General    1.1 Project Background Yunnan is a Province integrating border, mountainous, diversified ethnic nationalities. In recently year, the Province is experiencing rapid socio-economic growth, economic restructuring and changes of development pattern. Opening up & reform and science & technology advance have become impetus to promote local economic development. On Oct. 28, 2005, the State Council promulgated “A Resolution of the State Council on greatly development of vocational educationâ€? which defined guiding ideology, objective, task and policy interventions for vocational education to reform and develop. Development of vocational education became an important foundation and a strategic keystone in socio-economic development. It was decided to develop vocational education with Chinese characteristics to speed up fostering laborers with high technical skills and competency. Yunnan Province intend to enhance relevance of Yunnan’s TVET to local economic development, enlarge TVET scope, improve quality of TVET and to educate more skilled talents to respond the increasing needs of labor market, especially in the key industrial cluster sector. A series of plans, policies to promote TVET reform and development were made and funds input on TVET were intensified. Even though, there is an urgent need to introduce loans and knowledge from international financial institutes to build and improve its both hardware and software. Through the use of such loan, Yunnan would also explore the new concept, new mechanism and new approach in developing TVET that is adaptive to Yunnan’s conditions. With the approval of the State Council, the application of the People’s Government of Yunnan for financing Yunnan TVET has been included into candidate projects of the World Bank lending program in fiscal year 2012. The World Bank has completed its identification to the proposed Project. In 1    YNTEVT Project to be Financed by WB  YPED  YECSTD  viewing that the Project will include such construction activities as upgrading facilities and equipment, constructing new training centers/school buildings/laboratories, and rehabilitating existing buildings within the campuses of 9 existing schools, according to the World Bank environmental safeguard policy OP 4.01 on such category C project, this Environmental Codes of Practice (ECOP) is prepared on the basis of environmental impact assessment of the 9 participating schools individually prepared to satisfy the domestic procedures.   1.2 Objective of this ECOP As required by national law on environmental impact assessment on physical construction projects, during the project preparation and feasibility study stage, environmental impact assessment for each of the participation school was carried out to identify potential adverse impact and propose mitigation measures. According to the requirement of World Bank environmental safeguard policy OP4.01, Yunnan TVET project is categorized as “Câ€?. Environmental Codes of Practice (ECOP) is prepared to address construction-related impacts, especially the safety of students, disruption to daily school and community activities, and temporary storage/relocation of chemicals used in laboratories. The Objective of preparing this ECOP is to define responsibility of stakeholders in executing ECOP; to guide the planning and implementation of the mitigation measures to be carried out by Contractor during construction, and to guide the project owners, the participation schools (PSs) to implement the mitigation measure to comply with existing environmental standard. It sets out standard practices and procedures for managing the potential negative impacts on local environment and local communities of all civil works to be carried out under the Project. The ECOP will be included as a separate 2    YNTEVT Project to be Financed by WB  YPED  YECSTD  annex in all bidding and contract documents and the environmental supervisors will be assigned by PSs with responsibility to ensure contractors compliance with ECOP and reporting. The Contractor will be made aware of and commit to its obligation on environmental protection and know that cost for implementation of the measures is part of the construction cost. It also set up an environmental supervision mechanism during the project implementation to ensure this ECOP will be followed. 1.3 Applicability Having realized the importance and necessity of Yunnan TVET, it is necessary to realize that the some potential adverse environmental impact may be brought about, although such impact is minimal form Category C Project. Adequate capacity, mitigation measures and ensurance of CEOP implementation mechanism will be necessary to minimize the adverse impact to the satisfactory of national and local governments, and WB safeguard policies requirement. This ECOP will be applicable to all the nine participation schools. This ECOP is prepared on the basis of individual EIA carried out for the nine schools involving civil work project activities to provide guidance to the key parties (including the contractor, environmental supervisor, the project owner, etc.) to take effective actions to mitigate the potential adverse environmental impact.   3    YNTEVT Project to be Financed by WB  YPED  YECSTD  2. August 28, 2004 4    YNTEVT Project to be Financed by WB  YPED  YECSTD  2.2 World Bank Safeguard Policy This ECOP is prepared to satisfy the WB safeguard requirements under OP4.01 (EA) which requires planning, implementation, and monitoring of the mitigation measures during construction. Although the safeguard policies related to other safeguard policies are not triggered, the Bank requires inclusion of “chance findâ€? procedure into the contract to guide actions to be carried out by contractor 3. Institutional Arrangement to Execute ECOP    3.1 Project Implementation Arrangement To ensure the smooth progress of the Project, it is proposed that the participation schools take responsibility to manage their own sub-project activities under unified coordination by Provincial Project Management Office (PPMO), under the leadership and instruction of YDRC, YNDOF, and YPED, a PPMO has been established under Yunnan Provincial Education Department (YPED). The PPMO will be responsible for daily overall management of the Project. The nine participation schools will also establish its local project management office with similar structure as PPMO. The PMOs of PSs will be under the coordination of PPMO, responsible for managing all issues related to the respected school and contact with the county/city government agencies where the school are located and its administration agencies. 3.2 Institutional Framework for Environmental Management Under above-mentioned institutional arrangement, to execute this ECOP, an environmental management organizational structure is proposed as shown 5    YNTEVT Project to be Financed by WB  YPED  YECSTD  in figure 3-2 , which takes PPMO, PO/PS and their technical consultants, ES as internal management agencies, and local EPBs, external monitoring station as external regulatory agencies. General Requirement of ECOP  In the project implementation phase, contractors will play key role in environmental management, pollution control, mitigation measures at the construction sites. To implement ECOP, this chapter sets out the general requirements that are applicable to the main agencies related to construction environmental management. Contractors will be required to implement various environmental protection measures under the coordination of PSs and ESs. 4.1 Environmental Protection Measures to be incorporated into Design Drawings and Bidding Document In the project implementation phase, civil works will be procured and implemented in accordance with the WB procurement guideline. The PSs under the coordination and guidance of PPMO, should make sure that tendering agencies and DIs have incorporated environmental mitigation measures proposed by EIAs into the respective bidding document and design drawings. In the bidding document, the bidders will be required to respond to following environmental management requirement that would be included into The civil work contracts: Each Contractor should designate 1~2 full-time staff as EMC(s) to be responsible for the implementation of environmental protection/mitigation measures to ensure that its or its sub-contractor’s (if any) construction activities are compliance with ECOP’s requirements and all necessary environmental protection/mitigation measures are well taken. During construction, contractors must communicate and consult with local people in project area, and keep them informed of the specific 10    YNTEVT Project to be Financed by WB  YPED  YECSTD  activities and during of construction. The contractor should also set up hotline to receive public’s inquiring, comments and suggestion. Contractors should actively cooperate with environmental monitoring team and ESs to be entrusted by PSs Before the construction commencement order to be issued by ES, contractor should prepare its “site EMPâ€? and incorporate it into its construction scheme. If construction activities are scheduled during school term period, contractor should consult with school administration department to define appropriate construction time to avoid impact on during school time Contractor should strictly follow regulations on safety and honorable construction. Contractors and construction supervision engineer are required to be trained on environmental protection and management before construction If environmental accident occurs due to nonconformity with mitigation measures, ES and EMC should inform PS within 24 hours. The PS, local government, or EBP will immediately order contractor to take remediation action. The contractor should keep record of such remediation and report to PS. The Project owner, the PS will retain a proportion (around 3%) of contract value as deposit for the fulfillment of environmental protection assignment. 4.2 Environmental Readiness before Construction After the bid are awarded and before construction commencement, each PS should, under the coordination and guidance of PPMO provide copies of 11    YNTEVT Project to be Financed by WB  YPED  YECSTD  results of each EIA, including EIA reports and their approval document to contractors. Contractors should conduct field environmental investigation to verify EIA results and indentify environmental limit factors and develop the “site EMP as required in the contract. Information to be included into the site EMP is shown in annex 2 of this ECOP. In addition if new environmental sensitive issues are identified, corresponding mitigation measures should also be proposed and included in contractors site EMP. No construction should be commenced until the approval of ES on site EMP. 4.3 Environmental Management for Construction Site During civil works construction, environmental supervisors to be entrusted by each PS will take environmental management supervision responsibility throughout the entire construction period to oversee contractors’ action on implementation of ECOP according to contract requirement on environmental management and contractors site EMP approved by ES. In the mean time, contractors’ environmental behaviors will be subject to external supervision from local EPBs, faculties & students in campus and neighboring communicates. 4.3.1  Environmental  Management  Supervision  throughout  the  construction.    Environmental supervisors will undertake following tasks: To supervise the contractor’s actives related to land occupation, resettlement to ensure the compliance with environmental protection requirement and objectives; be responsible for coordination with land management agency, resettlement agency, and environmental protection agency. 12    YNTEVT Project to be Financed by WB  YPED  YECSTD  To supervise and guide the day-to-day environmental behaviors of contractor to ensure the compliance with this ECOP requirement. To review and approve contractor’s site EMP. To develop ES’s environmental monitoring plan and implement such plan. To keep monitoring and records of measures taken by contractor to avoid and mitigate potential negative impact on environment. To supervise contractor’s construction activities to ensure the compliance with this ECOP. To review and analyze environmental monitoring report prepared by contractor, conduct ES’s independent site environmental monitoring if necessary. To investigate the cases of adverse impact events or complaints from school teachers & students and local communities due to contractor’s non-compliance with relevant environmental regulation and ECOP. Communicate with local EBP about its investigation on the cases to seek appropriate solution. In the mean time, issue notice sheet for correction actions to be taken by contractors(shown in Annex 3 of this ECOP). To stop contractors from environmental offensive activities. To provide on-the-job trainings to contractors on environmental protection to avoid and mitigate potential negative impact on environment and on local communities. To conduct periodic monitoring on contractors’ implementation of this ECOP and keep frequent record of environmental inspection checklist (shown in Annex 1 of this ECOP) and incorporate such checklist record into its regular “Environmental Supervision Reportâ€?. 13    YNTEVT Project to be Financed by WB  YPED  YECSTD  4.3.2    EPB’s Regulatory and Publics’ Argumentation      During construction, contractors should cooperate closely with local relevant agencies to ensure the compliance with government policies and regulations. Contractors should disclose sufficient information to people to be affected, especially those information on construction activities potentially affecting public interests and securities, affecting sensitive zones, temporary stockpile, and so on. Local EBPs may selectively examine environmental behaviors of contractors. Local EPBs may receive and review the site “Environmental Supervision Reportâ€? from PSs or ESs and administrate any environmental issue raised from “Environmental Supervision Reportâ€? and take responsive measures if abnormal environmental accident occurs. . All the civil works will be constructed within designated school campuses, faculties & students and communities around the campuses might be the first ones to test environmental adverse impact, if any. Contractors should place posters, including estimated duration of construction impact, easily visible by faculties & students and communities around the campuses. Contractors should offer transparent approaches for public to participate, such as hot lines, website, forum etc. to receive public consultation, suggestions and complaints. The hotline conversations should be recorded. Prompt reaction to public arguments should be made by contractors under supervision of ESs. 14    YNTEVT Project to be Financed by WB  YPED  YECSTD    5. Mitigation  Measures  and  Management  during  Construction.    As the key component of this ECOP, this chapter provide guidance to contractors to meet the very essential requirements on taking mitigation measures to protect environment. The measures include construction site clearance, environmental-friendly management of school campuses, health safeguard, prevention and control over air and water pollution and soil erosion, solid waste management, disruption minimization, limitation on or prohibition to activities to protection environment, actions to be taken to protect cultural relics chance found, corrections to be taken by contractors on non-compliance and to response to public complaints,as well as environmental monitoring and management measures to ensure environmental quality. 5.1 Management on Construction Sites This section summarizes requirements on site environmental management, including site layout, working hours, stockpiling of construction materials and equipment, contractors vehicle management. Contractors should comply with Environmental management regulations promulgated by local EBPs and inspected frequently by environmental supervisors. Essential Measures to mitigate potential environmental negative impact are as follows: (1)Construction Working Hours Construction working hours are to be 8:00~20:00. At the mid day time from 12:00~14:00 for lunch break, construction should be suspended. Time for vehicles drive in and out should comply with local government’s requirement. Construction activity during nighttime would be restricted. If 15    YNTEVT Project to be Financed by WB  YPED  YECSTD  nighttime construction is really unavoidable, permit should be obtained and announcement should be made to school and peoples to be affected in advance. Mitigation measures should be adopted to minimize impact on residents. (2) Layout of Construction Camp Site Construction workers would be better to rent school residence as camp site. There would be only need to install contractor’s office, building materials storehouse, processing workshop which are far away from teaching zones and residential zones. Construction workers should use school lavatories rather than install their own ones. (3) Borrow Pits Legal borrow pits designated by local EPBs should be used during construction, rather than establish the new one. (4) Prevention of Accidental Risks Contractors should develop emergency preparedness in advance; designate its special staff responsible to response to the emergency. Once the accident occurs, implement its emergency preparedness actions or seek additional assistance immediately. (5) People’s Safety and Health The construction site should be fenced with traffic signs and guardrails to protect school faculties and students. Contractors should designate its staff to lead the traffic during on-school and off-school hours. Construction workers will be trained on safety and forced to be equipped with personnel safeguards. If materials containing asbestos or toxicant are to be tear down, they should be handled by workers specially well trained. All construction activities should be suspended upon heavy storm or emergent cases. (6) The laboratory reconstruction for Yunnan Forestry Technological 16    YNTEVT Project to be Financed by WB  YPED  YECSTD  College involves relocation of experimental chemicals and toxicants. Yunnan Qujing Agricultural School involves the storage of toxicants. Risks are foreseeable from such storage and relocation. It is required that during laboratory relocation, the college, the contractor, the environmental supervisor should designate their respective staff responsible for the storage and relocation. All toxicants must be registered one by one and be relocated to the appropriate places satisfactory to safety needs and be stored in a satisfactory manner. During laboratory relocation, all chemicals toxicants, together with their packages labeled significantly. Relocation and storage of toxicants must follow strictly the requirements stipulated in the national “Safety Management Regulations on Hazard Chemicalsâ€? and be handled by qualified agencies. Spill kits / sand / saw dust used for absorbing chemical spillage should be prepared and readily accessible in the storage place or during relocation. 5.2 Environmental Quality Management In order to minimize construction impact on environmental quality, following mitigation measures should be taken: (1) Ambient Air The construction sites should be fenced to reduce impact on ambient air quality. Dedusting measures, such as watering, etc. should be applied at earthwork site. Vehicles cleansing facilities should be installed at entrance and exits of the construction sites. Vehicles should be cleaned of dirt before leaving the construction sites. Hauling vehicles that are easily generating dust should be covered with tents. Building materials and shuttering boxes should be stored on flat and stable ground. Cement and dusty materials that easily generate fly dust should be placed in obturator or covered with tents. Commercial concrete are encouraged. The construction site should be 17    YNTEVT Project to be Financed by WB  YPED  YECSTD  regularly cleaned and watered. Fuel-powered machines and vehicles can only be used at normal operation conditions to ensure their exhaust gas comply with emission standards. Wastes incinerations are prohibited. (2) Water Environment During construction, contractors are requested to design its wastewater treatment and discharging approaches to comply with standard. Any illegal discharging of untreated wastewater into environment or inundate municipal establishments would be prohibited. Contractor workers are to use existing school refectories and lavatories. Temporary sedimentation tanks are to be installed at construction sites to treat slurry, wastewater from concrete maintenance, other construction wastewater, stormwater mixed with silt . After slurry sedimentation, water from sedimentation tanks can be used for site watering for dedusting. The rest of wastewaters can be discharged into the existing school sewer system. Quite equipment should be used as much as possible. Sound and vibration reduction or insulation facilities should be installed if necessary. Construction equipment should be well-maintained to keep in good operation conditions, so as to minimize mechanical noise impact. Contractors should follow its site monitoring program to monitor noise levels at the construction site and the point of environmental concerns from time to time and adjust its construction schedule or take mitigation measures based on monitoring results. (4) Solid Waste Management Wastes should be properly piled up, sorted and recycled as much as possible. Non-reusable waste should be disposed of at permitted disposal sites. (5) Eco-Environment Protection and Erosion Control At the pre-conditions of construction safeguard quality and quantity, construction occupation duration should be shortened as much as possible. Earthwork duration should be controlled. Excavation and backfilling slope 19    YNTEVT Project to be Financed by WB  YPED  YECSTD  should be kept stable to reduce interruption on exterior. More attention should be paid on rational construction site management during raining season. Once the construction is completed, re-vegetation or re-cultivation should be made promptly. Trees that are not necessarily felled in the construction sites should be protected. Once temporary land occupation for construction is completed, the land should be cleared, leveled and recovered with original vegetation. Intercepting ditches should be prepared in the construction site to channelize surface runoff outside so to reduce site erosion by runoff. (6) Cultural Relics Conservation Surveys during project preparation suggested that there are no cultural heritage sites in the construction sites. However, if there is any chance found cultural relics or articles suspected to be cultural relics, the site should be promptly protected and reported to local agencies responsible for cultural relic administration. Construction activities cannot be resumed until the sites are handled by cultural relic administration agencies. 5.3 Environmental Monitoring Program During construction, with good environmental supervision, contractors will conduct their internal environmental monitoring as defined in their site EMP.
