Project Description: The National Electric Power Policy (NEPP) 2001 states that “the primary objective of the Nigeria Rural Electrification Programme is to expand access to electricity as rapidly as can be afforded in a cost-effective manner”. In March 2005, the Federal Government of Nigeria (FGN) passed the Electric Power Sector Reform Act 2005 (EPSR Act 2005), which established the legal foundation for reform of the Nigerian Electricity Supply Industry (NESI), including the establishment of an independent regulatory body, the Nigerian Electricity Regulatory Commission (NERC), unbundling and corporatization of the national electric utility, National Electric Power Authority (NEPA) and the creation of Successor Companies that are now privatized. It also provides the legal foundation for the establishment of the Rural Electrification Agency (REA), a governmental body charged with designing and implementing strategies to achieve rural access to electricity. The EPSR Act 2005 provides the framework for the Government’s approach to rural electrification. It is estimated that only 36% of the rural population have access to electricity and 95 million Nigerians do not have access to electricity. Therefore, the Goal of Federal Government of Nigeria is to increase access to electricity to 75% of the population (rural and urban) by 2020 and at least 10% of renewable energy mix by 2025 as contained in the National Electric Power Policy (NEPP) of 2001 and the Rural Electrification Policy of 2005 respectively. The Federal Government Economic and Recovery Growth Plan 2017-2020 (“ERGP”) sets out the medium-term structural reforms to diversify Nigeria’s economy, including expanding power sector infrastructure as one of the top priorities. Following the World Bank’s spring meetings held in Washington D.C, from the 21st to 23rd of April 2017,between the World Bank Group’s Senior Directors and Nigeria’s Federal Ministries of Finance, Power, Works and Housing, Chairman Senate Committee on Energy, Chairman House Committee on Energy and FGN Senior officials on the Power Sector Recovery Program (PSRP), World Bank missions have visited Nigeria and had a series of meetings with The Ministry of Power, Works and Housing, Ministry of Finance, Budget office, NBET, NERC and REA for the $350 million electrification Project for Solar mini grid projects, Social solar electrification projects and Energising education program (Federal universities IPP programme) The Project is categorized into four components as described below. 3 Component 1 - Rural Mini Grids for Economic Development (IDA US$150m equivalent): The objective of this component is to electrify unserved and underserved areas that have high economic growth potential aiming to serve households, local enterprises and public institutions, developed by the private sector. The tentative target/indicators are 200,000 households; 50,000 local enterprises; and 15 mini grid operators (10 local and 5 international), subject to scaling up or down during project preparation. Figure 1: Candidate sites for minimum subsidy tender in five states This component is the preferred choice for low cost rural electrification planning, depending on a host of context-specific local conditions, including: a) community size; b) population density; c) distance to existing national grid; e) geographic factors such as topography; f) general socio-economic factors (energy demand, economic growth potential). Due to their ability to provide reliable electricity, mini grids can be used to power small industrial machinery such as water pumps and mills for farming/agro- processing, tools needed in welding and carpentry workshops, etc., and are consequently expected to have a positive impact on local livelihoods. Both solicited as well as unsolicited projects will be allowed under the project. 4 The component has two delivery approaches: A solicited track inviting proposals for minimum subsidies for 200 rural load centres. Given the scale of the energy access challenge in Nigeria and the limited number of private developers that are already active at scale prospecting for potential mini-grid sub-projects, in order to catalyse mini-grid deployment at scale and kick-start the market, a solicited track for mini-grid proposals will be implemented; An unsolicited track providing a framework for a market-based approach. The unsolicited track will provide performance-based grants to mini-grid sub-projects on the basis of installed capacity ($/kW), new connections ($/end user) or a combination of both. It is expected that there will be performance-based grants for 1,167 mini grids/load-centres; at least 8 companies; and 342,423 end users. Component 2 - Rural Standalone Solar Systems (IDAUS$75 million equivalent): The goal of this component is to help 2.5 million underserved Nigerian households and micro enterprises (MSMEs) access better energy services at lower cost than their current service, via stand-alone solar systems provided by the private sector. The solar powered solutions range in size and level of service. The market-based intervention approach is estimated at $80 million and was selected based on market barriers and financing needs of the private sector in the solar market in Nigeria as well as past program experiences in other countries. A number of discussions with partners, the client, and key private sector firms, confirmed that the support is both necessary and complementary to the ongoing efforts in the sector. Investment: Output Based Fund ($60M). This fund will provide payments (in the average range of 15% per system) for each eligible system installed and verified to enable capable solar providers to reach and serve larger numbers of customers more rapidly. This line of support is not a subsidy on the end-user price. Rather, expanding reach requires investment in people, training, advertising, increased working capital, processes, logistics. The grant amount will be fixed for each system size/level of service category and reduced over the life of the programme to a nominal level during the final period of the program. Investment: Market Acceleration Challenge Fund ($15M). This fund will offer up-front payments grants to the handful of strongest and most capable providers to accelerate their capacity to reach and serve Nigerian households and MSMEs at massive scale. It will enable commercial investment in solar providers in spite of FOREX risk and local debt that is limited and high cost, by reducing investors’ risks. A tranche-based payout will be used to manage any risk of non-performance. Technical Assistance ($5M). Several TA support pieces were identified during the preparation mission to address the market and regulatory barriers which if addressed could make the financing support to the private sector go further, helping the sector grow and mature: An extensive national market study to identify the needs and market opportunities at the household level through establishing energy demand for different levels of service and market segmentation. The study is likely to build on the multi-tier framework (MTF) household survey scheduled to be carried out in the next few months. The study would provide insights to eligible companies to decide where to target their services, help prospective new entrants assess the market prospects in Nigeria. (Bank-executed; preparation stage) Targeted above-the-line and other sensitization campaign focusing on consumer awareness and sales promotion to support all eligible providers. (Lighting Africa; implementation stage) 5 Easing of regulatory barriers including importation duties and tax, easing forex constraints, streamlining the mobile payment regime, adoption and enforcement of standards for products, etc. (implemented and co-funded by partners like Shell Foundation; preparation and implementation stages) Incubation and technical advice to new entrant solar companies to help them develop missing capacities, refine and develop business strategy, support them in engaging with and attracting investors (WB Climate Innovation Center; implementation stage) Adoption of Lighting Global standards for solar products in Nigeria will require testing and enforcement capability (Lighting Africa with Standards Organisation of Nigeria and ECOWAS; implementation stage). Component 3 - Underserved Universities and Hospitals (IDA US$105.00m equivalent): Access to uninterrupted power supply in the federal universities and university teaching hospitals in Nigeria has been cited as a major challenge and barrier to effective learning, institutional operations and student residency. Consequently, the Honourable Minister of Power, Works and Housing has developed an initiative called ‘Energizing Education’ (the “EE Program”). This is a rural electrification initiative that seeks to; develop off grid captive power plant projects for the generation and provision of adequate power supply to 37 federal universities and 7 university teaching hospitals, provide street lights to ensure safety for students, staff and visitors of the institutions, as well as to develop and operate training centres to train students in courses related to renewable energy. The next phase of the Programme also seeks to distribute power to the surrounding communities of those institutions to not only improve quality of life but also to promote economic/SME activities. Component 4 - Technical Assistance (IDA US$ 20.00 million equivalent) Consulting services and training (US$12.0) plus Operating Costs (US$8.0) 6 This component will finance project implementation as well as help build the framework for rural electrification. This component will be used to fund activities including but not limited to the following: (i) Funding of the PIU, (ii) Energy demand studies, surveys and community identification for developing solar mini grids and individual solar systems, (iii) Support for safeguard instruments, (iv) Support for engineering design and project management for Energizing Education and Economic Clusters, (v) Preparation of operational guidelines for REF and other implementation support B. PROJECT DEVELOPMENT OBJECTIVES: The project development objective is to increase access to electricity services for households, universities, and small businesses in rural areas Result Indicators: The proposed PDO indicators are: (i) Number of People/household provided with new or improved electricity service. (ii) The number of enterprises provided with new or improved electricity services. (iii) Number of public institutions provided with new or improved electricity services. The use of Nigeria’s Procurement Act 2007 may be considered for the procurement of standard off-the-shelve goods and small works as situation demands. There are no other restrictions to procurement on state-owned enterprises that meet autonomy requirements 3. COVID-19 Context in Nigeria 3.1 The recent outbreak of the COVID19 pandemic across the globe has had an unprecedented impact on socio-economic and healthcare systems. Nigeria, not being exempt from this outcry, is currently witnessing an exponential rise in COVID-19 cases. According to the Nigeria Centre for Disease Control (NCDC), the confirmed number of COVID-19 positive cases in the country is growing exponentially and has reached 1,728, with the number of unconfirmed cases estimated to be significantly higher given the likely number of asymptomatic cases and the challenges with rapidly mobilizing testing. 3. 2 The COVID-19 pandemic presents unique and severe challenges to the health care system. Current data from the World Health Organization indicate that approximately 20% of individuals who contract COVID-19 will require professional medical care, and approximately 20% of these patients will require intensive life-supporting interventions. The highly infectious nature of COVID-19 (each infected person transmits the disease to 2-3 other people) combined with its potentially severe individual health impacts mean that healthcare and testing facilities are likely to be severely strained. There are, on average, 25 critical facilities per state that act as isolation and treatment centres and laboratories for COVID-19 containment and over 16,900 public healthcare facilities of which the majority lack reliable power supply. 3.3 In consideration of both the health and economic impacts of COVID-19, the Rural Electrification Agency (REA), in partnership with the NCDC, the National Primary Health Care Development Agency (NPHCDA) and State Governments, is proposing a Response to urgently supply reliable electricity to a prioritized cohort of 100 isolation and treatment centres and 400 Primary Health Centres (PHC) by accelerating funds under the Nigeria Electrification Project. 3.4 REA’s Proposed Response under NEP (P161885). REA proposes to accelerate funds under NEP for the Response (US$78M) as it directly supports the development objective, results framework and outcomes of NEP (new connections, capacity of solar mini grids installed, employed people, number of public institutions, number of people and women impacted). Under NEP, a cohort of 25 companies have been qualified and a streamlined online procurement and monitoring platform is operational (REA-Odyssey). NEP also includes the proposed Engineering, Procurement and Construction (EPC) + Operations & Maintenance (O&M) approach as well as an accompanying Sustainability 11 Plan for the universities and teaching hospitals. REA and the PMU have the capacity, established procedures and systems to implement fiduciary, safeguards, procurement and other requirements. The Response does not require changes in the Financing Agreement and the Subsidiary Agreement (between Ministry of Finance [MoF] and REA). The Project Implementation Manual (PIM) will remain the same notwithstanding two waivers/approvals on thresholds for the two proposed procurement packages (see below). 3.5 The objective of the Response is to rapidly provide reliable, efficient and sustainable electricity to 100 isolation and treatment centres and 400 PHCs throughout the country as identified by REA in coordination with NCDC, NPHCDA and States Governments. The Response proposes to deploy solar hybrid power systems that have a modular design for fast mobilization that can provide instant basic services for emergency operations. The system also provides adequate power for equipment (ventilators, cooling systems, etc.) used for testing and treating COVID-19 related cases as well as steady water supply where needed. In order to minimize power consumption and cost some facilities are retrofitted (e.g. bulbs). The systems need to be delivered on time (deployed within weeks, not months) and on budget. The Response is designed in a way that sustainability is also addressed post COVID-19 crisis. REA and partners have already successfully installed the first four systems in healthcare facilities as part of the Government’s Response and wants to expand this rapidly throughout the country. 4. Strategic Assessment of Operating Context and Borrower Capability 4.1 Operational Context 4.1.1 Governance Aspects Nigeria is a Federation made up of six (6) geopolitical zones comprising thirty-six (36) states and federal capital territory, Abuja. It is a democratic government with a multi- party system. There are three (3) arms of Government consisting of the Executive, Legislature, and Judiciary. The day-to-day activities of the Government are run by the Executive with its Ministries, Department and Agencies (MDA). The Rural Electrification Agency (REA)) is an agency under the Federal Ministry of Power, Works & Housing. The Federal Government has promulgated the Public Procurement Act 2007 with regulations and guidelines issued by the Bureau of Public Procurement (BPP). All procurement processes by federal government MDA’s are guided by the Act. However, this Project will be governed by World Bank’s “Procurement Regulations for IPF Borrowers” (Procurement Regulations) dated July 2016 and revised in November 2017 under the “New Procurement Framework (NPF), and the “Guidelines on Preventing and Combating Fraud and Corruption in Projects Financed by IBRD Loans and IDA Credits and Grants”, dated July 1, 2016, and other provisions stipulated in the Financing Agreements. Compliance with governance-driven regulations will have a significant impact on the management of the project for successful implementation. The project will have to be proactive in its operations to enable it meets the project development objectives. For example. ● The project will need to learn from older projects how they were able to successfully transit Nigerian Government implemented a Treasury Single Account (TSA) policy which closed all government accounts in commercial Banks and transferred the money to the Central Bank of Nigeria (CBN). If not 12 properly handled, payments particularly to foreign contractors/consultants could take several months. Problems associated with local payments have been largely solved since the accountants can pay directly after all the signatories have signed their respective portions of invoices online. ● NOTAP stands for the National Office for Technology Acquisition and Promotion. It is one of the agencies under the Federal Ministry of Science and Technology (NOTAP). NOTAP is responsible for registration of all technology transfer agreements signed by Nigerian entrepreneurs and their foreign technical partners. The Central Bank of Nigeria will not make any foreign payment especially to foreign Consultants if such payments are not backed up by the required certificates from NOTAP. The process of obtaining the certificates is also very cumbersome and not very straight forward. The project may need to start interacting with NOTAP to enable it to understand the working of the agency and how to synergise with them to ensure prompt response from them each time the project requests for a certificate. The World Bank and the Nigerian Government need to work together to solve the problem that could emanate from NOTAP especially for the foreign consultants. ● With the number of coronavirus (COVID-19) cases growing exponentially, the Federal Government of Nigeria instituted a national policy that restricts human and vehicular movements within and across the States in Nigeria. It also affects both inter-states and international borders. The project operations have been adversely affected thus: challenge of availability of various service providers; operational delays resulting from the Consultants’/Suppliers/Contractor’s inability to implement the contract due to the restricted movements and market closures; deferred contract commencement; workers’ inability to come to work; inability of the Project staff to coordinate effectively with the Bank staff because they now work from home not the office; international Consultants could not continue contract implementation because there are no flights; e.t.c. Government has made and is still making progress in its fight against insurgency and armed banditry in some parts of the country. Significant security concerns are not envisaged within and around the project sites. 4.1.2 Economic Aspects Overall, this project will make a significant positive impact on the Nigerian economy and environment as it will amongst others: - ● Increase agriculture, industrial, commercial and other economic and social activities in rural areas. ● Raise the living standards of the rural population through improved water supply, lighting and security. ● Encourage the use of domestic electrical appliances to reduce the drudgery of household tasks. ● Promote cheaper, more convenient and more environmentally friendly options to the prevalent lighting methods. ● Assist in reducing rural – urban migration. 13 ● Protect the nation’s health and environment through pollution reduction and elimination of other energy – related environmental hazards. ● Provide reliable, efficient and sustainable electricity to 100 isolation and treatment centers and 400 PHCs throughout the country by providing adequate power for equipment (ventilators, cooling systems, etc.) used for testing and treating COVID- 19 related cases as well as steady water supply where needed as identified by REA in coordination with NCDC, NPHCDA and States Government. 1. Nigeria was ranked as the 30th largest economy in the world with a Gross Domestic Product (GDP) growth rate of 2.1% as at 2016. Following a global drop in the price of oil in the same year and owing to its dependence on the oil (which accounts for 70% of the GDP), and the incessant vandalization of oil pipelines along with insurgency, the country’s revenue dropped, and the naira weakened. These factors plunged the country into recession after two decades in August 2016. 2. The economy was declared out of recession in the second quarter of 2017 when the GDP grew by 0.55%. As seen in the graph below, there has been steady growth since then. 3. Nigeria is the biggest economy in Africa. Services is the largest sector of the economy, accounting for about 50 percent of total GDP. One of the fastest growing segments in Services are Information and Communication, which together account for about 10 percent of the total output. Agriculture, which in the past was the biggest sector, now weighs around 23 percent. Crude Petroleum and Natural Gas constitute only 11 percent of total GDP, while being the main exports. Industry and Construction account for the remaining 16 percent of GDP. 4. The economy of Nigeria advanced 1.87% year-on-year in the first quarter of 2020 compared to a 2.55% growth in the previous period, against the backdrop of significant global disruptions resulting from the Covid-19 public health crisis, a sharp fall in oil prices and restricted international trade. It was the slowest pace of economic expansion since the third quarter of 2018, reflecting the earliest effects of the disruption, mainly in the non-oil sector (1.55% vs 2.27% in Q4), amid declines in internal trade (-2.82% vs -0.58%); accommodation & food services (-2.99% vs 2.05%); public administration (-8.72% vs 0.06%); administrative & support services (-1.9% vs 1.27%). Also, output grew less in manufacturing (0.43% vs 1.24%) and agriculture (2.20% vs 2.31%). At the same time, the all- important oil sector lost steam (5.06% vs 6.36%). On a quarterly basis, the GDP shrank 14.27%, following a 5.59% expansion in the previous period. NIGERIA GDP ANNUAL GROWTH RATE 14 5. However, according to the Central Bank of Nigeria’s (CBN) statistics, Nigeria's annual inflation rate rose for a ninth straight month to 12.40% in May of 2020 from 12.34% in the prior month. It was the highest rate since April of 2018, due to the lingering effects of the global pandemic. Food inflation hit an over two- year high of 15.04%, amid supply chain disruptions caused by lockdown restrictions. Prices also increased sharply for health (10.66% vs 10.27%), especially felt in urban areas (11.29%) which concentrate the bulk of Covid-19 cases. Other significant upward pressure came from the costs of transport (10.09% vs 9.78%); clothing & footwear (10.39% vs 10.33%) and miscellaneous goods & services (10.03% vs 9.84%). On a monthly basis, consumer prices inched up 1.17%, the most since June 2018, after increasing 1.02% in the previous month. Annual core inflation, which excludes farm produce, hit 10.12% in May, the highest since July 2018. INFLATION RATE 15 6. In recent months, the exchange rate of Naira to the Dollar in Nigeria has been quite stable with the dollar exchanging at a Central bank of Nigeria (CBN) official rate of between N30 6.95 – N307 . As a result, there is no risk to the foreign investor with the Nigeria Electrification Project (NEP) since payments would mostly be made in USD. However, the global COVID-19 pandemic has also affected international businesses with it’s impact on the Nigerian economy. The current exchange rate as at 7th August 2020 is N380, which has risen from the N307 prior COVID-19. 7. The Nigeria Electrification Project (NEP) will also bring about further growth and development to the rural dwellers and the country at large. It would also support Agriculture, promote Small and Medium Enterprises (SMEs) which would lead to a higher employment rate and bring about improved security. Most of all, it will provide environmentally clean and affordable electricity. 8. According to the National Bureau of Statistics, the unemployment rate in Nigeria increased to 23.10 percent in the third quarter of 201 8 from 22.70 percent in the second quarter of 2018. Please see attached graph for clarity. UNEMPLOYMENT RATE 16 The NEP project would help in getting people self-employed and gainfully employed because having constant and affordable electricity will be a panacea for most small-scale business owners. 4.1.3 Sustainability Aspects Nigeria submitted its Intended Nationally Determined Contributions to the United Nations Framework Convention on Climate Change (UNFCC) in November 2015. The NEP would facilitate moving to low carbon energy sources and move to non-fossil energy usage that will enhance a reduction in CO2 emissions. It is pertinent to realize that women and household are central to any national plan to mitigate carbon emissions and deforestation. Therefore, there is a need for holistic and well thought out plan, which NEP represents, aiming to provide clean, efficient electricity thereby contributing to eradicating energy poverty, whilst bringing considerable health, developmental and environmental benefits. The NEP, when fully implemented, can mitigate deforestation, one of the major causes of global warming. Moreover, it can help reduce indoor and outdoor air pollution with its attendant health consequences. The NEP is majorly of renewable sources with no soot and low CO2, a principal ozone depletion gas. Therefore, there will be no significant sustainability and environmental aspects that would have a procurement impact under the Project, over and above compliance with Nigerian and international standards as well as the World Bank Safeguard policies relating to environmental and social effects. ESIAs and ESMPs will be conducted at each project site in accordance with the environmental laws of the government of Nigeria. 4.1.4 Technological Aspects Nigeria is technologically advanced and could make good use of its technological status to leverage on procurement approach. So much has been done on the infrastructure, but more needs to be done in terms of the implementation of the technological change. 17 Cell phone access and coverage is relatively high even in remote areas in the country which makes people including bidders to exchange and access information around the entire country. In recent years, Nigeria has made tremendous advancement in providing internet access, with fibre optics coverage of nearly 90 percent of the country, with over 20 major operators. There are no restrictions in the use of internet facilities. The print and electronic media have active public and private operators, with the whole country covered by electronic media. In addition, several MDAs, including the Bureau of Public Procurement, have websites where procurement opportunities and contract awards are published. The NEP project will publish its procurement notices in UNDB Online and the procuring entity’s website in addition to publications in the national newspapers. The county-wide restriction of movements due to COVID-19 has made it impossible to conduct normal regular meetings with the Consultants/Suppliers/Contractors, but the Project has improvised by deploying technology to organize virtual meetings via zoom conference calls. This medium is also used for the opening of bids, technical and financial proposals, contract negotiation meetings e.t.c. Conclusions on Operational context to be addressed through the procurement approach. The Nigerian economy is growing gradually since its exit from recession in 2017. Exchange rates have generally stabilized and the legal and regulatory frameworks have improved in recent years, thus making the environment suitable for private investment. 5.0 Client Capability and PMU Assessment 5.1 Experience: The Nigeria Electrification Project is the first World Bank funded Project to be implemented by the Rural Electrification Agency. The Head, Project Management Unit and the Senior Procurement Specialist have worked in various capacities with the World Bank funded Projects. The other PMU staff (Senior Environmental Specialist, Senior Finance Development Specialist, Senior Commercial Specialist, Senior Technical Advisor and Social Specialist) have worked in the Private Sector in their respective professional capacities. The Project Accountant and Internal Auditor were seconded from the Office of the Accountant General of the Federation and has not worked in World Bank funded Project. The Project team has demonstrated good improvements in project implementation since effectiveness. Guidance has been received on handling procurement under COVID-19 conditions. 5.2 Need for hands-on support There is a need for Institutional capacity strengthening through external assistance and training programs, management retreat for proper integration of the PMU. 18 The other PMU staff are capable and reliable in their specialties, but need relevant training to strengthen their capacities, particularly in the application of the Procurement Regulations under the New Procurement Framework of the World Bank. 5.3 Contract management capability and capacity There is no significant professional gap identified, but capacity strengthening through external assistance and training programs may be necessary to further strengthen the capacity as the program expands. In addition, the Project will engage a consulting firm to support the project team in contract management. 5.4 Complaints management and dispute resolution systems: Grievance Redress and Feedback Mechanism: to identify, mitigate, or prevent adverse impacts on the project and produce appropriate corrective actions. The procedures for making a Procurement-related Complaint are detailed in the “Procurement Regulations for IPF Borrowers (Annex III).” If a Consultant wishes to make a Procurement-related Complaint, the Consultant should submit its complaint following these procedures, in writing (by the quickest means available, that is either by email or fax), to the implementation Agency. 5.5 Key Conclusions: REA will put mitigation measures in place and will be proactive in its style of procurement to ensure Value for Money through timely completion of contracts within budget and to specification. 6.0 Market Analysis 6.1 Supplier Positioning Model The total value of procurement activities (Goods, Non-Consulting and Consulting Services) envisaged under NEP is about US$167 million. 89% of this value constitutes the mini-grid developments under component 1 of the Project. Each mini-grid contract value is above 1% of the overall procurement costs under the project. Due to the adoption of the minimum subsidy proposals with possible ESIA, ESMP and RAP requirements, it is considered a high risk, low value contract on the supply positioning model as shown below. The contracts for the Nation-wide geospatial analysis, survey data collection for mini grids market intelligence and prospectus and the contract for Consultancy for Mini Grid pre-investment activity are considered a low value contracts each constituting less than 1% of the total value of the procurement cost, and considered low risk on the supply positioning model. This is due to the relatively high number of foreign and local consulting firms in this market. However, the COVID-19 intervention programme estimated to cost US$78million is considered a high value, high risk activity. The high risk consideration stems from the current limitation on effective participation of potentially qualified bidders/proposers/consultants in competitive procurement process. The global and national restrictions on movement has adversely impacted on global businesses and competitiveness in the procurement process. This has influenced the adopted limited market approach option for the COVID-19 intervention activities. For mini grids, this includes projects with mini grids with private sector participation in East Africa, South Asia and elsewhere as well as its dedicated ESMAP facility on mini grids that can draw from extensive knowledge both within and outside the organization. For stand-alone solutions, Lighting Africa, the joint WB-IFC program that is currently operating in 11 African countries including Nigeria, has supported the delivery of quality-verified off-grid lighting and energy products into the hands of 52.5 million people since 2007. Of particular relevance to this project is the Lighting Ethiopia program, which utilized a financial intermediary to provide a credit facility for retailers of solar lanterns. There are eight (8) identified Mini Grid Developers and about 14 active SHS-distributors of the Lighting Global quality verified solar lanterns/home systems in Nigeria. More potential distributors are interested in entering the market but are deterred by the scarcity of foreign exchange. The existing and potential solar lanterns/home systems importers/distributors remain hampered by a lack of suitable loans and inadequate access to foreign exchange. The COVID 19 pandemic has adversely impacted the value of the Nigerian Naira because of its impact on the fluctuating international oil market. Direct Foreign investment has also been hampered by the global lock-down due to the pandemic which has affected businesses. The COVID-19 pandemic has adversely affected economies and businesses across the world. It has forced Governments to take various reactionary measures, including but not limited to: border closures; restrictions of human and vehicular/flight movements resulting in practically non-existing markets. These restrictions have also affected the contractor’s and supplier’s ability to implement the existing contracts. Competitive procurement processes become a challenge in this circumstance. Most of the potentially qualified companies/firms, who are also wary of the health risks posed by the COVID-19 pandemic may have granted leave to their employees, will not want to bid at this time. Hence, their non-availability for business transactions thereby limiting effective competition in the procurement process. Therefore, the COVID-19 pandemic has brought in an unprecedented challenge to procurement activities globally. Some procurement processes may be delayed or cancelled in some on-going projects as a result. Consequently, an open competitive procurement process may not be a desirable option at this period. Other considerable options may include direct selection, limited competition e.t.c. The viability of the options may however depend on the following: 1. None or mínimum human movement is required to execute the contract; 2. The godos, equipments and materials (in the required quality and quantities) are readily available in stock (i.e no importation and port clearance required); 3. Established technical and financial capabilities amongst the selected companies/firms e.t.c. The procurement arrangement adopted for the COVID-19 Goods component is the limited market approach option with the Request for Bids (RFB) selection method. The following are the summarized justifications for the selection of the Eleven (11) firms and the procurement arrangement for the Development of Solar Power Supply to 100 Isolation and Treatment Centers under the COVID-19 Intervention Program: 21 ● For the purpose of rapid project deployment, the firms all have proven track records of successful project implementation with the Rural Electrification Agency (REA); ● The firms have readily available stock of equipment required to deploy the energy solution within the short timeframe; ● The firms all have equipment already in stock inside Nigeria or have already ordered from outside Nigeria and can provide evidence of a bill of lading showing a date of shipment that is before the date of signing the contract; ● The firms will confirm the supply of only new material/equipment is to be used in the construction of the energy solution; ● The firms are of sound financial standing, capable of executing the scope of work; ● The firms can provide evidence of entrance into a joint venture with another company (where applicable) or supplier to ensure the availability of material and human resources; ● The firms will guaranty that 60% of all offered systems will be fully installed and commissioned latest 3 weeks after contract signature, the remaining systems latest 5 weeks after contract signature; and ● The firms have operational offices and personnel within the lots of their bidding preference. Similarly, the procurement arrangement for the COVID-19 Consultancy component is also limited market approach with Request for Proposal (RFP) selection method. In addition, apart from the relatively shorter lead-time to contract award advantage, the Bidder will also own and be wholly responsible for the design, manufacturing, equipment delivery, installation, testing, commissioning and acceptance. However, the non-availability of the detailed specifications and requirements, unwillingness of the Client to bear the risk of design and specifications/requirements failure as well as the limitation in scope for innovation highlights the unsuitability of this procurement option. This is a key consideration in view of the lessons learnt from the EEP Phase I project. Option 2 - Request for Proposals (RFP) – Plant Design, Supply and Installation (Two-Stage RFP, after Initial Selection) The second selection method considered was the Request for Proposals (RFP) Plant Design, Supply and Installation (Two-Stage RFP, after Initial Selection). The NEP-PMU’s emphasis on the high quality of the design has made this option appealing because it encourages innovations and new solutions, evaluates the quality of the proposals, in conjunction with cost and only the technical specifications are required by the Bidders to prepare their designs. The use of this SPD is usually preceded with an initial selection process that pre-selects only Applicants with appropriate and adequate capacity, capability and resources are invited to submit bids. Although, this document is used when there is no detailed 27 design and specifications available, its applicable for the design and building of large and complex plants. However, the proposed mini-grid plants are not complex facilities. Hence, this option is also not considered suitable. Option 3 - Request for Proposals (RFP) – Plant Design, Supply and Installation (Single-Stage RFP, after Initial Selection) This is similar to Option 2 above with the only difference being the single-stage procurement process involved. This is the most appropriate option as it allows for: only performance specification (not detailed design) is required; design innovativeness, deployment of new (latest) technologies or alternative solutions; delivers a fit-for-purpose solution and it protects the Employer against any risk in the design/installation/construction aspects. These represent the specific needs of the Employer. Some of the lessons learnt during the implementation of the Energizing Education Program (EEP) Phase I (in section 8.0) were considered in arriving at this procurement option. The initial selection process will address the issues related to improper definition of the project requirements, lack of plans for detailed design and submissions for thorough review and approval, National, restricted/selective procurement method, inadequate knowledge of the RFP used, inadequate site information, risk management issues, e.t.c. Whilst the initial selection process will address the quality and capabilities of the Proposers, the RFP selection method/process guides against the others challenges encountered. 9.2 Development of Solar Power Supply to 100 Isolation and Treatment Centers under the COVID-19 Intervention Program Two (2) contracts are envisaged under this activity i.e Procurement of Goods and Consultancy Services for Supervision. The Goods contract with estimated cost of US$20.5million will normally be procured through an international competitive bidding selection method (i.e RFB) with the open market approach option. However, considering the global and nation-wide restrictions on movements (via land and air) within the country due to the impact of the COVID-19 pandemic with its attendant dip in global businesses, this selection option will no longer be viable. Therefore, the Limited Competitive Bidding amongst local companies identified to have the requisite capacities and capabilities with due considerations to the following: Availability of the required inventories in stock; Operating location of the company’s resources in reference to the project site; and Company’s familiarity with/knowledge of the project sites/locations e.t.c will be a more suitable procurement option. This is because the Project was able to carry-out a market search to discover that there are few potential bidders with substantial volume of the required inventories for the construction of these facilities in stock within the country and are willing to deploy as soon as the contract is signed. 28 9.3 Consultancy Services for Supervision of the Construction of 100 Isolation and Treatment Centers under the COVID-19 intervention Program The Consultancy contract under the COVID-19 intervention Program with an estimated cost of US$1.15million should normally be procured using the Quality and Cost Based Selection (QCBS) method with an open market approach. However, the prevailing pandemic situation has rendered this procurement option unsuitable as most of the potentially qualified international companies will not be willing to participate.
