PROCUREMENT PLAN (Textual Part) Project Information: Philippines Beneficiary FIRST Social Protection Project (P174066) Project Implementation Agency: Department of Social Welfare and Development (DSWD) Date of the Procurement Plan: August 2020 Period Covered by this Procurement Plan: First 18 months of project implementation Preamble In accordance with paragraph 5.9 of the “World Bank Procurement Regulations for IPF Borrowers” (July 2016) (“Procurement Regulations”) the Bank’s Systematic Tracking and Exchanges in Procurement (STEP) system will be used to prepare, clear and update Procurement Plans and conduct all procurement transactions for the Project. This textual part along with the Procurement Plan tables in STEP constitute the Procurement Plan for the Project. The following conditions apply to all procurement activities in the Procurement Plan. The other elements of the Procurement Plan as required under paragraph 4.4 of the Procurement Regulations are set forth in STEP. The Bank’s Standard Procurement Documents: Shall be used for all contracts subject to international competitive procurement and those contracts as specified in the Procurement Plan tables in STEP. National Procurement Arrangements: In accordance with paragraph 5.3 of the Procurement Regulations, when approaching the national market (as specified in the Procurement Plan tables in STEP), the country’s own procurement procedures may be used. All contracts for goods, works and services to be procured under the project in line with the national market approach shall follow the Philippines’ national procurement procedures (NPP) set out in RA9184 (or the Philippines’ Government Procurement Reform Act (GPRA)), which were assessed and found to be broadly consistent with the requirement of the WB Procurement Regulations, Section V - Para 5.4, National Procurement Procedures subject to a few conditions specified in the PPSD and as listed herein. (a) eligibility screening shall not be applied, provided however that the bids that do not contain any of the following documents shall not pass the documentary compliance check: (i) evidence of the required financial, technical or production capability; (ii) audited financial statements; (iii) credit line or cash deposit certificate; (iv) bid security; and (v) authority of the bid signatory; (b)a ceiling may be applied to bid prices provided the following conditions are met: (i) bidding documents are obtainable free of charge on a freely accessible website; (ii) the agency has procedures in place to ensure that the Approved Budget for Contract (ABC) is based on Engineer’s Estimate; (iii) the agency has trained cost estimators on estimating prices and analyzing bid variance; (iv) the agency has established a system to monitor and report bid prices relative to ABC and Engineer’s Estimate; (c) domestic or regional preferences shall not be applied in the evaluation of bids, and other preference in effect in the Philippines shall not be used except with prior concurrence of the Bank; (d)foreign suppliers and contractors shall be allowed to participate, if interested, without first being required to associate with, or enter into joint venture, with local firms, and foreign bidders shall be allowed to bid, even without registration, licensing, and other government authorization, leaving these requirements for after award and before signing of contract; (e) alternative procurement methods defined in the implementing rules and regulations such as Limited Source Bidding, Direct Contracting and Shopping as acceptable, and the use of the other alternative methods shall require prior Bank concurrence; and (f) the e-bulletin board, e-catalogue of prices, subscriber’s registry and e- payments features of the Borrower’s government electronic procurement system (PhilGEPS) may be used with prior Bank concurrence as described in the PIP. When other national procurement arrangements other than national open competitive procurement arrangements are applied by the Borrower, such arrangements shall be subject to paragraph 5.5 of the Procurement Regulations. Other Relevant Procurement Information Component 1 (US$ 580 million) will fund cash grants and performance targets and, hence no procurement activities. Component 2 (US$ 20 million) will support DSWDs SP delivery systems and project management, and will fund (a) strengthening of various business processes and software and hardware for information system upgrades and, the UBD, adoption of the PhilSys (for example, fingerprint scanners and facial recognition devices); (b) development of a tailored service delivery system for BARMM; and (c) project management, which is expected to include procurement of goods (for example, IT solutions, software, hardware, office equipment), consultant services (for example, technical assistance, capacity building and training services) and non-consultant services (for example, cloud services). No large value contracts, nor any procurement of civil works are expected under these two components of the project. Component 3 (US$ 0 million) is on CERC. Consistent with the Project’s objective, the CERC will support the immediate response to an eligible crisis or emergency, as needed, to mitigate the impacts. Eligible expenditures may include cash transfers (for example, ECT) to beneficiaries and procurement of critical goods and services to quickly restore livelihoods and lifeline infrastructure. For the CERC component, an ERM (Emergency Response Manual) includes a section on procurement methods, approaches and procedures in line with the provisions of the Bank Guidance: Procurement in Situations of Urgent Need of Assistance or Capacity Constraints, dated March 7, 2019 and Bank Guidance: Contingent Emergency Response Components (CERC), dated October 16, 2017.
