No I. PROJECT STATUS AND RATIONALE FOR RESTRUCTURING A. Project Status 1. The Lao People’s Democratic Republic (Lao PDR) continues to show strong commitment and leadership to strengthen the management of environment and natural resources in a sustainable manner and to move the country toward green growth. The World Bank supports this important agenda through the Second Lao Environment and Social Project (LENS2) implemented by the Environment Protection Fund (EPF). The LENS2 portfolio consists of 38 subprojects under 3 components: (a) institution development and capacity building (23 subprojects), (b) management of wildlife and protected areas (14 subprojects), and (c) project administration and EPF capacity building. LENS2 was declared effective on July 4, 2014, and Additional Financing was effective on October 1, 2015. Total disbursement of all external financing sources is 29 percent as of the end of December 2017. The portfolio is implemented by several ministries: the Ministry of Agriculture and Forestry (MAF), the Ministry of Natural Resources and the Environment (MONRE), the Ministry of Education and Sport (MES), the Ministry of Finance (MOF), the Ministry of Planning and Investment (MPI), the Ministry of Public Security (MPS) and the Prime Minister’s Office (PMO). The Environment Protection Fund (EPF), supervised by a Board of Directors (BOD) chaired by MONRE Minister, is responsible for day-to-day project management and administration and channels funding to eligible subprojects via Subproject Delivery Agencies (SDAs). 2. Below are highlights of some project results reported by December 2017: a) Component 1: Institutional Development and Capacity Building i. Functional capacity of the EPF and 34 SDAs increased an average of 8.1 percent (exceeding the intermediate target for 2017), as measured via a score card approach combined with self-assessment. ii. 1,315 staff members of public and partner institutions have completed basic adaptive training, of which 404 are women,– exceeding the intermediate target. iii. The Lao Wildlife Enforcement Network (Lao-WEN) is operational. Lao-WEN is a coordination platform for wildlife law enforcement agencies (Customs, Army, Environmental Police, Police, Department of Forestry Inspection (DOFI), and the Office of the Public Prosecutor). Five international illegal trade information reports were submitted to international law enforcement (INTERPOL, TRAFFIC, ASEAN-WEN or CITES) in October 2017; exceeding the intermediate target. Five other international illegal trade information reports (3 from LCD and 2 from DCNEC) have been submitted to international law enforcement agencies. iv. The enforcement of wildlife laws at the provincial and district levels is also strengthening: 17 Provincial Wildlife Enforcement Networks (P-WEN) have been established, several joint patrols have been conducted in sensitive border areas, and 11 domestic wildlife trafficking and two international wildlife trafficking cases have been detected and recorded in the Information Management System by MAF/DOFI in October 2017. b) Component 2: Management of Wildlife and Protected Areas i. Protected area management effectiveness baseline was assessed using the METT tool in the 11 protected areas, covering 1,297,000 hectares. ii. 242,000 hectares in protected areas (approximately 19 percent of total protected land area supported by LENS2) now include enhanced biodiversity management via periodic mobile patrols and monitoring selected mammal populations and threats. c) Component 3: Administration and EPF capacity building The World Bank Second Lao Environment & Social Project (former Protected Area and Wildlife Project) (P128393) i. The portfolio of LENS2 subprojects is close to being fully developed and the LENS2 budget is almost entirely allocated. Not counting the EPF subproject for capacity building and overall project administration (US$5.4 million), 34 subprojects are under implementation, and two subprojects are being appraised. Some subprojects are being revised to accommodate that ministerial reorganizations within MAF and MONRE that were completed in late 2017, and some subprojects are being revised to absorb additional funds within the LENS2 subproject portfolio. ii. The EPF’s basic capacity for administering the project and the LENS2 portfolio of 37 subprojects is seen to improve: the EPF Decree is revised as No.94/PM dated 9 March 2017 and is in effect, staffing is now adequate for all functions, and the two subprojects with the highest risk ratings (Nam Et-Phou Louey NPA and Nakai-Nam Theun NPA subprojects) have made significant progress recently with the support of the EPF team. iii. EPF is harmonizing its operations (as part of the “One EPF” agenda) which is being implemented through various channels. The EPF Annual Report, draft Vision, Strategy and Business Plan, HR policy and implementation manual and fundraising and communications strategy all present a holistic approach. B. Rationale for Restructuring 3. The Bank conducted a Mid-term Review (MTR) between March 20 and April 7, 2017 and concluded that project implementation is on track toward achieving the project development objective (PDO), and this was later confirmed by the November 2017 implementation support mission. As the GoL embraces green growth and improvement of natural resource governance as national development objectives, the LENS2 portfolio has become highly relevant, with EPF being increasingly seen as a useful mechanism to achieving these objectives. The MTR report highlighted that the portfolio has recently evolved to reflect the GoL’s green growth aims related to environmental planning and management as well as policy and institutional development, all of which are in line with the on-going Bank-financed Lao PDR Green Resilient Growth Development Policy Financing series. 4. The MTR also noted several key challenges in project implementation, namely: (a) a substantial portfolio of subprojects for protected areas management are experiencing difficulties in moving into full implementation stage (Portfolio of 9 subprojects totaling US$ 9.95 million); (b) the lack of consistent indicators for capturing outcomes from subprojects that focus on environmental and natural resource planning and pollution reduction impacted directly on the measurement of project progress toward PDO and indirectly on the LENS2 overall rating; (c) the lack of capacity in reporting on specific indicators constrains the effective implementation of project M&E framework, and (d) internal government restructuring, completed in late 2017, has affected a specific set of SDAs in MAF and MONRE and some respective new mandates are pending clarification. The MTR mission recommended the following changes: a) The MTR mission considered a potential change in PDO to reflect the evolution of the GoL’s emphasis on green growth and natural resources governance. It has since been determined that the PDO/GEO as currently phrased remains relevant and achievable while contributing to the green growth agenda of the GoL; b) Rebalancing the LENS2 Component 1 and Component 2 budgets and re-allocating the small unspent balance of the project preparation advance to the LENS2 Component 3.2 (EPF capacity and administration); c) The restructuring of the LENS2 results framework to improve the measurement of progress toward the PDO. 5. The Task Team has been making concerted efforts with the GoL to address these challenges. For example, project management has improved on many levels, including data collection and aggregation, as well as providing technical support to the provinces and districts. The EPF team has undertaken intensive work to develop an action plan for the implementation of MTR conclusions and work with the Task Team to restructure the LENS2 results framework. These concerted efforts should generate progress on project management, in particular M&E system functionality and reporting quality. C. Relevance of the Project Development Objective 6. The PDO/GEO was revised during the 2015 restructuring and remains relevant and achievable within the Laos context and current LENS2 subproject portfolio. The PDO/GEO statement is therefore unchanged: “To help strengthen selected environmental protection management systems, specifically for protected areas conservation, enforcement of wildlife laws, and environmental assessment management”. The term “system” refers to a set of interacting or interdependent elements (such as human, technical, information, institutional, and financial) that together form a logical and unified whole, assembled to achieve a purpose. That purpose is to protect environment by helping strengthen (a) the protected area conservation system that refers to all elements related to Protected Areas management and biodiversity conservation, including social sustainability and participatory aspects, (b) the wildlife law enforcement system that encompasses all elements related to international and domestic wildlife and natural resources trafficking combating and poaching as well as biodiversity protection, (c) the environment management system that concerns diverse elements related to environmental planning, including development planning, environmental impact monitoring including social impact monitoring, and pollution monitoring and management. Cutting across all of these dimensions of environmental protection management systems are (a) human and institutional capacity at all levels (national, provincial and district) to implement projects, programs, plans, policies and laws, and (b) the financing capacity of the EPF as sustainable and cost-effective environmental financing vehicle in Lao PDR. These three elements together contribute to foster environmental, social, and economic sustainability within the GoL’s current development priorities as part of promoting inclusive green growth. Thus, the current PDO phrasing encompasses all dimensions of the LENS2 portfolio including activities, results and outcomes as well as green growth. 8. To assist in understanding the contribution of the LENS2 to the environmental priorities of Lao PDR, including green growth, a “theory of change” for LENS2 has been developed to show how the current PDO, current activities, and revised indicators interact. DESCRIPTION OF PROPOSED CHANGES 9. The World Bank received a restructuring request dated November 24, 2017 from the Ministry of Finance (MOF) on November 28, 2017, and a clarifying e-mail on December 22, 2017, that included specific adjustments to the operation, as follows: a) Reallocation of funds across LENS2 components: As the client has allocated more than originally anticipated to implement Component 2 and less than originally anticipated to implement Component 1, the restructuring request includes a slight re-allocation of funds between the two. b) Re-allocation of Project Preparation Advance (PPA) proceeds (Disbursement Categories 2 and 3) to the LENS2 implementation budget (Disbursement Category 1): The PPA proceeds have not been entirely used. The restructuring request will re-allocate the combined total unspent balance of 482,858 XDR (approximatively US$ 685,658 in December 2017) from disbursement categories 2 and 3 (IDA H9150 and IDA 56200) to disbursement category 1. c) Revision of results indicators: The revision agreed will (a) improve reporting of the project’s achievements, (b) introduce relevant new indicators, (c) adjust target values for selected existing indicators, and (iv) clarify indicator definitions and operational relevance. d) Raise the disbursement ceiling: Raising the disbursement ceiling from US$1.5 million to US$3 million will better support expenditure speed and timeliness among the many subprojects being implemented in 8 provinces and the central level. e) Cancel part of one subproject: One activity (re-delineation of forest boundaries and concessions, US$ 719,313) funded by one subproject that is implemented by DFRM [Moved in late 2017 from Ministry of Natural Resources and Environment (MONRE) to the Ministry of Agriculture and Forestry (MAF)] was requested by EPF to be cancelled and the proceeds re-allocated to other subprojects. The cancellation will not result in re- allocation of proceeds across LENS2 components or disbursement categories and could potentially reduce the social and environmental risk profile of LENS2. A. Revision of Results Framework 10. This revision aims to (a) simplify the project’s results framework by streamlining the number of indicators and M&E system, (b) clarify indicators by being more precise and aligned with the current subproject activities, objectives and outcomes as well as with the existing PDO, and (c) capture outcomes of new subprojects involved in environment planning and pollution control. The revision includes revising baseline values and end of project targets, taking into account the capacity improvements during the last three years of project implementation. 11. Revisions are summarized as follows: (a) addition of environment planning and management indicators to reflect the scope of LENS2-supported subprojects on green growth; (b) revision of indicators related to the wildlife law enforcement dimension of the PDO to encompass new subprojects (Environmental Police and Customs), and specifically to measure the level of cooperation between Lao-WEN agencies, capacity improvements, and commitment of Lao PDR to enforcement of the Convention on International Trade of Endangered Species (CITES); (c) revision of other indicators, or dropping/replacing some indicators, to address issues with clarity of phrasing, definitions, data collection, and aggregation, given the capacity constraints in project monitoring; and (d) adjusting targets for indicators to reflect subproject proposals developed or revised in late 2017. Specific changes to the results framework are summarized in Table 1 below, and the revised results framework is included under section (e) below. Monitoring and Evaluation based on the quality of data collection: The LENS2 project is characterized by a large portfolio of subprojects implemented by several SDAs under EPF management and administration. The EPF supervises the quality of implementation and outcomes, compliance with fiduciary requirements, including safeguards, and monitoring and evaluation (M&E) of input, output, process and outcomes generated by subprojects funded. The M&E system and arrangements as defined in the EPF M&E manual is based on a bottom-up approach: data collection starts at the SDA level and is consolidated at the EPF Office and reported into the EPF semi-annual and annual reports. In parallel, relevant line ministries monitor the implementation of subprojects from a policy and national plan compliance viewpoints as many of these activities are feeding directly into their five-year programs. 13. Data tracking and reporting on time is critical for tracking progress toward the PDO and for adjusting project management and activities. Nonetheless, some SDAs have difficulty with producing quality data and require enhanced implementation support by the EPF M&E team. These SDAs have been identified as a key bottleneck within the M&E process that impact the EPF workflow, the quality of the reporting of LENS2 overall, and consequently a reliability of the subproject and project reviews/analysis. Capacity development is considered highly critical and the operation aims to focus efforts on this topic across subprojects and includes a number of indicators to track progress on bridging the capacity gap.
