Period covered by this procurement plan: March 2019 – September 2020 Preamble In accordance with paragraph 5.9 of the World Bank Procurement Regulations for IPF Borrowers, July 2016, revised November 2017 and August 2018 (“Procurement Regulations”), the Bank’s Systematic Tracking and Exchanges in Procurement (STEP) system will be used to prepare, clear and update Procurement Plans and conduct all procurement transactions for the Project. This textual part along with the Procurement Plan tables in STEP constitute the Procurement Plan for the Project. The following conditions apply to all procurement activities in the Procurement Plan. The other elements of the Procurement Plan as required under paragraph 4.4 of the Procurement Regulations are set forth in STEP. The Bank’s Procurement prior review thresholds and selection method threshold: The identified procurement risk under this Project is ‘substantial’. Accordingly, all contracts listed in the Procurement Plan Table at or above the thresholds set out in below are subject to the Bank’s procurement prior review. All other contracts are subject to post-review. The following selection method threshold shall govern for procurement of non- consulting services and consulting services. National Open Competitive Procurement: In accordance with paragraph 5.3 of the Procurement Regulations, the procedures applicable to the procurement of goods, works, non-consulting services and consulting services under contracts awarded on the basis of National Open Competitive Procurement shall be those of the Pelelangan Umum (Public Tendering) and Pemilihan Langsung/Pelelangan Sederhana (Simplified Tendering) methods as set forth in the Borrower’s Presidential Regulation No. 16/2018 subject to paragraph 5.4 of the “Procurement Regulation” and the following, which shall govern in the event of a conflict with the Borrower’s procedures: 1. The procurement is open to eligible firms from any country; 2. The request for bids/request for proposals document shall require that Bidders/Proposers submitting Bids/Proposals present a signed acceptance at the time of bidding, to be incorporated in any resulting contracts, confirming application of, and compliance with, the Bank’s Anti-Corruption Guidelines, including without limitation the Bank’s right to sanction and the Bank’s inspection and audit rights; 3. Procurement Documents include provisions, as agreed with the Bank, intended to adequately mitigate against environmental, social (including sexual exploitation and abuse and gender-based violence), health and safety (“ESHS”) risks and impacts; 4. Rights for the Bank to review procurement documentation and activities; 5. Maintenance of records of the Procurement Process; 6. Procurement Documents acceptable to the Bank shall be used; 7. Bids shall be evaluated using only post-qualification for procurement of goods, works and non-consulting services. Use of National e-Procurement System (SPSE): At the present time, use of e-procurement is only permissible for procurement of non-consultant services through Request for Bids method with Open National competition, and for selection of consultant services through QCBS method using the modified SPSE 3.6 system developed by MPWH and applying the Bank’s standard RFP document. If in the future the Bank considers the SPSE has been satisfactorily modified and found acceptable for the other procurement methods, the Bank will notify in writing to the Project Implementing Agencies. Other Relevant Procurement Information: • Advance procurement may be applied under the project, especially for the main consulting services (NMC, TMC). • Reference to Project Operations Manual: Operations Manual NUDP • For some particular assignments, due to criticality and importance of the assignments, the Bank will carry out prior review although the estimated value of the contract is below the prior review threshold. • Special Procurement Arrangement with UN Agency (UN Habitat) may be applied for some assignment in situations where UN Habitat is determined to be uniquely qualified for the assignment and possesses experiences of exceptional worth for the assignment. • The proposal from bidders/consulting firms shall be evaluated through combined quality and cost scores depend on the nature and complexity of the assignment. The Procurement Plan table below are only for the first 18 months of implementation. The Procurement Plan is a living document and will be revised if there are any changes during the implementation of the project.
