I page Annex: Resettlement Monitoring and Assessment Plan Annex: Feasibility Study on Adjustment of Compensation Rate for Affected Houses-Luoyang-Sanmenxia Expressway Project General The expressway from Zhumadian to Xinyang, as the southern extension of the expressway from Zhengzhou to Xuchang, Luohe and Zhumadian that runs through the south of Henan province, is the vital passage of the north to. south highway transportation channel in China. It is an important part of Beijing-Zhuhai National Trunk Highway (NTH). It starts from the terminal of Luohe-Zhumadian Expressway, which is now under construction and ends in the east of Xinyang City where the interchange overpasses the National Highway 312, with total length of 95 .52 km. This section of expressway connects two important regions in south Henan- Zhumadian Prefecture and Xinyang City. It passes through Runan, Queshan and Pingqiao county/district, etc. They are all major agricultural areas in Henan Province.. According to statistics of 1997, the area of Zhumadian and Xinyang City/Prefecture is 33618Sq. Km, the total population is 15.49 million and GDP is 43.563 billion-yuan RMB. It takes 10.67%/ of the GDP of Henan Province. In 1998, the daily traffic volume came to 10,000 vehicle/day within this section of the existing highways, which significantly exceeded the capacity of the existing highways. Therefore, it is necessary to build an expressway from Zhumadian to Xinyang. Construction of this section of expressway will occupy certain amount of land (include cultivated land) permanently or temporarily. Some of the ground attachments will be removed. Therefore, the normal, fife and production of the local people will be influenced at certain leveL This Resettlement Action Plan is prepared to solve and settle these problems properly, offer reasonable compensation and resettlement to the people who are influenced by land requisition and removal, protect the migrants' lawfil rights, and create conditions for future economic development to keep the migrants' living standard at least the not lower than the form one. This project shall occupy 9,074mu (604.93 ha.) of land permanently and remove 31317Sq.m of buildings. 1,384mu (92.27 ha.) of land shall be occupied temporarily. The amount for compensation shall be 231.86846 million-yuan and 4,920 people shall be affected. The cultivated land to be affected is 252,812mu. The permanent land requisition for this project is 3.5% of the total cultivated land of to be villages of land requisition.'* ->M; Therefore, the influence to the villages is not strong. This project is planned to startonNov.20, 2000 and complete inNov.30, 2003.- I~~~~~~~~~~~~~~~~~~~~~~.-.t I. Background of the Project 1. Description of the Project and Its Major Purpose The expressway from Zhumadian to Xinyang is an important part of Beijing-Zhuhai NTH. It connects the important regions in the south of Henan Province-Zhumadian Prefecture and Xinyang City. It is an important passage on north to south highway transportation of China. At present, fully enclosed and elevated expressways from Anyang to Xinxiang, and from Zhengzhou to Xuchang and Luohe have been built up. The expressway from Luohe to Zhumadian is now under construction. They are also parts of BeiJing- Zhuhai NTH. The upgrading of Class I highway from Xinxiang to Zhengzhou and the preparatory work for Xlnxiang-Zhengzhou expressway are also in process. . Because of the rapid economic development of China since reformation and opening to world, highway traffic volume is increased greatly. The investigated traffic volume between Zhumadian and Xinyang has been more than 10,000 vehicle/day (converted into medium-type vehicle), which significantly exceeded the capacity of the existing highways. Therefore, it is necessary and urgently required to build Zhumadian- Xinyang expressway. It has important significance to improve and realize Beijing- Zhuhai NTH to be functioned as expressway, to clear cross interference, to enhance the capability of highway, to reduce traffic accidents and to promote further development of the national economy. 2. Regions Affected and Benefited by the Projec The expressway from Zhuniadian to Xinyang directly influences Zhumadian Prefecture and Xinyang City, including 12 counties or districts under their administration: Qinyang, Runan, Queshan, Pingyu, Suiping, Shangcai, Xincai, Zhengyang, Pingqiao, Luoshan, Xixian and Guangshan as well as Luohe City and Hubei Province. It will influence indirectly 5 counties including Xinxian, Huangchuan, Huaibin, Gushi and Shangcheng as well as Nanyang City, Zhoukou Prefecture and Anhui Province. The construction of 95.52km long expressway shall bring vigorous development for the above-mentioned areas, which are main grain, cotton and edible oil producers in Henan Province. Also the investment enviromnent shall be improved and the economical .development shall be promoted. It will make great role in poverty fighting. 3. Social and Economical BaCkground of the Regions Affected by the Project Zhumadian Prefecture is located in the south of Henan Province with total area of 15,083Sq.m, 753,000 ha. of which is cultivated land. Its total population is 7.89 million, in which 7.04 million are agriculural people and 850,000 nonagricutural people. Its population density is 523 person per square meter. The average cultivated land per capita is 1.6mu. The main scope for agriculture includes grain, cotton and edible oil. Main industxy sections include non-metal development, building mateials, 2 medicine, textile, machinery, electricity and chemistry. Its main products include cigarette, beverage, alcohol, textile products, machine-made paper, paper plate, synthetic ammonia, plastic products and cement. Its GDP in 1997 was 22.509 billion- yuan, average 2,806 yuan per capita, ranking the 15th in 17 cities and prefectures in the province. Xinyang City, which connects with Hubei Province, is located in the south end of Henan Province. It has 18,915sq.m of land with 520,000ha. cultivated land. It has 7.6 million people including 6.6 million'agricultural people and 1 million non-agricultural people. The population density is 402 per square meter. The average cultivated land per capita is 1.2mu. The main scope for agriculture includes grain, cotton, red ramie and tea. Main industry sections include machinery, electricity, medicine, building materials, foodstuff feedstuff, textile and chemistry. There are 38 kinds of explored valuable mine resources, including serpentine and pearlite whose storage ranks first in l. ' f China. Its GDP in 1997 was 22.054 billion-yuan, average 2,785 yuan per capita, ranking the 16th in 17 cities and prefectures in the province. Zhumadian Prefecture and Xinyang City are both under-developed regions in economy of the province. The backward situation in economy needs to be improved. 4. Measures Taken to Minimum Migrants A lot of work has been done to minimum the influence caused by land requisition at the stage of feasibility study of the project. The alignment of this proposed expressway is determined according to the result of aerial photography, the land and the buildings to be influenced can be clearly distinguished in the photograph. In order to minimum the influence to the local people caused by land requisition of this project, Henan Provincial Communications Planning, Survey & Design Institute discussed with the leaders of highway construction departments and local governments along the route to work out the scheme of alignment. A 1:2000 topographic map is finally adopted, with the purpose to take the influence of removal and resettlement into consideration, to determine the scheme of alignment. From the stage of preliminary design, land requisition and resettlement has been the main factors that decide the project design and alignment. Because a lot of work has been done in survey and design stage, best efforts have been paid to minimum .the influence of land requisition. In order to minimum the quantity of land occupation and removal further adjustment for horizontal alignment is made during final design period, to avoid the alignment goes through those villages whose population'is large. Also, the longitudinal rdiei _ is reasonably adjusted to shorten the height of fill and the depth of cut, and the; interchanges are awranged properly. . . In addition, effort shall be made to minimum the influence caused by land requisition 3 and resettlement during construction period. The temporary land used shall be focus on existing buildings and waste yards (e.g. township enterprises that have been closed). Also, best effort shall be made to balance the earthwork during construction period, borrow sources shall be arranged in the waste land or waste hills. 5. Economical and Technical Feasibility Study The preparatory work for this project is arranged earlier because of the big scale and the large investment of this project. ln August 1990, "Pre-feasibility Study for Henan Section of Beijing-Shenzhen NTI" was completed by Henan Provincial Communicatio'ns Planning, Survey & Design Institute. In 1995, "Pre-feasibility Study for Beijing-Zhuhai NTH in the Section between Luohe and Xinyang"' was completed. In 1998, 'Pre-feasibility Study for Beijing-Zhuhai NTH in the Section between Zhumadian and Xinyang" andr 'Teasibility Study for Zhumadian-Xinyang Expressway of Beijing-Zhuhai NTW' were completed. 6. The Preliminary Design and Construction Design The Preliminary Design for this project has been completed during the period of October 1998 to January 1999, the Construction Design has been started in May, 1999 and shall be completed in October 1999 by Henan provincial Communications Planning, Survey & Design Institute. 7. Ownership and Organizational Structure of the Project Zhumadian-Xinyang Expressway is one part of the Beijing-Zhuhai National Trunk Highway, which characterized as stated-owned highway. The Henan Communications Department and the High-grade Highway Construction and Management Bureau under it shall responsible for the said project's construction, management and maintenance. During the implementation period, all levels (county/district, prefecture/city and province) of construction authorities and the offices under them shall responsible for land requisition & removal and migrants' resettlement. 8. Social and Economical Survey The social survey for this project was carried out by the design unit and communication authorities at city, county (district) levels under the requirement of Henan Provincial Communications Department. The survey groups involved the Design nstitute, communications bureaus at city and county levels, villages and: households influenced. The survey period was from March 23, 1999 to June 4,1999, totally 74 days. The suvey was focus on economical situation of the counties, towns * and villages along the expressway. including basic production conditions, geological environment, production forms, living habits, lvng levels, people constion, soil- quality, attachment quantity, market price-of local materials and the attitude of the'- local people towards this project. The survey forms mainly included checling statistic data of 1998,1997 and 1996 in statistic bureaus at county level, visiting officers at 4 county, township and village levels and the people who are involved in land requisition and removal. Permanent land requisition and the ground attachments that shall be removed were registered in details to be used as the basis in preparing this implementation plan. The investigation group included the following members (1) Hu Chaoyin: Deputy chief of the First Design Department of Henan provincial Communications Planning, Survey and Design institute (HPCPSDI), senior engineer, who in charge this investigation; (2) Wang Jianshen: Engineer of Planning & Economy Department of HPCPSDI, who responsible for investigating the population, land, output and rate of crops for each village, township and county; (3) Zhang Xinagjian: Assistant Engineer of Planning & Economy Department of HPCPSDI, who assist to investigate the population, land, output and rate of crops for. each village, township and county; (4) Du Junwang: Engineer of the First Design Department of HPCPSDI, who responsible for investigating the quantity of various land occupied and the quantity of structures, attachments, power and telecommunication facilities on various land along the proposed highway; (5) Du Zhanjun Assistant Engineer of the First Design Department of HPCPSDL- who assist to investigate the quantity of various land occupied and the quantity of structures, attachments, power and telecommunication facilities on various land along the proposed highway; (6) Zhang, Zhongmin: Senior Engineer of Geological Exploring Department of ,IPCPSDI, who responsible for investigating soil property, geological environment and natural resources in the areas along the proposed highway; (7) Wu Jingshun: Chief of Planning Division of Communication Bureau ofZhumadian Prefecture, who responsible for investigating the economical condition of each village, township and county along the proposed highway; (8) Miao Baogu: Chief of Engineering Division of Communication Bureau of Zhumadian prefecture, who responsible for investigating the economicalcondition of each village, township and county Wlong the proposed highway; (9) Zhang Baogang: Chief of Design Division of Highway Management Department of Xinyang City, who responsible for investigating the economical condition of each village, township and county along the proposed highway; (10) Peng Zigang: Chief of Planning Division of Highway Management Department of Xinyang City, who responsible for investigating the economical condition of each - village, township and county along the proposed highway.. 9. Preparation of the Resettlement Action Plan (I) The design unit shall provide and requisition quantity attachment quantity and population affected by land requisition and removal according to Construction Design. It will also provide economical situation of the project area, traffic volume forecast after completion of this project and the foreseeing of economical development based 5 on Feasibility Study Report. (2) Set up migrant resettlement organization. The construction authorities of this project at provincial and city levels will be established in December 1999. By that time, the relevant authorities or leading groups in Xnyang and Zhumadian City/Prefecture, and Pingqiao, Runan, Queshan counties/districts as well as townships (towns) under their administration will be set up. The Authorities at different levels will be in charge of passing through land requisition formalities, carrying out removal plan, releasing compensation fee, settling down affected people, guardig social security, coordinating relationship between the Contractors and local people, solving problems based on contracts or authorization of the higher authorities. (3) Giving publicity of the significance of the project and the laws and rules on which compensation policy is made. The propaganda should be extended to every family and every person. (4) The construction authorities and the offices under them at county and district A levels are -in charge of making up Resettlement Action Plan, especially land readjustment plan. 10. Implementation Program Regarding Project Preparation, Contract Signing and Construction/Supervision July 15, 1999: Pre-qualification documents submitting to the World Bank July 4, 2000: release of bidding documents Aug.22, 2000: Bid opening Nov.20, 2000: Commencement of construction Nov.20, 2000-Nov. 30, 2003: Construction period Nov. 30, 2003: Tine for completion Warch 1, 2000-Nov. 1, 2000: Pre-approval of land requisition and removal 11. Permission of Land Utilization, Resettlement and Construction The total permanent land occupation for this project is 9,074mu and the temporary occupation of land is 1,384mu. The plan of land utilization and other relevant documents shall be submitted for approval before May 2000, the best effort shall be made to get the approval from the State Land Administration Bureau before Nov. 1, 2000. The people influenced by land requisition shall be resettled through rearrangement of land. And the rearrangement of land shall be made properly before commencement of the works' 12. Unfavorable Influence Appeared after Implementation None. Influence to the Vulnerable Groups The vulnerable groups include impoverished families, one-parent families and families supported by old people. Table 2.8 shows the qualification standard of vulnerable groups and Table 2.8 provides the number of vulnerable groups affected. Laws and Rules 1. Polices 1. In China, there are three levels of policies regarding land requisition and migrant resettlement. * Basic policy framework set up by central government through issuing state laws and enforcement regulations. * Comprehensive/special regulations and enforcement methods on carrying out state laws issued by provincial governments. * Relevant regulations issued by Prefectures/cities, which are accorded with the state/provincial laws and regulations, and are only applicable in the specified jurisdictional areas. The Resettlement Action Plan is prepared according to the following laws, regulations and the Guideline of Non-volunteer Migrants (OD4.30) issued by the World Bank. The implementation of the Resettlement Action Plan shall be based on the said law framework. 2. Laws and Regulations Regarding Compensation (1) State laws and regulations The following laws contain the key policies about land, grassland and forest: A. "Land Management Law of the People's Republic of China". It is approved by the 16th session of Standing Committee of the 6th National People's Congress in June 1986, and is revised on Aug 29, 1998. It comes into force since JanL 1 1999. B. '"nforcement Regulations for Land Management Law of People's Republic of China", it is approved by the Standing Committee of the State Council on April 24, 1998 and comes into force since Jan. 1, 1999. C. "State Forest Law " and its implementing regulations. (2) The major provisions of the Land Management Law (the most important part) are shown as follows: Ownership (1) The people's Republic of China carries out socialist public ownership for land. That is national. ownership system and collective ownership systeam The land in wban area belongs to the state. The land in count'yside and suburb, apart om those that' - belongs to the state by law, belongs to collective of farmers. Homeste;d & househod . - plots and household hills belong to collective of farmers (Clause 8 of "Laid Management Law of China"). -- (2) The land that has collective ownership of farmers betongs to collective of farners of a village by law, shall be managed and operated by the collective economical 12 organization of the village or by farmers' committee of the village. The land that has collective ownership of farmers belongs to two or more than two of economical organizations of a village respectively, shall be managed and operated accordingly by the collective econoniical organizations of the village or by farmers' group of the village. The land that has collective ownership belongs to a town/township, shall be managed and operated by the countryside economical organization of the town/township (Clause 10 of 'Land Management Law of China"). (3) The land owned by the collective of farmers shall be registered and recorded in the county government. The certificates to prove the land ownership shall be issued by the county government after confirmation (Clause 11 of "Land Management Law of China"). (4) If the purpose of the land ownership is to be changed, it shall registered (Clause 12 "Land Management Law of China!). (5) The ownership and right of utilization of the registered land by law is protected by law. It is prohibited to violate by any units or individuals (Clause 13 of "Land Management Law of China"). Land usage (I) Units or individuals can use the land that belongs to the state and collective of farmers by law. The land user has the obligations to protect, manage and properly use the land (Clause 9 of "Land Management Law of China"). (2) Land survey system is set up by the state (Clause 27 of "Land Management Law of Chinaj). (3) Land statistic system is set up by the state (Clause 39 of "Land Management Law of China"). (4) The governments at different levels shall organize to prepare an integral plan for land utilization according to the plan of social and national economy development, requirements for state land renovation and environmental protection, land supply ability and the need of land for constructions (Clause17 of 'Land Management Law of China). (5) Cultivated land is stiicdy controUed being transferred into non-cultivated land. The state camies out compe ion system for culivated land ocwation In the even't that the cultivated land is to be t tsferred to non-agriculura construction lnd after approval, the unit that occupy it shall be responsible to cultivate another piece of land with the same quality and the same amount according to the principle of "ultivate. the same land as you use". For those who incapable to cultivate or the cultivated land can't meet the requirement, cultivated land cultivation fee shall be paid according to 13 the relevant regulations. This fee will be specially used in cultivating new cultivated land (Clause 31 of "Land Management Law of China"). Land used for state construction (1) Procedure for approval If the approved project needs to use state land for construction, the construction unit shall apply to the land administration authorities above county level that have approval right with relevant documents of law and administrative regulations. The application shall be checked by the land administrative authority and reported to the government at the same level for approval (Clause 53 of "Land Management Law of China"). (2) Confirmation for approval Land used by units and individuals for a specific project shall be handled according to Clause 22 and 23 of "Enforcement regulations of Land Management Law". The authority of approval to unused state land for construction projects is that: (a) land less than 2ha. shall be approved by county (city) government; (b) land more than 2 ha. but less than 4 ha. shall be approved by city ( prefecture) government; (c) land more than 4 ha, shall be approved by provincial government. Apart from paid use land, after the project is completed and passed examination for acceptance, "State Land Use Certificate" shall be issued (Clause 36 of "Execution Method for Land Management Law in Henan Province"). 2. Laws and Regulations Regarding Standard of Compensation Permanent land requisition decrees are mainly based on the implementation method of "Land Management Law" executed in Henan Province (It is approved by the 11^ session of Standing Committee of the 9th Provincial People's Congress on Sep. 24, 1999 and comes into force since Dec. 1, 1999): It is marked in Clause 34 of the "Land Management Law" that after the proposal of land used for construction land is approved, the compensation to the unit whose land is in requisition shall be executed according to following rules: (1) Land compensation fee The requisitioned cultivated land (including vegetable plot) orchard, fish pond, lotus pond and tea garden in suburb of cities under direct provincial administration shall be compensated by 8-10 times of the annual outut value. Other land in suburb of oth; - cites, industry/mining areas and towns under direct admistration of countyhall bl compensated by 7-9 times of the average annual output value for the last 3 years. The * land in other places shall be compensated by 6-8 times of the annual output value. ' In the requisitioned cultivated land, the by-products of crops (vegetables excluded) shall be calculated by 15-20%r of the output of their corresponding main products. 14 When the orchards where no fruit is growing, newly-built fish pond, lotus pond, reed pond, tea garden and forest land are requisitioned, the compensation shall be made according to the lowest standard of the adjacent cultivated land. For the land used for residence and the collective land used for public facilities, commonweal benefits or used for individual business, apart from removal subsidy shall be mad, it shall also be compensated as cultivated land. If the unused land is to be requisitioned, the compensation shall be made by 3 times of average output value of the adjacent cultivated land in last three years. (2) Resettlement subsidy The resettlement subsidy for cultivated land and other land requisitioned shall be calculated according the number of agricultural people to be resettled. That is: the agricultural people to be resettled = the requisitioned land/the average cultivated landper capita. The standard of resettlement subsidy for each agricultural person to be resettled shall be 4-6 times of the average output value of the corresponding cultivated land in last 3 years. For suburb undef direct administration of the province, it shall be 6 times, For the suburb of other cities, land in industrial and mineral areas and towns under direct administration of the county, it shall be 5 times. For other land, it shall be 4 times, but l. the resettlement subsidy for per ha. shall be no more than 15 times. (3) Compensation for young crops shall be made according to the output value of one harvest. (4) Compensation method and standard for ground attachments shall be executed l. - according to the regulations made by the provincial government. The regulations are based on two documents issued by the provincial government. They are the provincial > F document No.113 (189) named "Notice about publishing Henan Provincial's Compensation Standard for Ground Attachments on State Construction Occupied Land", and the provincial document No.152 (1993) named "Notice about Henan l Provincial's Compensation Standard for Ground Attachments on State Construction - Occupied Land". (Note: The cultivation fee is temporarily determined as the same cost of land compensation.) 3. Principle for Compensation (I) Avoid land requisition as far as possible. If it is impossible to avoid, land requisition shall be as fewer as possible, then a Resettlement Action Plan and payment for various compensation shall be made accordingly. (2) Make sure the living standard, productive ability and income of the people. influenced can be resumed to the original level. (3) Buildings such as residential houses to be removed must be compensated according to replacement cost. (4) In principle, the new houses for the migrants shall be ready before the demolition of the old ones, and the removal expense shall be paid. If a transition period is necessary, the units who undertaking the proposed project shall properly pay the corresponding expenses. (5) The units who undertakng the proposed project shall strictly follow the compensation policy and standard drawn up in the Resettlement Action Plan. If there are some important or major variations during the implementation period, a report concerning this case shall be submitted to the World Bank before they come into force. When it is necessary, revision shall be made to the Resettlement Action Plan. 4. Information: Initial consultation from Land Management Bureau of Zhuniadian Prefecture and statistic organizations of Xinyang City. Arranged by Henan Provincial Land Management Bureau and government of Pinqiao District, Xinyang City, in first of June 1999, the compensation standard for land requisition was preliminary estimated by Land Management Bureau of Zhumadian Prefecture and Statistic Bureau of Pingqiao District, Xinyang City, and a report in writing were furnished. The report shows that the average annual output value for every mu of cultivated land is different form the calculdting result, but the difference is slight. In the "Budgetary Estimate Program for Compensation of Land Requistion" provided by Land Management Bureau of Zhumadian Prefecture in June 15, 1999, the' - compensation rate is 1,118yuan/muyear, while the calculating result for compensation rate is 1,O91yuan/mu.year,'the difference is only 2.4%. The anmnal average output value per mu for the township/town along the proposed project in year 1998 is 1054.5yuan/mu.year (data provided by Statistic Bureau of Pingqiao District, 17 Xinyang City), while the calculation result is 961.5yuan/mu.year, the difference is 8.8%. After we calculated the replacement cost for houses under Henan II H1 hway Project, we found out: in 1997, the replacement cost for brick-concrete strucural single-story house was 240yuan/sq.m, while for brick-concrete structural brick-concrete structural storied. building was 265yuan/sq.m. Also, inflation rate in Hean province in 1998 and 1999 was zero. Therefore, we adopt the compensation standard listed in table 3.3. Compensation for Young Crops (1) Compensation for young, crops shall be based on Clause 34(3) in "Execution Methods in Carrfing Out Land Management Law in Henan Province" (revised draft). That is, compensation shall be based on output value for one harvest (output value for one harvest: 546yuan/mu for Zhumadian Prefecture, 481yuanlmu for Xinyang City), so the total compensation fee for the whole project shall be 4,153,172yuan RMB. (2) Compensation for houses (including other buildings affected) See Table 4.1 and Table 3.3. (3) Compensation for vulnerable groups: I,O0Oyuan/househole. Estimation of Cost for Compensation The expenses ocacrred in land requisition and resettlement shall also be included in the general budgetary estimate of th, project. In the execution of RAP, the Resettlement Action Plan shall include annual fund requirement in annual investment plan. The total cost estimation for land requisition and migrant resettlement, based on the price of June 1999, shall be 218.76 million-yuan RMB.. 1. Capital Flow According to the compensation policy and standard given in the Resettlement Action Plan, PMO shall sign agreements of compensation with Commissioner Office of Zhumadian Prefecture and Xinyang Government respectively. The compensation fee shall be paid according to the agreements and the schedules given in the agreements. The Provincial Construction Authority shall allocate the compensation fund to the township governments, village committees and the people who are influenced through city/County construction authorities. The compensation for public infiatructure facilities affected shall be paid to those public enterpnses concerned through city/county authorities. 2. Basic Cost Detailed calculation for different expenses see Table 4.1 3. Administration Cost ' For the organizations that are responsible for migrant resettlement and restoration, another 3% of the total compensation fee for their jurisdiction areas shall be drawn as their administration cost. The other governments at different levels have no right to draw such administration cost. 4. Contingency The estimated cost for implementing Resettlement Action Plan shall include the changes caused by unforeseen prices and quantities. It begins at the endpoint of Luohe-Zltitnadiani Expressway (tunlder consitrction), and stops at Xiniyang City. It passes Runan, Queshan and Pingqiao Counties and its total lengtih is 95.52 km;. This project also includes roads connecting to cities anid county seals along the way. It is expected to commence construction on Junie 1, 2000 and to finish in June of 2003. For the main stem of the project, 9074 mu land is to be acquired, 1384 nu land is to be leased, 225 households (868 people) resettled, and the area of houses affected is 31752m2. Some power supply, telecommunications and water supply facilities are affected to varying degrees. To alleviate the above-mentioned impacts, it is planied to carry out land adjustiimenit in the 52 affected villages and resettle-the villagers affected by land acquisition. Affected inlrastructure will be recovered. The - total land acquisition and tesettlement imvestment for the main stemii of this project is 231.8685 mnillion yuan. 2 Purpose of Monitorinig and Assessmentt To ensure resettlemnent is implemented according to the resettliemeit action plan, in accordance with the requirenments of the World Bank, the Govenmenit and the afteccted populalion, the Project Employer should hire an organization, whiich is completely independent from the project implementation organization and govemnment agencies and acknowledged by the World Bank, to-' carry out independent monitorinig of resettlemenlt implementationi process and assessment or implementation results. This monitorinig organiizationi will lave an extensive and. long-temni viewpoint and monitor and evaluate all resettlemilenit implcilemilation activities in an objective, fair and comprehensive manner to detennine whethier: (1) Resettlement implementation has been carried out in accordance with the principle of the resettlement action plan and the action plan has been strictly followed; (2) The living standards and production facilities of tile affected population have been recovered or improved. 3 Duties of Monitoring anid Assessmentt (1) Comprehensive understanding of project impact in lernis of resettlement, and reasonable anid . feasible determination of monitored samples and evaluation criteria; r - "a _ , _ (2) Comprehensive and accuratle monitorinig or resettlemenit implem.entation progress. -- Divergences from the principle/criteria of the resettlement action plan sihid be monit6red ' - and reasons found. Both sioit-lenil and long-term effects of resettlement are evaluated and Forecasted, and feasible improvement measures anld advice should be provided. (5) Comprehensive evaluation of resettlement results' should be carried out when the implementation of resettlemncit action plan is completed. 4 Monitored Targets 4.1 Implementation Progress 4.1.1 Compenlsation Disbursemenet (I) Progress of compensation disbursemeint to the affected population and enterprises before tile conmnencement of project construction; (2) Monitor and make detailcd records of complretisationi ty3pes and criteria, amount and date of compensation payment and recipient of compcnsation. 4.1.2 Housing (1) The acknowledgement of the afcited populationi witli the reasonableness and faimness of thle selection of new housing location: (2) The new locations should be close to the original locations; ' (3) Compensation for self-built houses should be made according to the constructiou criteria and individual characteristics and approximately equal to the re-construction cost of the houses (without deducting the value of depreciation and utilizablc materials); (4) Monitor and make detailed records of housing requirementis of the affected population, date they move into the new housas and housing relocation etc. - (5) Compensation should be paid to the aflec(ed population on time, including moving subsidy,' subsidy for the 'transition period and awards. etc. -' .~~~~ j~~. 4.1.3 Enterprise Relocation (1) All affected enterprises shotild be compenisated at the re-coistruction cost without deducting 2 Zhumadian-Xinyang Expressway Project, llciia't Povilcc Rcsculcdnct Moiiitorng and Evaluntion Pli,1 depreciation or utilizable niaterials, (2) For the enterprises that need to relocatc, the date or moving and tihe tinme span of transition period should be detemijued atler discussion with themlz; (3) During the period when the eniterprises are not operatinig, tlhe affectcd. employees shiould receive subsidies approximtlely cqual lo ilicir noniial wages: (4) During the period when ihe enlerprises are not operatinig. they should be compensated for their loss due to stop of produclion/operation. 4.1.4 Production Recovery (1) Adjustment to farmland should be made withiii the unit of village, and land compensation and relocation subsidies should be utilized to develop collective economy (village); (2) Development of other production channels/measures and employment opportunities. 4.1.5 - Infrastructure Recovery (1) All necessary infrastructute should at least be recovered to its original level afler relocation: (2) Compensation for infrastructute shotild be einoughi for its re-construction with the same quality. 4.2 Public Participation and Negotiation 4.2.1 Extent of Participation During the implementation process, the participationt system for resettlers and other affected parties should be set up and operating smoothly. Comprehensive social and economilic investigation and analysis is conducted whei monitoring is completed, and reports in written form regarding the living standards after resettIement is submitted to evaluate tile impact or the implemcintation of the resettlement action plan on the affected population. 5 Metihodology 5.1 lnvestigatlonnlntervlew The monitoring and evaluation work is based on thle results of field investigation and infonnation - collection, and information collected is verired, foiorits authentikity.ifw Questionnaires ae used in the investipation press. I1his sample is covered by the monitoring and evaluation work. 5.3 Information Collection and Processing (1) Questioniaires are distributed to tlie affected villages, enterprises and households, and then answered by individuals concerned and filled out by designated personnel; (2) Direct interviews with affected individuals nnd enterprises; (3) Special teams are formed to carry out investigation and find out problems, suchi as the elderly. women, children, affected enterprise, aind olher issucs; (4) Information collected is classified and analyzed according to the following criteria: affected location, affected time period, inipact type, compelnsation level and length of relocation period; (5) The independent monitoring organizationt will keep a database, in which information collected from various sources is stored and updated through timne; (6) Data regarding implementation progress is provided by the implementation organizations, and the monitoring and evaluation organization make verifications by means of sample investigation. 6 Monitoring Report 6.11 Monitoring Period From the time when the Implementation of the resettlenent action plan commences, the monitoring and evaluation organization will submit an extemnal nionitoring rport every tix months,.ai d the report submitting frequency Is reduced to one report each ycar as resettlement inmplementation 5 comes to a close.
