) a report on the progress of RAP implementation; (ii) deviations, if any, from the provisions and principles of the RAP; (ii) identification of problem issues and recommended solutions so that implementing agencies are informed about the ongoing situation and can resolve problems in a timely manner; and (iv) a report on progress of the follow- up of problems and issues identified in the previous report. The monitoring reports will be discussed in a meeting between the MO, PCU and implementing agencies held immediately after submission of the report. Necessary follow-up action will be taken based on the problems and issues identified in the reports and follow-up discussions. Evaluation is an assessment at a given point of time of the impact of resettlement and whether stated objectives have been achieved. The external monitor will conduct an evaluation of the resettlement process a:id impact 6 to 12 months after completion of all resettlement activities using the same survey ques~ionnaireand sample as used during the monitoring activities. Internal Monitoring Report: is required to prepare during the reseitlement and land recovery process. The implementing agencies will be required to submit the report as part of general progress report. - Resettlement Plan 27 Viet Nam Urban Water supply development project-Stage 11, Sub-project in4 town in H.si Duong Province -- The implementing agencies will coordinate with CCCs to collect information and data concerning to resettlement and displacement process for submitting findings of monitoring and evaluation. The report should contain: (i) A report on the progress of RP implementation (number of DP by type of loss and compensation, relocation and rehabilitation schedule by each component. budget allocated to project activities or compensation and disbursemenl. amount for each activities... (ii) Grievance and redressing output (if any); (iii) Issues arising during implementation (if any) and solutions.; (iv) A report on progress of the resettlement and updated report on the coniiilg time. Independent Monitoring Report: is prepared before, during and after resettlement. The report need to reflect the followings: (i) Determine internal monitoring output; (ii) Assess whether the RPF objectives have been achieved; how DP living standard and income improved and rehabilitated. (iii) Review whether the resettlement entitlements are appropriate with DP's conditions. (iv) Evaluate effectiveness, impacts and level of the resettlement sustainabiliiy; lesson learned for planning and developing RPF in future. 10. COST ESTIMATE AND BUDGETS Compensation policy including compensation prices will apply the World Bank policy as well as the various laws, degrees, and circular regulating use of land in Vietnam. Determining land cost to compensate project affected households or organizes b-ase on Decision No.4615/2007/QD-UBND dated December 21, 2007 for prices of different types of land in province. These prices were set up basing on a principle which guarantee next to transferring cost of land use rights on the market in normal and prevalent situated condition in Hai Duong.
