GENERAL INFORMATION ABOUT THE PROJECT 1.1 About DESKİ Denizli province gained the status of Metropolitan Municipality pursuant to the “Law on Establishing Metropolitan Municipalities and Twenty-Seven Districts in Fourteen Provinces” No. 6360, legal entity of villages and town municipalities within the civil boundaries of its districts was abolished, and villages were made into neighbourhoods and town municipalities were joined with the municipality of their districts as single neighbourhoods. Denizli Metropolitan Municipality, Directorate General of Water and Sewerage Administration (DESKİ) was established to operate water and sewerage services across the province as a public legal entity under Denizli Metropolitan Municipality with the Cabinet decree No. 2014/6072 published in the Official Gazette No. 28958 of of 31 March 2014 pursuant to Law No. 2560. In line with its purpose, DESKİ has completed the Municipal Services Project in the water, wastewater and stormwater sector with the financing of the World Bank and signed a Sub-Loan Agreement with İller Bank for the Sustainable Cities Project (SCP-1) in December 2016. Within the scope of SCP-1, it is planned to complete drinking water, wastewater and rainwater network and household connections in the neighbourhoods of Deliktaş, Dokuzkavaklar, Anafartalar, Aktepe, (a part of) Karşıyaka (DES-W1) and Sevindik Sümer and Karşıyaka (the remaining part) (DES- W2). 1.2 Assessment of Work Items under Sub-Loan Agreements in terms of Land Acquisition Within the scope of the Sustainable Cities Project –I (SCP-I) funded by the World Bank, 1 Sub- Loan Agreement was signed in the wastewater sector between Denizli Metropolitan Municipality Directorate General of Water and Sewerage Administration (DESKİ) and İller Bank. The Sub-Loan Agreement signed with DESKİ on 28.12.2016 within the scope of the SCP with an amounts of EUR 53,750,000. Contractors can acquire land for their construction sites by renting from 3rd parties. It is obvious that contractors should consider the proximity of the manufacturing site during the process of determining the construction sites. Contractors will ensure that there is no agricultural activity on construction sites to be selected in the areas close to the manufacturing site and/or any building (house, barn, tent, etc.). If there are existing enterprises which maintain their commercial activities on these lands, the economic losses of these enterprises will be covered by the contractors. Contractors will receive the approval of the Consultant Firm’s Project Manager for the selection of the construction site and carry out the installation of the construction site. Procedures of land acquisition from individuals will not be required for the works planned to be constructed within the scope of DES-W1. In this context, it is planned to construct 2 wastewater Pumping Stations besides water, waste water and storm water network:  TOKİ Pumping Station: It will be constructed in a non-registered/non-owned area. This is an area that is off-registration, that is, under the heel of and in the possession of the state. There is no block or parcel number due to being off-registration. This area is already not allocated to any institution or any person. There is no economic or agricultural use and no income- generating activity in this area. In addition, there are no unauthorized users in this area.  Akvadi Pumping Station: Allocation is required for a part of the parcel. The parcel no. 1903, in which the construction is planned, is owned by the State Treasury, and as it is qualified as a forest area. DESKI applied to Denizli Regional Directorate of Forestry for its allocation pursuant to Article 16 of the Forest Law No. 6831. Under DES-W2, it is planned to construct 1 wastewater collector and 1 wastewater Pumping Station. It is planned to perform expropriation in regard to land acquisition from individuals for the Eskihisar wastewater collector. Sevindik Pumping Station: The parcel owned by Denizli Metropolitan Municipality needs to be allocated or transferred to DESKİ. Eskihisar collector line: Expropriation is required for the cadastral parcel no. 307 in Gümüşçay neighbourhood of Merkezefendi district through which the line passes. The decision of public benefit no. 203 of 14.09.2018 by the Board of Directors of Directorate General DESKİ for the subdivision and 4 / 20 expropriation of the parcel no. 307 in Gümüşçay neighbourhood of Merkezefendi district, and this decision was approved by the Ministry of Environment and Urbanization in 12.11.2018. The expropriation works for the Eskihisar collector line under DES-W2 will be discussed in detail in this Land Acquisition Action Plan. Furthermore, detailed information on the acquisition under DES-W1 will be included in the following sections of the report. 1.3 Information about the Project Area Denizli province is located in the southeast of the Anatolian Peninsula and southeast of the Aegean Region. It functions as a passageway between the Aegean, Central Anatolia and Mediterranean Regions. Of the province, Çameli and Kale districts are within the boundaries of the Mediterranean Region; Sarayköy, a part of Buldan and the Çürüksu Valley of the central district are within boundaries of the Aegean Region, and the other districts are within the boundaries of the Central Anatolia Region. Previously having been a district of İzmir, Denizli became a province in 1923. With a surface area of 12,134 km2, the province has 19 districts and 618 neighbourhoods. Denizli province is geographically located on the northern slope of Akdağ and on the plateau slightly split by Aksu River which is a branch of Büyük Menderes River. The prominent mountains of Denizli are Menteşe Mountains in the north, Honaz Mountain in the southeast (2571 m) and Babadağ (2571) in the southwest. The city center has an elevation of 428 meters from sea level. 1.4 Project Description (SCP-1) İller Banka provide a loan from International Bank for Reconstruction and Development Bank (IBRD ) to support investments related to the Sustainable Cities Project-I. The primary objective of the Sustainable Cities Project (SCP) is to contribute to the development of environmental, financial/economic and social sustainability of metropolitan municipalities. The overall management of this comprehensive project is carried out by the Project Management Unit under the Directorate General of İller Bank. İller Bank allocated part of the loan to Denizli Directorate General of Water and Sewerage Administration (DESKİ) for the financing of “Denizli Rehabilitation Project for Drinking Water, Wastewater and Rainwater”. With Municipal Services Project - I (2008-2011) and Municipal Services Project II (Additional Financing) (2011-2016) funded by the World Bank through İller Bank, construction works of drinking water, wastewater and storm water network were carried out in some parts of the city. Within the scope of the Municipal Services Project, the designs of drinking water, sewerage and storm water network were prepared for the whole city with the consultancy services procured in 2012, and it is planned to implement the investments under the SCP-I by using these designs . Within the scope of the Sustainable Cities Project (SCP-1), it is planned to complete drinking water, wastewater and storm water network and household connections in the neighbourhoods of Deliktaş, Dokuzkavaklar, Anafartalar, Aktepe, (a part of) Karşıyaka (DES-W1) and Sevindik, Sümer and Karşıyaka (the remaining part) (DES-W2). As seen in Figure 1.1, Sümer and Sevindik neighbourhoods in the project area are located to the north of İzmir Boulevard, to the west of Ankara Boulevard, and the other neighbourhoods to the east of Ankara Boulevard. 5 / 20 SEVİNDİK KARŞIYAKA KARŞIYAKA ANKARA ROAD SCP-1 SÜMER DOKUZKAVAKLAR AKTEPE İZMİR ROAD ANAFARTALAR DELİKLİTAŞ ANTALYA ROAD Figure.1.1 – Areas of Infrastructure Works Among the components of the sub-project briefly described above, as for the final designs approved by İller Bank A.Ş., it is planned to carry out the constructions of 99 km length drinking water line, 82 km length wastewater line, 28 km length storm water line and 2 wastewater pumping stations within the scope of construction work DES-W1 [Anafartalar, Dokuzkavaklar, Aktepe, Deliktaş and [a part of] Karşıyaka neighbourhoods). Within the scope of construction work of DES-W2 [Sevindik, Sümer and Karşıyaka (remaining part) neighbourhoods], constructions of 54 km length drinking water line, 41 km length wastewater line, 22 km legth storm water line, 1 wastewater pumping station and 2.5 km wastewater main collector line will be carried out. DES-W1 – “Construction and Rehabilitation Work of Drinking Water, Sewerage and Stormwater Network in Anafartalar, Dokuzkavaklar, Aktepe, Deliktaş and Karşıyaka Neighbourhoods”  Akvadi Pumping Station: Part of the cadastral parcel no. 1903 in Eskihisar neighbourhood of Merkezefendi district needs to be allocated for DESKİ. The parcel no. 1903, in which the construction is planned, is owned by the State Treasury, and as it is qualified as a forest, DESKİ applied to Denizli Regional Directorate of Forestry for its allocation pursuant to Article 16 of the Forest Law No. 6831. It is foreseen that the approval procedures will be completed by March 2019 (See Figure 1.2) 6 / 20 Figure 1.2 – Location of Cadastral parcel no. 1903 owned by the State Treasury and of Akvadi Pumping Station  TOKİ Pumping Station: It will be constructed in a non-registered/non-owned area. It will be constructed on the area which is off-registration, that is, under the heel of and in the 7 / 20 possession of the state. There is no block or parcel number due to being off-registration. This area is already not allocated to any institution or person. There is no economic or agricultural use in the area indicated on the ground. This area will be registered in the name of DESKİ with the completion of construction works for the pumping station which is planned to be constructed on an area of 100 m 2. Area of the Pumping Station Station Figure 1.3 – Location of TOKİ Pumping Station in non-registered area DES-W2 – “Construction and Rehabilitation Work of Drinking Water, Sewerage and Stormwater Network in Sümer, Sevindik and Karşıyaka Neighbourhoods”  Sevindik Pumping Station: The block 6710, parcel no. 4 in Eskihisar neighbourhood of Merkezefendi district needs to be allocated or transferred to DESKİ. The block 6710, parcel no. 4 owned by Denizli Metropolitan Municipality will be allocated or transferred on behalf of DESKİ pursuant to the relevant articles of Law on Municipalities No. 5393. If the allocation of the said parcel is realised, an area enough to construct the pumping station on; if it is a transfer, the whole parcel will be registered in the name of Denizli Water and Sewerage Administration. Since the area in question is planned as a “Park” in the current zoning plan, a plan amendment was requested for this area to become a “wastewater facility area”. Zoning Plan Amendments are in progress. Afterwards, a request for this area will be made from Denizli Metropolitan Municipality. Correspondence with Denizli Metropolitan 8 / 20 Municipality, Directorate of Real Estate and Expropriation has been initiated, and the decision will be made upon completion of the zoning plan amendment. (Figure 1.4) Figure 1.4 – Location of Block 4 Parcel no. 6710 owned by Denizli Metropolitan Municipality and Sevindik Pumping Station  Eskihisar collector line: Expropriation is required for the cadastral parcel no. 307 in Gümüşçay neighbourhood of Merkezefendi district through which the line passes. The parcel no. 307 in Gümüşçay neighbourhood of Merkezefendi district planned as “road” in the zoning plan on the collector route is owned by 8 different shareholders, 3 of whom are alive and 5 of whom are deceased. As for the deceased persons, it was found that the transaction of transfer is yet to be carried out by their heirs at the Land Registry Offices. Besides, there are 17 heirs of 5 deceased shareholders who were found in the survey conducted by the Directorate of Population. 20 citizens (3 living shareholders and 17 heirs who have not started the transactions of transfer yet) need to be negotiated. Address information of all shareholders and heirs was obtained from the population-based address information system. The right holders residing in Denizli 9 / 20 were reached and informed of the project. Firstly, the decision of public benefit no. 203 of 14.09.2018 by the Board of Directors of Directorate General DESKİ for the subdivision and expropriation of the parcel no. 307 in Gümüşçay neighbourhood of Merkezefendi district has been taken, and this decision was approved by the Ministry of Environment and Urbanization on 12.11.2018. Next, the cadastral file was prepared for the part of the immovable through which the collector line passes, control procedures were completed at Denizli Directorate of Land Survey, and the Directorate submitted the file to the Directorate of Land Registry for the subdivision of the parcel no. 307. However, the Directorate of Land Registry requested opinion from Denizli Directorate of Museum due the annotation “it is a cultural asset that must be protected” in the land register of the parcel no. 307. The subdivision will be registered to the deed after the result of the opinion from Directorate of Museum. Next, negotiations will be conducted to purchase the subdivided part of the immovable from the right holders via expropriation. There is no income-generating activity on the immovable, and it has no vital, agricultural and/or economic use. There are also no unauthorized users. Totally there are 20 individuals (17 heirs + 3 living) Table 1.1 - Land use areas The current status of the lands on the route of the wastewater collector line and the lands on which pumping stations are planned to be constructed in regard to land acquisition within the scope of the SCP is given in Figure 1.6 below. 11 / 20 Figure 1.6 - Status of Land Acquisition in the Project Area 12 / 20 2. POTENTIAL IMPACTS AND AFFECTED PEOPLE 2.1. Project-Affected People Since the parcel no. 1903 in which the construction of Akvadi Pumping Station is planned within the scope of the construction work DES-W1 is owned by the State Treasury and it is qualified as a forest, official applications were made to Denizli Directorate of Forestry for allocation. As the construction of the TOKİ Pumping Station will be performed in a non-registered area, it is not a matter of concern to any individual in the land acquisition process to be carried out under the construction work DES-W1. For the construction of Sevindik Pumping Station under DES-W2, there is no individuals affected in the area as the block 6710, parcel no. 4 in Eskihisar neighbourhood of Merkezefendi district is owned by the Denizli Metropolitan Municipality. Concerning the land acquisition for the construction of the Eskihisar Wastewater Collector line, the parcel no. 307 located in the Gümüşçay neighbourhood of Merkezefendi district is owned by 8 individuals. These individuals are Fatma KARABAĞ (deceased), Gülsüm ÇALIK (deceased), Raziye SÜMER (deceased), Meliha BOZKIR, Süleyman KARABAĞ, Mehmet KARABAĞ (deceased), Ali KARABAĞ (deceased) and Sultan KILCI. 5 deceased shareholders have 17 heirs. A negotiation needs to be held with 20 citizens in total (3 living shareholders and 17 heirs of the deceased shareholders). Required studies for the expropriation process are carried out by the personnel at Directorate General of DESKİ, Department of Real Estate and Expropriation with the said shareholders and heirs. There is no agricultural activity and/or income-generating activity in the parcel no. 307 to be subject to land acquisition, and there are no tenants or operating business residing in the parcel. Therefore, there are no persons which might be at loss physically and/or economically. 13 / 20 3. LEGAL FRAMEWORK Under the Turkish legal framework, land acquisition/expropriation procedures are based on the Expropriation Law No. 2942 and Article 46 of the Turkish Constitution. Other legislation regulating DESKİ’s activities of expropriation, allocation and transfer is as follows:  Civil Code No. 4721,  Forest Law No. 6831 and the associated Regulations,  Law on Land Development, Law on Land Survey, Pasture Law,  Environmental Law and other relevant legislation,  Soil Protection Act No. 5403,  Law on Public Financial Management and Control No. 5018 In addition to the national legislation to be followed, DESKİ also undertakes to implement the World Bank OP/BP 4.12 “Involuntary Resettlement Policy” under the signed Sub-Loan Agreement. In this context, this report has been prepared by taking into consideration the issues stated in the “Land Acquisition and Resettlement Policy Framework (LARPF) document, and the World Bank OP/BP 4.12 “Involuntary Resettlement Policy Framework” as well as the Turkish legislation. 4. IMPLEMENTATION, COMPENSATION AND OTHER AID The land acquisition process will be carried out by DESKİ. Depending on the type of land (public or private), DESKİ will procure the immovables to use them for infrastructure services, hold negotiations or negotiate through expropriation. Expropriation will be carried out in the part of the privately-owned land through which the Eskihisar Collector line passes within the scope of DES-W2. After the cadastral controls required for the parcel subject to expropriation have been done, decision of public utilities will be received from relevant authorities, and the approval process of this decision will be completed. The compensation amount will be determined by DESKİ’s specialised engineers and other experts pursuant to Expropriation Law No. 2942. Following the valuation process, all individuals to whom the compensation amount to be paid will be contacted for negotiations. In case of failure of negotiations, DESKİ will initiate the relevant court process in accordance with the Expropriation Law. The valuation of the real properties will be carried out by an Expert Commission appointed by the Court. After the completion of the court process, DESKİ will pay the compensation amount determined by the Court to each owner’s bank account before construction commences. During the valuation of the property subjected to land acquisition, the criteria specified in Article 11 of the Expropriation Law shall be taken into account. Accordingly, due to the fact that the parcel for which easement right is required through expropriation is planned in the 1/1000 scale Implementation Zoning Plan, the parcel no. 307 will be considered as land area. Therefore, the price will be determined with the “comparison of precedents” method for the land. Article 11 of the Expropriation Law requires that the sales value for the lands is to be determined according to the precedent sales of no specific purpose which were made before the expropriation day. In the precedent comparison method, the cost of the immovable property subject to expropriation is appraised by taking into consideration the current sales prices of the remaining parcels in the areas of similar construction and social reinforcements. This method is applied for lands that have 1/1000 scale implementation zoning plan and constructions around such as the parcel no. 307. Revenue 14 / 20 capitalisation method is applied for agricultural lands. The price is appraised via average income and expenses of the agricultural data produced in the region. Revenue capitalisation method does not reflect the real value of the immovable property for parcels that are considered land area such as the parcel no. 307. Expert delegation that will make valuation can choose similar lands that may be precedent to the land to be valued from among precedent sales or can accept sales value of a suitable immovable to be found by the expert committee ex officio as concrete precedent in determining the price of the immovable. Access to the railroad Appropriate precedent is determined by reviewing properties such as the provisions of the zoning plan, etc. Justifications of each value affecting the value of the land and its contribution rates to the value need to be determined separately and evaluated providing grounds to determine the expropriation value. In this method zoning plan and the construction conditions are based on because this factor is considered having the most impact on the value. After calculating the land value of the immovable to be expropriated, the compensation amount must be paid to the owners. Moreover, related permits will be obtained from Denizli Regional Directorate of Forestry with regard to Akvadi Pumping Station under DES-W1 pursuant to the Forestry Law and Articles 17 and 18 of the relevant governing regulations. The Sevindik Pumping Centre which is planned to be constructed under DES-W2 is owned by Denizli Metropolitan Municipality, and the process of transfer or allocation from the Metropolitan Municipality will be completed pursuant to the Law on Public Financial Management and Control No. 5018 and Law on Municipalities No. 5393. 15 / 20 5. PUBLIC INFORMATION, CONSULTATION AND PARTICIPATION Prior to land acquisition procedures, the Environmental and Social Management Plan (ESMP) preparations were completed, a Public Participation Meeting was held on January 15, 2019, and the public was informed of the environmental impacts of the project. Persons affected by land acquisition were also consulted and informed about the project in line with this meeting. Negotiations will begin after the completion of the subdivision procedures. Despite the lack of adequate provisions in the Turkish Legislation on public consultation and information on land acquisition, DESKİ provided necessary information to the mukhtars to inform the affected community and left the Land Acquisition and Resettlement Policy Framework document to the offices of Mukhtars. The grievance mechanism of the project will be announced through methods such as giving the contact information and sharing the names of the authorized persons which the affected people can contact, by local newspaper advertisement, the announcement on the website, posters and brochures. If needed further, negotiations for land acquisition procedures may be conducted between the personnel of the DESKİ Department of Real Estate and Expropriation and the affected persons, and İller Bank will be informed through the Land Acquisition Progress Reports which are prepared semi-annually. The personnel of DESKİ Department of Real Estate and Expropriation who had interviewed with the land owners and other affected persons gathered the socioeconomic information required for the implementation of this Abbreviated Land Acquisition Action Plan (ALARAP). The interviews with the affected people will continue during the visits made by DESKİ Department of Real Estate and Expropriation during the land acquisition process. The meetings, participants and problems will be communicated through the Land Acquisition Reports prepared for İller Bank and the World Bank. 6. GRIEVANCE MECHANISM . The grievance mechanism established by DESKİ enables the complaints, concerns and requests of the affected persons to be properly recorded and timely evaluated. No complaints or applications have been made to DESKİ for the project so far. DESKİ will make every effort to ensure that the complaint mechanism of the project is carried out regularly during any information and consultation regarding the affected persons and affected land(s) during the project. During the period of the project, DESKİ will allocate an accessible contact person (Ali İhsan ŞENER /Tel:0258 297 20 20 Dahili: 2613 Survey Engineer) to whom any problems (concerns, complaints, etc.) related to the Project, including those related to land and property acquisition or land can be communicated during the construction. This person is responsible for keeping records of filed complaints on land acquisition. DESKİ will ensure that all complaints are dealt with in a timely manner and resolved according to World Bank policies. By Land Acquisition Progress Reports, DESKİ will inform İller Bank about the complaints received. Within the scope of the Sustainable Cities Project - I, a Grievance Mechanism through which the public can apply to the DESKİ/Project Management unit regarding the problems that may arise during the construction and operation phase will work together with DESKİ’s Integrated Management System. DESKİ will specifically code the applications made within the scope of ‘Denizli Improvement Project for Drinking Water, Wastewater and Stormwater Systems’ refer to the Project Management Unit and refer them to the DESKİ Project Implementation Unit as a priority. MONITORING AND REPORTING DESKİ will prepare a semi-annual Land Acquisition Progress Report covering the land acquisition activities carried out under the Sustainable Cities Project - I (SCP) and submit it to İller Bank. This report will cover the following:  Affected owners and their current status  Suggested and paid compensation, (if possible, an Excel list showing the size of the acquired land (square meters), parcel no. and the compensation paid)  Interviews with the affected people (frequency of interviews and the topics discussed) The purpose of the land acquisition monitoring step is to verify the following:  Affected people have received their compensation within the appropriate period agreed upon,  Whether the complaints made by the project-affected persons are followed, and where appropriate corrective actions are applied for these complaints, At the end of the project, DESKİ will submit a completion report to İller Bank/World Bank explaining the results of all land acquisition activities. 8.
