C 15-16 Kuningan Jakarta 12950, Indonesia Dear Ms. de Lacy: Re: Amendment No. 1 to the Trust Fund Administration Agreement between the Government of Australia, acting through the Australian Agency for International Development and the International Bank for Reconstruction and Development concerning the Consolidating Peaceful Development in Aceh Multi-Donor Trust Fund (TF No.TF071413) (AusAID agreement no. 54244) We are pleased to refer to the Trust Fund Administration Agreement (“Administration Agreement”), dated January 8, 2010 between the Government of Australia, acting through the Australian Agency for International Development (the “Donor”) and the International Bank for Reconstruction and Development (“IBRD” or the “Bank”), pursuant to which the Donor made available a Contribution to support multi-donor the Consolidating Peaceful Development in Aceh Trust Fund (the “Trust Fund”). Terms used but not defined in this letter of amendment (“Amendment”) have the meanings given to them in the Administration Agreement. The Donor and the Bank have agreed to amend the Administration Agreement as follows. 1. The title to the Administration Agreement is: “Trust Fund Administration Agreement between the Government of Australia, acting through the Australian Agency for International Development and the International Bank for Reconstruction and Development concerning the Consolidating Peaceful Development in Aceh Multi-Donor Trust Fund (TF No.TF071413) (AusAID agreement no. 54244)”. 2. The first sentence of paragraph 3 of the Administration Agreement is deleted. 3. The following email contact is added for the donor representative in paragraph 6 of the Administration Agreement: Email christine.vanhooft@ausaid.gov.au. 4. The following language is added as paragraph 10 of the Standard Conditions set out in Annex 2 to the Administration Agreement: Page 2 Ms Jacqui de Lacy 2 of 2 June 10, 2010 Australian Agency for International Development “ 10. Use of Funds 10. Recognizing the obligations of the Bank member countries under the various United Nations Security Council Resolution to take measures to prevent financing of terrorists, the Bank undertakes to use reasonable efforts consistent with the Bank’s Articles of Agreement and policies, including those pertaining to combating financing of terrorists, to ensure that the funds provided under any Administration Agreement are used for their intended purposes and are not diverted to terrorists and their agents. The Bank will include a provision in each Grant Agreement that the Recipient will: (a) not use the proceeds of the grant for the purpose of any payment to persons or entities, or for the import of goods, if such payment or import, to the Recipient’s knowledge or belief, is prohibited by decisions of the United Nations; and if applicable, (b) include a corresponding provision in any sub grant agreements that the Recipient enters into with entities to which the Recipient makes the grant funding available.” Please confirm your agreement with the foregoing, on behalf of the Donor, by signing, dating, and returning to us the enclosed copy of this Agreement. Upon receipt by the Bank of the copy of this Agreement countersigned by you, this Agreement will become effective as of the later of (i) the date of the countersignature by the Donor and (ii) the date of countersignature of a corresponding amendment letter incorporating the addition of paragraph 10 of the Standard Conditions in Annex 2 to the Administration Agreement by the other donor to the Trust Fund.
