This is the second (and final) extension of the project closing date (the first extension was for 22 months between November 2018 and October 2020). The project has disbursed US$99 million (89 percent) of the loan amount. The remainder of the loan amount is fully committed and tied to completion of the ongoing court constructions. 19 courts have been completed with 10 courts still in progress. Of the 10 remaining courts, there is a risk that 4 of these courts may not be completed or in a usable state at the end of project period. The judiciary has revised its approach for these four specific courts, and this is now part of the project completion plan. For any courts not completed by the end of the project period, costs relating to the completion of these courts will be passed on to the Government of Kenya. 4/29/2021 Page 1 of 7 The World Bank Implementation Status & Results Report Judicial Performance Improvement (P105269) During the project period, a number of service delivery outcomes have been achieved. The combination of data-based management reforms (review of the organizational structure of the Judiciary, the establishment of the case management system, mainstreaming of performance contracting, piloting court annexed mediation and strengthening public participation through Court User Committees), together with improved physical Information and Communications Technology (ICT) infrastructure, has facilitated the achievement and the delivery of better services for court users. Some of the results from these reforms include: (a) increasing access to free, online legal information (over 1 million users have accessed Kenya Law’s resources website during the project period); (b) citizen engagement in the administration of justice through court-user committees (132 court user committees have been issued with the Court User Committees (CUC) grants. These small grants were used to facilitate local solutions to local problems); (c) improving the timeliness of judicial services by addressing case backlogs (since 2017 a total of 201,980 cases have been concluded) and using court-annexed mediation to quickly and cheaply resolve disputes (especially for commercial and family matters); (d) enhancing performance and the quality of decision-making, including through performance contracts for judges and senior staff (284 contracts have been signed); and (e) improving evidence-based decision making through a new administrative data system to guide strategic planning, budgeting, investment and personnel management. Three out of five PDO indicators and eight out of eleven intermediate indicators have been achieved. It is expected that all indicators will be achieved during the project period except for the following: (a) “average distance to courts a result of construction of new courts”, this may not be achievable due to the risk that Mukurwe-ini ,Ol Kalau, Voi and Wajir courts may remain unfinished (as detailed later in this section); (b) “user satisfaction with the delivery of court services”, this will not be achieved as it will not be possible for a subsequent court user survey to be conducted during the project period to capture the latest results; (c) “new courts constructed by the project to improve access to courts”, 4 out of the 29 courts run the risk of not being completed during the project period. COVID-19 pandemic forced the judiciary to downscale its court construction operations in response to various government directives, and this negatively impacted the earlier schedule for delivery of the remaining courts (necessitating the request for a further project extension). Toward achieving accelerated progress during the remaining project period, the project completion plan continues to be successfully implemented with various actions specifically targeted at the completion of the court construction processes.
