ELRP started with four first mover countries (phase 1)—Djibouti, Ethiopia, Kenya, and Uganda—whose projects were approved as part of the regional program on May 20, 2020 investing a total of US$160 million. Phase 2 added Somalia to the ELRP through the Shock Responsive Safety Net for Locust Response Project (P174065) which will invest US$40 million to provide income support as defined under subcomponent 2.1 of the MPA. Phase 3 is currently being designed and will include South Sudan and a small grant for regional coordination in East Africa. The ELRP team continues to monitor the The World Bank Emergency Locust Response Program (P173702) locust situation, which now includes desert locust and African migratory locust, to identify additional countries in West and Southern African that might need to join the MPA. The projects in Djibouti, Ethiopia, and Kenya (Phase 1), and in Somalia (Phase 2) are effective. Ethiopia and Djibouti have begun disbursing, while Somalia and Kenya should have their first disbursement by the end of November 2020. The ELRP team is leveraging other programs in the region to provide background analysis and identify sources of desert locust information and possible technical assistance, particularly focused on implementation of Components 2 and 3, with an emphasis on helping households, communities, and nations build back better after the crisis. No I. PROJECT STATUS AND RATIONALE FOR RESTRUCTURING 1. This memorandum seeks the Country Director’s approval for a Level 2 Restructuring of Phase I of the Emergency Locust Response Project (ELRP – P173702). The proposed changes relate to the Uganda operation only. This modification will enable The World Bank Emergency Locust Response Program (P173702) the Government of Uganda to obtain Cabinet approval for the project and thereby initiate the process towards Parliamentary ratification and project effectiveness. 2. Status of Uganda Project: The Uganda ELRP is a US$48 million IDA Credit, using a menu of activities under the ELRP, a regional integration program using a horizontal MPA that was approved on May 20, 2020. The project development objective for Uganda is to prevent and respond to the threat [to livelihoods] posed by the desert locust outbreak and to strengthen Uganda’s national systems for preparedness. The project components include: Component 1 – Surveillance and Control Measures (US$20.41 million); Component 2 – Livelihoods Protection and Restoration (US$18.08 million); Component 3 – Coordination and Preparedness (US$2.85 million); and Component 4 – Project Management (US$6.66 million). The project is to be implemented jointly by the Ministry of Agriculture Animal Industry and Fisheries (MAAIF), Office of the Prime Minister-OPM (under the Northern Uganda Social Action Fund – NUSAF (3)), and the Inspectorate of Government (IG). 3. The draft Environmental and Social Management Framework (ESMF) documents for Component 1 (ESMF-1) and for Component 2 (ESMF-2) submitted by the Government have been reviewed by the Bank team and are undergoing a final round of edits before seeking final clearance from ESSA. Following guidance from Operations Policy and Country Services (OPCS) during project preparation, both ESMF documents contain the following instruments: Integrated Pest Management Plan, Gender Based Violence (GBV) Mitigation Action Plan, Labor Management Procedures, and Vulnerable and Marginalized People Management Plan. 4. The Financing Agreement (FA) of the project is yet to be signed by the Government of Uganda. At the time of project’s presentation to the Government Top Management for discussion, Cabinet set aside the decision for approval and requested that revisions be made in line with the Government of Uganda’s official request dated May 26, 2020, in which it was proposed that the administrative and fiduciary elements of the project be financed by the Government of Uganda, and be considered as counterpart funding. The Government therefore proposed to have some of the funds under Project Management in the original project design reallocated to finance the procurement of specialized equipment as part of surveillance and control measures. A follow up letter dated August 11, 2020 was submitted along with a detailed proposal of amendments. 5. Specific adjustments proposed by the Government include (i) a reduction in project management/administrative costs and Regional and National Level Coordination budget costs as the Government of Uganda has proposed to engage existing Government staff or staff from existing PIUs to undertake project activities and to finance oversight activities to be undertaken by the IG through the national budget, (ii) a reallocation of Credit Proceeds across project components to reflect this staffing change; (iii) minor revisions to select project target indicators in light of budget adjustments across components; and (iv) amendments to the FA in light of requested changes. II. DESCRIPTION OF PROPOSED CHANGES 6. The Government proposes the following changes, which are described in more detail below: (i) reducing project management/administrative costs and Regional and National Level Coordination budget costs by engaging existing Government staff to undertake project activities and to financing oversight activities that will be undertaken by the IG through the national The World Bank Emergency Locust Response Program (P173702) budget; (ii) reallocating credit proceeds across project components to reflect these staffing changes; (iii) making minor revisions to some project target indicators in light of these adjustments; and (iv) revising Schedule 2, Sections I and III of the FA. (a) Reallocation of Credit Proceeds across Project Components 7. Based on the Government’s request, credit proceeds will be reallocated from Components 3 and 4 to Component 1, while the budget allocation for Component 2 will remain unchanged. The Government of Uganda informed the Bank of its intention to use existing Government staff or staff from other PIUs to implement project activities and to recruit if required qualifications and experience were unavailable among existing personnel. The positions of Project Coordinator, Procurement Specialist, Monitoring and Evaluation Specialist and Communications Specialist will be seconded from staff under MAAIF. Financial Management Specialist and Environmental Specialist positions, competitively recruited from the Agriculture Cluster Development Project, will be assigned to manage ELRP The World Bank Emergency Locust Response Program (P173702) finances and environmental safeguards, and budget provisions made in ELRP. In addition, the position of Gender Specialist is to be recruited in the timeline set forth in the Environmental and Social Commitment Plan (ESCP) and before disbursement and commencement of activities under Component 1. 10. The staff shall have qualifications, skills and experience acceptable to the Bank in accordance with the Project Implementation Manual (PIM). Terms of References (ToRs) for designated staff must be acceptable to the Bank and they shall work at least 80 percent of their time on the project. However, the gender specialist shall work 100 percent on the project for the first 12 months and this shall be reviewed after the first year and as appropriate for the remainder of the Project. The specialist will be supported by the Bank’s gender specialists. This requirement shall be reflected in ToRs of the above staff. All CVs/Resumes of designated staff shall be concurred by the Bank. The Government of Uganda shall send the Bank a letter committing to comply with these requirements, including on the timing of staff deployment to the project. The Government should also take note that Government employees designated to the project cannot be paid a salary from the project resources. The details of staffing arrangements will be further elaborated in the PIM to be prepared by the project team. Schedule 2. Section I.A.2.(b) of the FA is revised as follows: 11. “(b) Project Coordination Unit established within MAAIF - headed by a Project coordinator and staffed, at a minimum, with a procurement specialist, a financial management specialist, a gender specialist, a monitoring and evaluation specialist, communications specialist, and an environmental specialist- and responsible for overall Project implementation including provision of technical guidance as well as coordination with Recipient’s ministries and agencies”. 12. The Government of Uganda indicated its intentions to fund the fiduciary component of the project (Inspectorate of Government oversight activities) through counterpart funding. Consequently, the following paragraph has been added to the FA as Schedule 2. Section I.A.5. and reads as follows: 13. “5. Without limitation upon the provisions of Section 1.A.1(c) of this Schedule 2 and Section 5.03 of the General Conditions, the Recipient shall, through its Ministry of Finance, Planning and Economic Development: (a) establish not later than four (4) months after the Effective Date and thereafter maintain a budget line item for its share of costs of implementing the Project including Part 2.3 of the Project; (b) in each Fiscal Year (“FY”) commencing FY2020/2021 allocate a portion of Counterpart Funds required for the Project indicated in the respective Annual Work Plan and Budget and thereafter that all funds allocated to said budget line item shall be used exclusively for the intended purposes. A definition of counterpart funds has also been added to the APPENDIX of the FA as Section I.6: 14. 6. “Counterpart Funds” means a minimum amount of funds required for the Project, estimated at US$1,136,266 million equivalent, to be provided by Recipient, through an allocation to the budget under each Annual Work Plan and Budget. 15.
