Introduction 1.1 The proposed Harbin-Jiamusi Railway is located within the mid-east region of Heilongjiang Province and situated in Harbin City and Jiamusi City at the south bank of the Songhua River. The line starts at Harbin Station, passes by Binxian County, Fangzheng County and Yilan County, and ends at Jiamusi Station in Jiamusi City. The line is 343.344km long in total, including 179.435km main track subgrade, 154.064km bridge, and 9.845km tunnel, with bridge-tunnel ratio. 1.2 Harbin-Jiamusi Railway passes by 2 prefectural-level cities and their 7 districts and 3 counties, namely Daowai District, Acheng District, Xiangfang District, Binxian County, Fangzheng County and Yilan County of Harbin City and suburb of Jiamusi City. 1.3 Although route, station location and construction campsite have been designed according to current design phase, partial sections and construction position of the railway may be substantially changed in next phase. Thus the resettlement policy framework should cover all possible changes according to OP/BP4.12 of the World Bank. 1.4 Resettlement framework mainly refers to the resettlement policy framework that causes uncertain and unexpected impacts during project implementation. This framework applies to direct permanent occupancy scope and possible scope, like temporarily occupied land, construction and material campsite and constriction road. 2. Measures to Avoid and/or Alleviate Resettlement Impact 2.1 Project Planning and Design Phase During project planning and design, the design organization and the owner have adopted the following measures to reduce impact on social economy of local residents: World Bank Loan Project 2 Newly-built Harbin-Jiamusi Railway Appendix of Resettlement Action Plan Report of Newly-built Harbin-Jiamusi Railway • During scheme optimization and comparison & selection, try to consider the impact of engineering construction on local social economy and take it as a key factor for scheme optimization and comparison & selection; • To reduce land acquisition and resettlement, the railway section within the suburb areas is routed along the existing railway to decrease land acquisition and relocation and environmental impact; • Optimize construction design, shorten construction period and reasonably arrange housing demolition and construction periods. 2.2 Implementation Period In case that land acquisition and relocation are unavoidable, following measures should be adopted to alleviate impact of land acquisition and relocation on local residents: • Reinforce collection of fundamental data, analyze current situation of social economy and future development, formulate feasible Resettlement Action Plan based on local situations and guarantee that living standard of local residents will not be degraded; • Strengthen internal and external monitoring, establish efficient and smooth feedback mechanism and channel, and try to shorten information processing period to solve all problems in implementation in time; • Require construction organization to use effective measures during construction to reduce impact of engineering construction on local production. 3. Legal Framework The People's Republic of China has formulated a complete legal framework and policy framework according to standards on land acquisition, house demolition, resettlement and compensation. Since issuing in 1986, the Law on Land Management of the People's Republic of China has been modified for 3 times according to change in China's national conditions. On August 28, 2004, the 11th meeting of the 10th NPC Standing Committee made a latest modification to this law. Local governments at all levels have respectively issued and implemented relevant laws and policies that conform to local conditions within the national law and policy framework so as to manage and guide local land acquisition, house demolition, resettlement and World Bank Loan Project 3 Newly-built Harbin-Jiamusi Railway Appendix of Resettlement Action Plan Report of Newly-built Harbin-Jiamusi Railway compensation. Heilongjiang Province along the Harbin-Jiamusi Railway has established relevant local laws and policies according to national laws and policies to manage and guide local works. Relevant provisions of the provincial governments have been implemented by all cities, county-level cities, districts and counties. Land acquisition, demolition and resettlement of the project should follow relevant provisions and strictly abide by implementation measures of province and cities, social safety guarantee policies of World Bank and design document of the project (for some related policies, please refer to Appendix 9). Mainly including:   Law on Land Management of the People's Republic of China (modified and effective in October 2004);   Implementation Regulations for Law on Land Management of the People's investigation findings of the project. 3.1 Involuntary Resettlement Policy Target of World Bank • Involuntary resettlement policies of World Bank have been illuminated in OP4.12. The overall target is stated as below: • To discuss all feasible project design schemes to avoid or reduce involuntary resettlement; • If resettlement is unavoidable, resettlement action should be designed and implemented as a sustainable development plan. Sufficient capital should be provided to make migrants enjoy benefits of the project. Do negotiate with migrants to give them opportunities to participate in planning and implementation of resettlement action plan; • Help migrants to improve their production and living standard and at least enable them to recover to higher level before relocation or project commencement. World Bank Loan Project 7 Newly-built Harbin-Jiamusi Railway Appendix of Resettlement Action Plan Report of Newly-built Harbin-Jiamusi Railway 3.2 Necessary Measures to Reach Target • The resettlement action plan or resettlement policy framework should adopt relevant measures to ensure that migrants are informed of right of choice and other rights in resettlement problems; • Know plans that are feasible in technology and economy, participate in negotiation and enjoy right of choice; • Gain fast and effective compensation according to all relocation cost to offset direct property loss caused by the project. • If relocation is impacted, the resettlement plan or resettlement policy framework should make relevant measures to ensure that migrants will be helped during relocation (such as relocation subsidy); • Gain residence or house site, or agricultural production site as required. Production potential, location advantages and other comprehensive factors of agricultural production sites should be at least equal to those of the original ones. • To realize the target, resettlement plan or resettlement policy framework should also make corresponding measures as necessary to guarantee that migrants will get help during the transition period after relocation which is calculated based on the time necessary to recover living and production. • Apart from gaining valid compensation according to replacement cost, get assistance in soil preparation, credit, training or employment. • Pay special attention to demand of vulnerable groups in migrants, especially those who live below the low-income level and without land, the old, women, children and minorities, or those who may not be protected by the national land compensation law. • For people who live on land, the strategies of resettlement on land should be given priority to. These strategies include resettling them on pubic land or private land that is purchased specially for migrants. No matter when land replacement is provided, the production potential, location advantages and other comprehensive factors of the provided land should be at least equal to those before land acquisition. If land replacement is not taken as a priority by migrants, provided land causes adverse influence on the sustainable development of park or protection area, or sufficient land cannot be obtained based on reasonable price, off-land resettlement plans with focus on opportunities of employment or living on migrants' themselves should also be World Bank Loan Project 8 Newly-built Harbin-Jiamusi Railway Appendix of Resettlement Action Plan Report of Newly-built Harbin-Jiamusi Railway provided apart from cash compensation for land and other property losses. If land is insufficient, make description in the document according to the requirement of World Bank. • Conditions that may apply to cash compensation for property loss: (a) migrants live on land. But the land acquired by the project is only a small part of damaged property. They can live on the remaining part; (b) migrants have active land, house and labor market. They can utilize these markets, and have sufficient land and house; or (c) migrants do not live on land. Cash compensation can be sufficient enough to land and other property level for full-amount replacement cost compensation loss of local market. • Provide in-time relevant information to migrants, their communities as well as resettlement communities, negotiate with them on resettlement plans, offer them with opportunities to participate in planning, implementation and monitoring of resettlement, and establish a corresponding and convenient appealing mechanism for those groups. • Provide necessary infrastructures and public service at new relocation sites or communities to improve, recover or keep original facilities utilization procedures and service level of migrants and resettlement communities. Offer replaceable or similar resources to make up available community loss (such as fishing area, pasturing area, fuel or forage). • Establish a community organization model that corresponds to new environment according to choice of migrants. Try to preserve current social and cultural systems of migrants and resettlement communities and respect the willingness of migrants to move to existing communities and groups. 4. Principle of Resettlement and Compensation 4.1 General Principles • Try to avoid/reduce involuntary migrants and land acquisition; • If resettlement and land acquisition are unavoidable, establish Resettlement Action Plan according to compensation and living recovery level for affected people; • Provide sufficient capital to implement Resettlement Action Plan; • Establish and implement Resettlement Action Plan after negotiating with local World Bank Loan Project 9 Newly-built Harbin-Jiamusi Railway Appendix of Resettlement Action Plan Report of Newly-built Harbin-Jiamusi Railway governments and affected people on resettlement and compensation; • Pay compensation according to replacement cost (excluding depreciation cost); • Pay compensation before relocation and land acquisition; • Help affected people in resettlement and living recovery; • Try to recover or improve living standard of affected people after resettlement; • Include all relevant expenses about land acquisition and architecture demolition into project expense budget; • Before relevant civil construction, modify Resettlement Action Plan of all counties each year and submit to province/city for review and to World Bank for approval. 4.2 Specific Principles 4.2.1 Compensation for Affected Rural Collectives Land belongs to the People's Republic of China and collective. In rural area, land belongs to village collective. Farmers only have the right to use farmland. Village collectives distribute land according to rural household population and agricultural population and implement "land contract responsibility system". In accordance with Law on Land Management of the People's Republic of China, there should be no compensation for farmers or rural households in case of land acquisition for national construction (like Harbin-Jiamusi Railway). The compensation should be paid to rural collectives for construction of agricultural production infrastructures and social infrastructures. However, the No. 28 file of the State Council stipulates that provincial governments should formulate a system of compensation for acquisition of rural collective land. This system conforms to the principle that compensation fee is directly distributed to rural households. The State Land and Resources Bureau stipulates in Guidance and Opinion of Completing Land Acquisition Compensation and Resettlement System (GTZF(2004)No. 238) that principle of land acquisition compensation is that farmers with land acquired get compensation. Compensation should be reasonably distributed to rural collectives. The distribution method should conform to provincial regulations. Besides, it stipulates: if compensation of 30 times of annual average output value cannot maintain living standard of affected farmers before land acquisition, the provincial government should add compensation fee correspondingly. 4.2.2 Compensation for Rural Households Affected by Land Acquisition World Bank Loan Project 10 Newly-built Harbin-Jiamusi Railway Appendix of Resettlement Action Plan Report of Newly-built Harbin-Jiamusi Railway Rural collectives distribute farmland to farmers according to rural household population and agricultural population. Compensation for main agricultural products (including crops and by-products on farmland) is directly distributed to farmers. 4.2.3 Compensation for Rural Households Affected by House Demolition Demolished houses are personal properties of farmers. Therefore compensation for house demolition is directly paid to affected agricultural households. Farmers will get new house sites from village collective for free for construction of new houses. Besides, relevant house movement fee should be paid, including income loss. 4.2.4 Compensation for City Residents Affected by House Demolition City households subject to house demolition will directly obtain house demolition compensation from the demolition organization. The amount of compensation is equal to expenses needed to construct a house of the same area and quality. Besides, relevant house movement fee should be paid. 4.2.5 Compensation for Affected Commercial Buildings/Stores Houses for commercial activities belong to personal property or collectives. Family-run stores are included into family property and will be included in resettlement investigation list. Compensation for affected population or collectives will not only include compensation for architectures but also that for commercial operation loss during relocation period and the period when new commercial houses are being constructed. Meanwhile, relevant house movement fee will be paid, including income loss. 4.2.6 Compensation for Affected Factories and Enterprises Compensation for factories and enterprises will be paid to representatives of affected enterprises who will decide if to reconstruct the enterprises. Compensation for commercial architectures not only includes that for buildings, but also that for loss during relocation and the period when new enterprises or factories are being reconstructed. Meanwhile necessary house movement fee will also be paid. 4.2.7 Compensation for Affected Organizations and Institutions Buildings of affected organizations and institutions belong to relevant government departments. They will be reconstructed by relevant departments. 4.2.8 Compensation for Affected Schools Schools, e.g. primary schools and middle schools, belong to public service facilities. After demolition, they will be reconstructed by government department after receiving demolition compensation (not involved in this project). World Bank Loan Project 11 Newly-built Harbin-Jiamusi Railway Appendix of Resettlement Action Plan Report of Newly-built Harbin-Jiamusi Railway 4.2.9 Compensation for Affected Infrastructure It refers to affected state-owned power stations and communication facilities as well as roads that belong to state, towns and collectives. Most infrastructures will be reconstructed by project owner. A portion will be reconstructed by the infrastructure owner upon reception of compensation. 4.2.10 Compensation for Temporary Land For acquired temporary land, compensation is paid for only basic agricultural products and land output loss during the period of temporary land use. After temporary use period expires, the Ministry of Railways will recover original cultivation conditions of the temporary land. Compensation for relevant land output like trees, fruit trees and agricultural by-products will be paid in cash to individuals or collectives. 5. Organization Frame and Arrangement A resettlement organization network is established to complete land acquisition, demolition and resettlement of the project. The network covers the Ministry of Railways, all construction contractors, auxiliary institutions and local governments. These organizations include land acquisition and relocation groups of construction contractors, land acquisition and relocation groups of development and reform committee at all levels/railway support office and land and resources administrations of local governments. The network may be changed after Harbin-Jiamusi Railway Corporation is established. By then local governments will arrange specific resettlement. During project implementation, provincial government will set up a provincial leader office. The leadership organ will be led by government leaders and members including department principals. Local governments will set up railway support offices or similar organs to coordinate and support railway construction. 6. Procedures for Establishment and Approval of Resettlement Action Plan The Ministry of Railways is responsible for establishment of Resettlement Action Plan. World Bank Loan Project 12 Newly-built Harbin-Jiamusi Railway Appendix of Resettlement Action Plan Report of Newly-built Harbin-Jiamusi Railway Basic planning procedures involve: • Social economic investigation for affected areas; • Affected population census, acquired land census and investigation in other affected assets (type, quantity and effect degree of affected population, family, village and acquired land) • Establishing resettlement measures and compensation standard according to relevant policies, laws and regulations after negotiating with affected people; • Establishment of action plan and implementation plan. The plans include: • Description of relevant civil engineering project and land acquisition position and scope; • Purpose for land acquisition; • Relevant policies and laws; • Basic data (basic information of affected people); • Compensation rate; • Organizations, responsibilities and personnel allocation; • Community participation; • Impact on community and living; • Land acquisition plan and specific living recovery plan; • Cost estimation and deadline; • Land acquisition supervision, management and evaluation Approval on resettlement plan: complete and submit the resettlement plan to the bank for review and approval within the first 3 months according to this framework. Land acquisition and building demolition can be started upon approval of the bank. 7. Supervision and Monitoring 7.1 Internal Monitoring Internal monitoring aims to guarantee that resettlement organization at all levels can keep sound supervision functions during the implementation of Resettlement Action Plan of the project and ensure that legal interests of affected people will not be damaged and construction will be carried out smoothly. Audit department of the World Bank Loan Project 13 Newly-built Harbin-Jiamusi Railway Appendix of Resettlement Action Plan Report of Newly-built Harbin-Jiamusi Railway provincial department will supervise the independent audit function of relevant organs in area under administration in accordance with relevant laws and regulations. Meanwhile, to ensure that all resettlement organs follow the principles and deadline of Resettlement Action Plan, all supervision organizations should monitor subordinate organs. Internal monitoring for land acquisition and resettlement work is in the charge of Harbin-Jiamusi Railway Engineering Construction Headquarters and is implemented by engineering construction leadership group offices (headquarters) of all counties (cities and districts) and all villages. To effectively exert internal monitoring, resettlement organs at all levels have special personnel to undertake this work. They will participate in compilation of Resettlement Action Plan and control and monitor its implementation and progress. 7.2 External Monitoring External monitoring mainly refers to monitoring and evaluating land acquisition, demolition and resettlement at regular intervals from the outside of the resettlement organs with an aim to evaluate if the resettlement target is reached. The external monitoring work will provide assessment, opinions and suggestions for the whole process of resettlement and the living and production recovery of migrants, offer engineering management department with a pre-warning system and provide migrants with opinion feedback channels. The external monitoring organ will act as a consultant for land acquisition, demolition and resettlement coordination group of the Ministry of Railways and Harbin-Jiamusi Railway Corporation. It will track, monitor and evaluate the implementation activities of resettlement plan and put forward decision-making opinions and references. Recently, the Foreign Capital Center of the Ministry of Railways has been entrusted as the external coordinating entity for the project. It will provide technical assistance to the Ministry of Railways or Harbin-Jiamusi Railway Corporation and conduct migrant investigation and also investigation in living standard of affected people, so as to implement all work about basic monitoring. 8. Complaint Procedures During actual implementation of land acquisition and resettlement, affected people can lodge a complaint via the following five-level organizations in order to solve World Bank Loan Project 14 Newly-built Harbin-Jiamusi Railway Appendix of Resettlement Action Plan Report of Newly-built Harbin-Jiamusi Railway problems with land acquisition, house demolition and compensation & resettlement. For oral complaint, relevant complaint receiving organization should make a written record. The county land resources administration is responsible for treatment within 15 days. If complainant is not satisfied with the treatment result, he can lodge a complaint to city railway support office and land resources administration within 1 month after receiving the reply from local land resources administration. If he is still not dissatisfied with the result, he can lodge a complaint to city railway support office and land resources administration within 1 month after receiving the reply from resettlement bureau. If the complainant is not content with the treatment result of city railway support office and land resources administration, he can lodge a complaint to the special organization, namely provincial land resources administration subordinate to the provincial government, within 1 month after receiving reply from the resettlement bureau, but he should do that within 3 months after the first complaint. The provincial land resources administration bureau will reply to affected people within 1 month after recording this complaint. If complainant or complaint organization is still not satisfied with the treatment of the provincial land resources administration, he or it can institute an appeal to people's court within 15 days after receiving the reply. The complainant can file a complaint to a higher department as necessary. A complaint can involve: affected people or organization can complain about land acquisition and resettlement, including compensation fee. Specific complaint procedures and documents & information will be distributed to affected people, villages and groups in form of Information Manual for Land Acquisition and Resettlement. These materials and information will be posted up on visible spaces in original living areas of those affected people. Apart from formal complaint remedy procedure, the Resettlement Action Plan can be usually communicated with project office, migrant office, contractor representatives and personnel of monitoring organization in form of public meetings, hearings and on-site visit to affected villages. The Resettlement Action Plan will be informed of to village cadres to ensure satisfying implementation of compensation agreement. If the consultant has formulated the plan, the Resettlement Action Plan will discuss problems including implementation of compensation agreement. To this end, as per Rules on State-Owned Land Based House Requisition and Compensation and People's Government of Harbin's Regulations on Implementation of Rules on State-Owned Land Based House Requisition and Compensation, and based on our general deployment and actual conditions, this regulation established hereby. I. Policy on State-Owned Land Based House Requisition, Compensation Standard and Rewarding Measures (I) Residential Building Requisition, Compensation and Resettlement Standards The affected households with legal estate ownership certificate may select monetary compensation or transfer of property ownership. 1. For monetary compensation, a competent estate appraisal agency World Bank Loan Project 63 Newly-built Harbin-Jiamusi Railway Appendix of Resettlement Action Plan Report of Newly-built Harbin-Jiamusi Railway valuates the house and calculate compensation based on the valuated price. As for requisitioned house with indoor decoration, the compensation shall be decided based on negotiation, or, if such negotiation fails, determined by an authorized appraisal agency based on related standard. 2. For transfer of estate ownership, the most applicable preferential resettlement rule shall be applied on a "one-for-one" building area basis. For the difference between area of allocated house as per preferential rule and that of the original one, the household may pay the house price based on general building cost. (1) The most applicable preferential resettlement rule shall be applied to the affected households.The allocated houses as per preferential rule include: houses with building area of 50, 60, 70, 80, 90, 100, 110 and up to 120 sqm. Additionally, a security house with building area of 40 sqm is also available. (2) For the building area by which the allocated house exceeds the original one in transfer of estate ownership, the household may pay the house price based on general building cost, with ownership of economically affordable housing granted. In case the household requests for additonal building area beyond the allocated houses as per preferential rule, the price for the additional portion shall be paid based on price of commercial residential building, with ownership of commercial residential building granted. Alternatively, the household may have the actual house area less than that of allocated houses as per preferential rule, and for the deficiency, monetary compensation will be paid based on the valuated price of the houses to be requisitioned. (3) Any households whose building area per capita is lower than the local standard and total building area is equal or less than 40 sqm and which cannot afford the price of 50-sqm house allocated as per preferential rule may be provided with 40-sqm security house and pay the house price baded on general building cost, or pay for the exceeding portion at a price World Bank Loan Project 64 Newly-built Harbin-Jiamusi Railway Appendix of Resettlement Action Plan Report of Newly-built Harbin-Jiamusi Railway equivalent to the basic rental, and pay off later when solvent and have ownership changed. (4) The 18-floor residential building for resettlement for this project is located in Songjiang Motor Plant Community, with coefficient of building occupation of 1.45. As per related rules, the executed building cost per sqm is 1,450 yuan, and general building cost per sqm is 2,610 yuan. Unit price of the commodity house for resettlement with building area up to 90 sqm is 4,800 yuan per sqm, while that above 90 sqm is 6,500 yuan per sqm. (5) For transfer of estate ownership, floor-related price difference is exempt for the original house and the house allocated as per preferential rule. For purchase of commodity house, the floor-related price difference shall be paid at a rate of 20 yuan per sqm for each floor up from the 7th floor (included). Floor above the 18th floor (included) applies the price difference for the18th floor, and no additional price is paid for the top floor. 3.Related Compensation and Privilege (1) For monetary compensation, the compensation will be offered in one payment at a rate of 15 yuan per sqm. For transfer of estate ownership, the compensation will be offered in two payments at the same rate as above. (2) Interim resettlement compensation for residential building is 20 yuan per sqm based on building area of the original house. For monetary compensation, Interim resettlement compensation for six month will be offered in one payment. For transfer of estate ownership, during the interim period, the interim compensation will be distributed once every six months for 24 months, and after 24 months, offered at a rate of 40 yuan per sqm of the original building area. Any interim compensation less than 500 yuan per month will be paid in amount of 500 yuan. (3) Compensations for communication, cable TV and broadband Internet access will be offered as per the actual transfer fee. (4) Compensation for gas installation will be 2,500 yuan for each household (invoice required as evidence). World Bank Loan Project 65 Newly-built Harbin-Jiamusi Railway Appendix of Resettlement Action Plan Report of Newly-built Harbin-Jiamusi Railway (5) For any affected house owners or leasees who hold Certificate of Subsistence Allowances for the Urban Poor will be offered allowance of 20,000 yuan. For any certified disabled, an additional allowance of 10,000 yuan will be offered. (6) Any house owners whose houses are to be requisitioned will be legally granted qualification for low-rent or affordable house; for transfer of estate ownership, they will be provided with appliable house allocated as per preferential rules with the area of affordable house around 60 sqm; for deficiency in original building area, house price may be paid based on general building cost. (II) Requisition Compensation for Non-Residential Buildings 1. For monetary compensation, a competent estate appraisal agency will valuate the building to be requisitioned for compensation. 2. In case of monetary compensation, resettlement compensation for non-residential buildings will be monthly paid at a rate of 35 yuan per sqm of original building area for six months. 3. Compensations for communication, cable TV and broadband Internet access and removal of equipment/facilities will be offered as per related national and local laws and regulations as well as the specific transport/removal/installation price. Residual value of any facilities which cannot be recovered will be valuated based on the replacement price and depreciation rate. 4. For any business which has obtained business license, had tax registration handled prior to issuance of the announcement, can provide tax payment evidence issued by the authorities and has to close down due to the requisition, six months' compensation will be offered in one payment based on certified number of staff and staff's monthly average salary. 5. For transfer of estate ownership, the difference price shall be settled down based on the monetary compensation and location, use, building area and depreciation rate of the building subject to transfer of estate ownership. World Bank Loan Project 66 Newly-built Harbin-Jiamusi Railway Appendix of Resettlement Action Plan Report of Newly-built Harbin-Jiamusi Railway In case that transfer of estate ownership can be met as per the approved construction work plan and design, the affected building owner may select transfer of estate ownership within the resettlement community. (III) Requisition Compensation for Residential Building Used for Business Purpose 1. Identification of any residential building used for business purpose shall be subject to business license, tax registration certificate and related tax payment records, as well as estate ownership certificate and identity of estate location as specified in the foregoing. 2. For transfer of house ownership, compared to the standard for it as stated above, additional building area of 10 sqm may be offered and the exceeding building area will be paid based on the general building cost, or subject to the standard for transfer of residential building ownership and the price difference be settled down as valuated. 3. For monetary compensation, resettlement compensation will be offered in one payment at a rate of 15 yuan per sqm. For transfer of estate ownership, the compensation will be offered in two payments in the same rate as above. 4. Interim resettlement compensation for any residential building used for business purpose will be offered in one payment once every six months at a rate of 35 yuan per sqm of the original building area for up to 24 months, and after 24 months, offered at a rate of 70 yuan per sqm of the original building area. Any interim compensation less than 500 yuan per month will be paid in amount of 500 yuan. (IV) Reward for Removal Reward for removal is available from December 17, 2011 to January 17, 2012. For household with beneficial area less than 10 sqm (4- or more floor building), additional building area of 10 sqm provided at a preferential price of 3,500 yuan per sqm, as requested voluntarily by the owner; 4. For any households who remove within the aforesaid term (4- or more floor building), additional building area of 10 sqm provided at a general building cost of 2,610 yuan per sqm. (V) Handling of Buildings without Ownership Certificate For any buildings in the area which has not been registered, or which have been certified as legal, or any interim buildings within the approved term, proper compensation will be offered as per related rules. For building area within 50 sqm, the compensation is 800 yuan per sqm; for building area above 50 sqm, the compensation is 300 yuan per sqm. No compensation is offered for any buildings that are identified as illegal buildings or are bdyond the approved term. (VI) Open House Selection and Decision For transfer of estate ownership, the household will select the house to be allocated at his own will based on the open selection sequence number, which is average of the removal sequence number and payment sequence number (in case that no payment is required, the sequence number is "0"). For same selection sequence number, the ownership transfer number will prevail. IV. Households' Comments and Modification Based on the households' 14 comments made during public notice from April 30, 2011 to May 30, 2011, and related agencies' negotiation and study, the Statement on Collected Comments and Modification will be applied. V. World Bank Loan Project 69 Newly-built Harbin-Jiamusi Railway Appendix of Resettlement Action Plan Report of Newly-built Harbin-Jiamusi Railway Regulation on the Expropriation of Buildings on State-owned Land and Compensation Order of the State Council (No.590) The Regulation on the Expropriation of Buildings on State-owned Land and Compensation, as adopted at the 141st executive meeting of the State Council on January 19, 2011, is hereby issued and shall come into force on the date of issuance. Premier Wen Jiabao January 21, 2011 Chapter I General Provisions Article 1 This Regulation is formulated for purposes of regulating the expropriation of buildings on state-owned land and corresponding compensation, maintaining public interests and protecting the legitimate rights and interests of owners of the buildings to be expropriated. Article 2 Where a building of any entity or individual on state-owned land is expropriated for public interest, the owner of the expropriated building (hereinafter referred to as the “owner”) shall be fairly compensated. Article 3 The principle of “democratic decision-making, due process and open results” shall be followed in the building expropriation and compensation. Article 4 The people’s government at the city or county level shall be responsible for the building expropriation and compensation within its administrative region. World Bank Loan Project 70 Newly-built Harbin-Jiamusi Railway Appendix of Resettlement Action Plan Report of Newly-built Harbin-Jiamusi Railway The building expropriation department as determined by the people’s government at the city or country level (hereinafter referred to as the “building expropriation department”) shall organize and implement the building expropriation and compensation within its administrative region. The relevant departments of the people’s government at the city or county level shall, according to the provisions of this Regulation and the division of duties as prescribed by the people’s government at the corresponding level, cooperate with each other to ensure smooth building expropriation and compensation. Article 5 The building expropriation department may designate a building expropriation implementing entity to undertake the specific work on building expropriation and compensation. A building expropriation implementing entity shall not operate for profits. The building expropriation department shall oversee the building expropriation and compensation activities of a building expropriation implementing entity within the authorized scope, and assume the legal liabilities for the consequences of such activities. Article 6 The people’s government at a higher level shall strengthen its oversight of the building expropriation and compensation work of the people’s government at a lower level. The competent department of housing and urban-rural development under the State Council and those of the people’s governments of provinces, autonomous regions and municipalities directly under the Central Government shall, jointly with the public finance, land and resources, development and reform and other relevant departments at the corresponding level, strengthen the guidance on the implementation of building expropriation and compensation. World Bank Loan Project 71 Newly-built Harbin-Jiamusi Railway Appendix of Resettlement Action Plan Report of Newly-built Harbin-Jiamusi Railway Article 7 Any organization or individual shall be entitled to report any violation of this Regulation to the relevant people’s government, the building expropriation department or any other relevant department. The relevant people’s government, the building expropriation department or any other relevant department receiving a report shall verify and deal with it in a timely manner. Supervisory organs shall strengthen the supervision of the governments, the relevant departments or entities and their staff participating in the building expropriation and compensation. Chapter II Expropriation Decisions Article 8 Where, for public interests such as safeguarding the national security and promoting the national economic and social development, it is necessary to expropriate a building under any of the following circumstances, the people’s government at the city or county level shall make a decision to expropriate the building: (1) necessary for national defense and foreign affairs; (2) necessary for the construction of energy, transportation, water and other infrastructures as organized and implemented by the government; (3) necessary for a public cause such as science and technology, education, culture, health, sports, environment and resource protection, disaster prevention and mitigation, protection of cultural relics, social welfare or municipal utilities as organized and implemented by the government; (4) necessary for the construction of a social security housing project as organized World Bank Loan Project 72 Newly-built Harbin-Jiamusi Railway Appendix of Resettlement Action Plan Report of Newly-built Harbin-Jiamusi Railway and implemented by the government; (5) necessary for the rebuilding of an old urban area where dilapidated buildings concentrate and infrastructure lags behind as organized and implemented by the government according to the relevant provisions of the Urban and Rural Planning Law; or (6) necessary for any other public interest as prescribed by a law or administrative regulation. Article 9 According to Article 8 of this Regulation, all kinds of construction activities requiring expropriation of buildings shall comply with the national economic and social development plan, overall land use plan, urban and rural plan and special purpose plans. The construction of social security housing projects and the rebuilding of old urban areas shall be incorporated into the annual plan for national economic and social development at the city or county level. Public opinions shall be extensively solicited in the making of the national economic and social development plan, overall land use plan, urban and rural plan and special purpose plans, and scientific demonstration shall be made. Article 10 The building expropriation department shall draft an expropriation and compensation plan and report it to the people’s government at the city or county level. The people’s government at the city or county level shall organize the relevant departments to demonstrate the expropriation and compensation plan and publish it for public opinions. The period for solicitation of public opinions shall be no less than 30 days. Article 11 The people’s government at the city or county level shall publish in a timely manner the public opinions solicited and the amendments made according to World Bank Loan Project 73 Newly-built Harbin-Jiamusi Railway Appendix of Resettlement Action Plan Report of Newly-built Harbin-Jiamusi Railway the public opinions. Where buildings need to be expropriated due to the rebuilding of an old urban area, if the majority of the owners consider that the expropriation and compensation plan does not conform to the provisions of this Regulation, the people’s government at the city or county level shall organize a hearing attended by the owners and the representatives of the public, and amend the plan according to the results of the hearing. Article 12 Before making a decision on building expropriation, the people’s government at the city or county level shall make a social stability risk assessment according to the relevant provisions, and if the decision involves a large number of owners, it shall be made at the executive meeting of the government upon discussion. Before a decision on building expropriation is made, the compensation fees for expropriation shall be ready in full amount, deposited in a special purpose account and used for designated purpose only. Article 13 The people’s government at the city or county level shall, after making a decision on building expropriation, announcement it to the public in a timely manner. The announcement shall state the expropriation and compensation plan, rights to administrative reconsideration and administrative lawsuit and other matters. The people’s government at the city or county level and the building expropriation department shall do a good job in the publicity and explanation of building expropriation and compensation. Where a building is expropriated according to law, the corresponding right to use state-owned land shall be retracted at the same time. World Bank Loan Project 74 Newly-built Harbin-Jiamusi Railway Appendix of Resettlement Action Plan Report of Newly-built Harbin-Jiamusi Railway Article 14 An owner against a building expropriation decision made by the people’s government at the city or county level may apply for administrative reconsideration or file an administrative lawsuit according to law. Article 15 The building expropriation department shall organize surveys and registration of the ownership, location, use, construction area, etc. of buildings within the scope of expropriation, and the owners shall provide cooperation. The survey results shall be announced to the owners within the scope of expropriation. Article 16 After the scope of expropriation is determined, acts which lead to an improper increase of compensation fees, such as new construction, expansion or reconstruction of a building or a change of the use of a building within the scope of expropriation, shall be prohibited. For such acts in violation of the relevant provisions, no compensation shall be made. The building expropriation department shall notify the relevant departments in writing of suspending the handling of relevant formalities for the matters as listed in the preceding paragraph. A written notice on suspending the handling of relevant formalities shall state the period of suspension, which shall be no longer than one year. Chapter III Compensation Article 17 The compensation granted to an owner by the people’s government at the city or county level which makes a building expropriation decision shall include: (1) compensation for the value of the building expropriated; (2) compensation for the relocation or temporary settlement resulting from the building expropriation; and World Bank Loan Project 75 Newly-built Harbin-Jiamusi Railway Appendix of Resettlement Action Plan Report of Newly-built Harbin-Jiamusi Railway (3) compensation for the production or business interruption losses resulting from the building expropriation. The people’s government at the city or county level shall formulate subsidization and incentive measures to give subsidies and incentives to the owners. Article 18 In case of expropriation of personal housing, if the owner meets the housing security conditions, the people’s government at the city or county level which makes the building expropriation decision shall give priority to providing housing security for him. The specific measures shall be formulated by a province, autonomous region or municipality directly under the Central Government. Article 19 The compensation for the value of the building expropriated shall not be less than the market price of real estate similar to the building expropriated on the date of announcement of the building expropriation decision. The value of the building expropriated shall be assessed by an eligible real estate price assessment institution according to the assessment measures for building expropriation. An owner who opposes to the assessed value of the building to be expropriated may apply to the real estate price assessment institution for reassessment. An owner who opposes to the reassessment result may apply to the real estate price assessment expert committee for appraisal. The administrative department of housing and urban-rural development under the State Council shall formulate the assessment measures for building expropriation, in the process of which the public opinions shall be solicited. Article 20 The real estate price assessment institution shall be decided by the owners through consultation. If the consultation fails, the institution shall be determined World Bank Loan Project 76 Newly-built Harbin-Jiamusi Railway Appendix of Resettlement Action Plan Report of Newly-built Harbin-Jiamusi Railway according to the majority’s decision, at random or by any other means, and the specific measures shall be formulated by a province, autonomous region or municipality directly under the Central Government. A real estate price assessment institution shall carry out assessment of buildings to be expropriated in an independent, objective and impartial manner, and no entity or individual shall interfere with it. Article 21 An owner may choose either monetary compensation or exchange of titles. If an owner chooses exchange of titles, the people’s government at the city or county level shall provide a building for exchange of titles, and calculate and settle with the owner the difference between the value of the expropriated building and the value of the building provided for exchange of titles. If personal housing is expropriated due to the rebuilding of an old urban area, and an owner chooses exchange of titles in the rebuilt area, the people’s government at the city or county level which makes the building expropriation decision shall provide a building in the rebuilt area or in a nearby area. Article 22 In case of relocation due to building expropriation, the building expropriation department shall pay relocation fees to the owners; and if an owner chooses exchange of titles, the building expropriation department shall, prior to delivery of the building for exchange of titles, pay temporary settlement fees to the owner or provide the owner with a temporary dwelling. Article 23 The compensation for production or business interruption losses resulting from building expropriation shall be determined on the basis of the proceeds from the building before expropriation, duration of production or business interruption and other factors. The specific measures shall be formulated by a province, autonomous World Bank Loan Project 77 Newly-built Harbin-Jiamusi Railway Appendix of Resettlement Action Plan Report of Newly-built Harbin-Jiamusi Railway region or municipality directly under the Central Government. Article 24 The people’s government at the city or county level and the relevant departments thereof shall strengthen according to law the supervision and administration of construction activities, and deal with according to law constructions in violation of the urban and rural plan. The people’s government at the city or county level shall, before making a building expropriation decision, organize the relevant departments to survey, confirm and deal with the unregistered buildings within the scope of expropriation. For buildings confirmed to be legal and temporary buildings not exceeding the approved period, compensation shall be made; and for buildings confirmed to be illegal and temporary buildings exceeding the approved period, no compensation shall be made. Article 25 The building expropriation department and an owner shall, according to this Regulation, enter into a compensation agreement on the method, amount and time of payment of compensation, location and area of the building provided for exchange of titles, relocation fees, temporary settlement fees or temporary dwelling, production or business interruption losses, time limit for relocation, transition manner, transition period and other matters. After a compensation agreement is signed, if one party fails to perform any obligation under the compensation agreement, the other party may file a lawsuit according to law. Article 26 If a compensation agreement cannot be reached by the building expropriation department and an owner within the contracting period as determined in the expropriation and compensation plan, or the owner of the building to be expropriated is unclear, the building expropriation department shall report it to the people’s government at the city or county level which makes the building World Bank Loan Project 78 Newly-built Harbin-Jiamusi Railway Appendix of Resettlement Action Plan Report of Newly-built Harbin-Jiamusi Railway expropriation decision for making a compensation decision under the expropriation and compensation plan in accordance with this Regulation, which shall be announced within the scope of expropriation. A compensation decision shall be fair, and include the relevant matters in a compensation agreement as prescribed in paragraph 1 of Article 25 of this Regulation. An owner who disagrees on a compensation decision may apply for administrative reconsideration or file an administrative lawsuit according to law. Article 27 Compensation shall be made before relocation in building expropriation. After the people’s government at the city or county level which makes a building expropriation decision compensates an owner, the owner shall complete relocation within the time limit for relocation as agreed on in the compensation agreement or as determined in the compensation decision. No entity or individual shall force an owner to relocate by violence or threat, by cutting off the supply of water, heating, gas or electricity or road passage in violation of the relevant provisions or by any other illegal means. Construction entities shall be prohibited from involvement in relocation activities. Article 28 Where an owner does not apply for administrative reconsideration or file an administrative lawsuit within the statutory time limit and fails to relocate within the time limit as determined in the compensation decision, the people’s government at the city or county level which makes the building expropriation decision shall apply to the people’s court for enforcement according to law. Documents on the compensation amount, account number of the related special World Bank Loan Project 79 Newly-built Harbin-Jiamusi Railway Appendix of Resettlement Action Plan Report of Newly-built Harbin-Jiamusi Railway deposit account, location and area of the building provided for exchange of titles or the temporary dwelling, etc. shall be attached to the written application for enforcement. Article 29 The building expropriation department shall establish building expropriation and compensation files according to law, and announce the information on division of household and compensation to the owners within the scope of expropriation. The audit organ shall strengthen the supervision over the management and use of compensation fees for expropriation, and announce the audit results. Chapter IV Legal Liability Article 30 Where, in building expropriation and compensation, any functionary of the people’s government at the city or county level or the building expropriation department fails to perform his duties as set out in this Regulation, or abuses his power, neglects his duties, practices favoritism or makes falsification, the people’s government at the higher level or at the same level shall order him to make a correction, and circulate a notice of criticism of him; if any loss is caused, he shall be liable for compensation according to law; the directly responsible person and other directly liable persons shall be subject to disciplinary actions according to law; and if a crime is constituted, the offenders shall be subject to criminal liability according to law. Article 31 Whoever forces an owner to relocate by violence or threat, by cutting off the supply of water, heating, gas or electricity or road passage in violation of relevant provisions or by any other illegal means, causing losses, shall be liable for compensation according to law; and the directly responsible person and other directly liable persons shall be subject to criminal liability according to law if a crime is World Bank Loan Project 80 Newly-built Harbin-Jiamusi Railway Appendix of Resettlement Action Plan Report of Newly-built Harbin-Jiamusi Railway constituted, be subject to disciplinary actions if no crime is constituted, or be subject to public security administration punishment according to law if a violation of public security administration is constituted. Article 32 Whoever obstructs lawful building expropriation and compensation by violence, threat or any other means shall be subject to criminal liability if a crime is constituted; or be subject to public security administration punishment if a violation of public security administration is constituted. Article 33 Whoever embezzles, misappropriates, secretly partitions, withholds or defaults compensation fees for expropriation shall be ordered to make a correction, the relevant amount shall be recovered, illegal gains shall be returned within a prescribed time limit, and a notice of criticism or a warning shall be given to the relevant liable entity; if any loss is caused, the violator shall be liable for compensation; and the directly responsible person and other directly liable persons shall be subject to criminal liability according to law if a crime is constituted or be subject to disciplinary actions according to law if no crime is constituted. Article 34 Where a real estate price assessment institution or a real estate valuer provides a false or seriously flawed assessment report, the certificate-issuing organ shall order it or him to make a correction within a prescribed time limit, give a warning to it or him, impose a fine of not less than 50,000 yuan but not more than 200,000 yuan on it or a fine of not less than 10,000 yuan but not more than 30,000 yuan on him, and record it into its or his credit file, and if the circumstances are serious, revoke the qualification certificate or registration certificate; if losses are caused, it or he shall be liable for compensation according to law; and if a crime is constituted, it or he shall be subject to criminal liability according to law. Chapter V Supplementary Provisions World Bank Loan Project 81 Newly-built Harbin-Jiamusi Railway Appendix of Resettlement Action Plan Report of Newly-built Harbin-Jiamusi Railway Article 35 This Regulation shall come into force on the date of issuance. The Regulation on the Dismantlement of Urban Houses issued by the State Council on June 13, 2001 shall be abolished simultaneously. Projects for which the building demolition and relocation permits have been obtained according to law before the implementation of this Regulation shall continue to be governed by the former provisions, but the government shall not order the relevant departments to conduct forced demolition and relocation. World Bank Loan Project 82 Newly-built Harbin-Jiamusi Railway Appendix of Resettlement Action Plan Report of Newly-built Harbin-Jiamusi Railway Important Information Materials and Procedure Required for Acceptance, Signature of Requisition/Compensation Agreement 1. The owners of residential building shall provide estate ownership certificate, identity card, personal seal, permanent residence registration certificate (both original and photocopy), cable TV/communication/Internet access/gas installation evidence. The owners of residential building used for business purpose or non-residential buildings shall additionally provide business license, tax registration certificate, tax payment invoice, labor insurance manual, legal person code certificate, official seal, authorization letter and the authorized representative's identity card (if applicable). 2. After signature of monetary compensation/ownership transfer agreement, the owners shall handle related procedure at related organizations such as water/power supplier or land administration. 3. After completing the aforesaid procedure and removal within the term as specified, the owners shall apply for house acceptance inspection with house acceptance team, providing the proper agreement and water/power fee settlement bill. If the acceptance inspection is passed, the acceptance team will sign off an acceptance bill and an official removal acceptance form will be completed by the on-site headquarters. 4. The owners who select monetary compensation may, within 7 day of signature of the agreement, be offered compensation at Dazhi Branch of Harbin Bank, providing monetary compensation agreement, identity card and personal seal. 5. To ensure accurate identification of resettlement house and early start of construction, the owners who select transfer of estate ownership shall, from December 19 to 21, 2011, pay their house price at the on-site office, providing two House Requisition & Compensation Agreements, World Bank Loan Project 83 Newly-built Harbin-Jiamusi Railway Appendix of Resettlement Action Plan Report of Newly-built Harbin-Jiamusi Railway House Acceptance Inspection Form and owner's identity card and personal seal, as well as the following information: Name of Receiver: Direction Team Office for transformation of shanty town in Xiangfang District, Harbin Account Number of Receiver: 1208010488733339 Swift Code: 108 Payment Source: Segment of (west side of) Tongxiang Street Name of Payer: Name of the Party B as named on House Requisition Agreement Deposit Bank: Dazhi Branch of Harbin Bank After payment, the owners will get the invoice at the on-site headquarters, by showing House Requisition and Compensation Agreement, Acceptance Inspection Form, original of the owner's identity card and Cash Payment Bill with bank's seal. For payment made after December 22, 2012 till up to three months later, the owners shall make the payment at any outlet of Harbin Bank, providing two House Requisition and Compensation Agreements, Acceptance Inspection Form, original of the owner's identity card and personal seal, and then get the invoice at the on-site office located at Minsheng International Community on Shengsandao Street, Xiangfang District, providing House Requisition and Compensation Agreement, Acceptance Inspection Form, original of the owner's identity card and Cash Payment Bill with bank's seal. Any consequence resulted from default of any due house price will be the owner's own responsibility. World Bank Loan Project 84 Newly-built Harbin-Jiamusi Railway Appendix of Resettlement Action Plan Report of Newly-built Harbin-Jiamusi Railway Appendix 12 Simple Description of Relevant Project--- Harbin Station Reconstruction Project 1. The new Harbin-Jiamusi and Harbin-Qiqihar railways are planned to enter Harbin Station. The starting point of Harbin-Qiqihar Passenger Dedicated Line is Harbin Station. 2. Station buildings of Harbin Station have been constructed in several phases under diverse economic and social conditions of different times. The station buildings and station square are short of overall planning in view of functions and layout. The main station building is not at the centerline. Its exterior façade is very old and out of tune with city construction environment. The existing station building cannot meet demand. Since the foundation of New China since 1949, Harbin Station has been reconstructed for four times. Its conditions and functions have been far fallen behind. After reconstruction in 2002, an overhead waiting hall was constructed. Now, the overhead waiting hall has a total area of 9,785.15m2 and cannot satisfy demand on transportation and also the need that Harbin-Jiamusi and Harbin-Qiqihar railways enter Harbin Station. 3. The feasibility study report for the new Harbin-Qiqihar Passenger Dedicated Line was approved by the state on June 26, 2009. The preliminary design was approved by the Ministry of Railways on August 21, 2009. Now the construction has been started. The project starts at DK1+600 outside Harbin Station, turns to north along the right side of Binzhou Line, crosses the Songhua River and extends to Qiqihar. 4. The feasibility study report for Harbin Station Reconstruction Project was finished in March 2009. Corresponding environmental impact assessment report for the project was approved in March 2012. The project mainly refers to train yard reconstruction, station building and columnless canopy. Scope of this reconstruction project is situated in Harbin City. Land involved is special railway land and also urban land. Land of railroad section between two ends covers a total area of 173mu, World Bank Loan Project 85 Newly-built Harbin-Jiamusi Railway Appendix of Resettlement Action Plan Report of Newly-built Harbin-Jiamusi Railway all of which is special railway land. The station building has a total area of 662 mu, including 579 mu within the railway and 83 mu newly acquired urban land. 9 local enterprises and 5 railway enterprises are involved in house demolition and relocation. Total houses to be demolished amount to 33,508 m2, including 27,508 m2 house of the railway administration and 5,500 m2 local houses. 5. Owner of the project is Harbin Railway Administration. The project is planned to start in 2013 and completed in 2015, with construction period of 24 months. The project will be completed at the same time with Harbin-Qiqihar Passenger Dedicated Line. Compensation and resettlement scheme will be established and gradually detailed by reference to that for adjacent Harbin-Dalian, Harbin-Qiqihar and Harbin-Jiamusi projects. World Bank Loan Project 86 Newly-built Harbin-Jiamusi Railway Appendix of Resettlement Action Plan Report of Newly-built Harbin-Jiamusi Railway Appendix 13 Cost Accounting for Housing and Appendages Replacement During field investigation, cost for housing and appendages replacement has been extensively discussed with local farmers and government officers who are responsible for resettlement. The resettlement cost of key categories is described as below: (1) Brick-concrete structure house: It involves house foundation, wall, roof system, door & window, floor and interior & exterior wall decoration, etc. For different material price levels in individual districts and counties, replacement cost for a new brick-concrete structure house/building is RMB 592~976/m2 through calculation. (2) Brick-wood structure house: It involves house foundation, wall, roof system, door & window, floor and interior & exterior wall decoration, etc. For different material price levels in individual districts and counties, replacement cost for a new brick-wood structure house/building is RMB 469~773/m2 through calculation. (3) Civil engineering structure house: It involves house foundation, wall, roof system, door & window, floor and interior & exterior wall decoration, etc. For different material price levels in individual districts and counties, replacement cost for a new civil engineering structure house/building is RMB 415~686/m2 through calculation.
