MADAGASCAR ROAD SECTOR SUSTAINABILITY PROJECT DRAFT VERSION FOR NEGOTIATION May 2021 Official Use ENVIRONMENTAL AND SOCIAL COMMITMENT PLAN 1. The Government of Madagascar ( the “Recipient� ) shall implement the Road Sector Sustainability Project (the “Project�) with the participation of Ministries / organizations / entities including but not limited to: the Road Agency as the Project Implementing Entity, in charge of the implementation of the entire Project and supported by the Ministry of Territorial Planning and Public Works (MTPPW) , Ministry of Tourism, Transport and Meteorology (MTTM), Ministry of Economy and Finance (MEF), the Madagascar Road Agency (AR), “Fonds Routier� (FR) and the National Steering Committee (NSC) including the Presidency and the abovementioned Ministries. The International Development Association (hereinafter “the Association�) has agreed to fund the project. 2. The Recipient shall implement the necessary and concrete measures and actions to ensure that the Project is carried out in accordance with current national legal and regulatory provisions on environmental management and social risks and in compliance with Environmental and Social Standards (ESS). This Environmental and Social Commitment Plan (ESCP) sets out the physical measures and actions, the specific documents or plans, and the timetable for each of them. 3. The Recipient shall also comply with all other environmental and social documents required under the ESF and mentioned in this ESCP, such as the Environmental and Social Management Framework (ESMF), the Resettlement Framework (RF), the Stakeholder Engagement Plan (SEP), the Labor Management Procedures (LMP) and Gender Based Violence Action Plan (GBV), and the timelines indicated in those environmental and social (E&S) documents. 4. The Recipient is responsible for compliance with all requirements of the ESCP, even when the implementation of measures and specific action is carried out by a Ministry, entity or unit referred in paragraph 1, above. 5. The implementation of the measures and concrete actions defined in this ESCP shall be the subject of ongoing monitoring of implementation by the Recipient and of periodic reports that shall be communicated to the Association in accordance with the provisions of the ESCP and the terms of the legal financing agreement for the Project. The Association shall monitor and evaluate the progress and implementation of these concrete measures and actions throughout the implementation of the Project. 6. As agreed between the Association and the Recipient through the National Steering Committee, this ESCP may be revised during the implementation of the Project, so as to reflect any changes or unforeseen situations that may arise within the framework of the Project, or in response to an evaluation of the performance of the Project carried out under the ESCP itself. In such situations, the Recipient will agree to these changes with the Association and revise the ESCP accordingly. The agreement on the modifications made to the ESCP shall be evidenced by the exchange of letters signed between the Association Official Use and the Recipient. Upon approval by the Association, the Beneficiary shall promptly publish the updated ESCP. 7. When the performance of the Project itself or unforeseen situations or changes that have occurred within the framework of the Project lead to a rise of risks and effects during the implementation of the Project, the Government of Madagascar makes additional funds available, if necessary, in order to implement actions and measures to deal with these risks and effects, which may include but are not limited to: loss of income due to traffic restriction or access to land as a result of land acquisition during maintenance or rehabilitation of national roads, environmental, health and security impacts, road security, risks of work-related accidents, risk of social conflict, labor influx, and Gender-Based Violence (GBV) and Violence against Children as well as Sexual Exploitation, Abuse and Sexual Harassment, child labor and forced labor. 8. The table below shows the important measures and actions required, the responsibilities of the actors involved in the Project and the deadlines for implementing the necessary measures and actions.
