The Loan Agreement was declared effective on October 31, 2014. Project activities are under implementation. The Ministry of Justice has arranged for live web-streaming from construction sites for 'smart courts' as a measure of openness and transparency - the links for the Sumgait Court Complex, the Baku City Narimanov District Court and the Baku City Surakhani District Court are operational, according to the Ministry of Justice, and can be accessed by clicking on the URL below (link provided by the Ministry of Justice): http://justice.gov.az/project.php. Each year, on June 30 and December 31, the publication of each element of the 5 sets of data above is tracked, scored and reported on by the PIU. Scoring is done as follows: each of the five data elements published counts for a score of 1 point. Non-publication results in a score of zero. Hence the maximum possible score for each year under this indicator is 5 points. The indicator value will range from zero to five. Using this scoring system, the baseline at project preparation as of March 31, 2014 was zero as none of these elements were published on the MOJ or SC public websites.The information provided will need to be verified over the course of the next implementation support missions. In two of these courts the Case Management System (CMS) is operational: Sheki Economic-Administrative Court and Baku Economic-Administrative Court No. 1. The value indicated above is the weighted average for the courts by caseload. The time taken to enforce contracts through courts in old courthouses without CMS support is 254 days, and in courthouses with smart infrastructure it is 216 days. This makes courthouses where CMS implemented at least 25% more effective. The information provided will be verified over the course of the next missions. Overall Comments The PIU significantly improved the project M&E arrangements and reporting. First, the PIU engaged an M&E specialist with a background in economics. Second, with his help and with support from the Bank team, the project prepared an excellent semi-annual M&E report which is attached to this ISR. Third, the PIU also prepared an M&E dashboard for use by MOJ and project management to monitor implementation progress and progress on results. Lastly, transparency-related indicators have improved (e.g. public reporting on MOJ and Supreme Court websites of data and information on justice sector efficiency and service delivery has begun). This contract will underpin the effective functioning and service delivery by the IT Department being established by the Ministry of Justice pursuant to the legal covenant in the Loan Agreement. The security and traffic regulations for the Islamic Solidarity Games, to be held in 2017, could also affect ongoing construction activities, leading to delayed release of the Government contribution for 2017. The World Bank is in discussions with the MOJ to gather and analyze data to better understand the benefits from such systems. Analysis of data can provide answers to questions such as "How much do audio-video recordings alter the quality or consistency of case outcomes?" and "How does it impact the experience of litigants in the courtroom?"
