The amount of funds disbursed under the Project has been low, with only US$14.44 million (36%) disbursed to date out of the total commitment of US$40 million. The Project ratings are “Unsatisfactory” on both Progress toward achieving PDO and Overall Implementation Progress. All four Project components are rated “Moderately Unsatisfactory” and although several outputs have been achieved, none of the PDOs targets have thus far been met. Overall, the Project has been heavily impacted by contextual (political economy) factors. These include insecurity and a prolonged absence of leadership in all three Justice Institutions (post-election vacuum) which resulted in delay of the Project’s Mid-Term Review agreed – to address key Project challenges - in May 2014. The Project has also been impeded by weak counterpart implementation capacity and an overly complex design and ambitious scope. Given that the Project sought to implement the Government’s National Priority Program, mitigate the impact of the Transition, put the justice system on a sustainable path for long-term results, and improve service delivery, its original objectives cannot be met in the absence of clear justice sector reform policies. The Project is therefore being restructured to improve its efficiency, effectiveness, relevance and impact.. This will be achieved by simplifying Project design and adjusting it in line with political economy considerations. This involves streamlining Project activities from their current broad scope. The restructuring reflects growing acceptance amongst key counterparts that the current Project with three justice institutions (Ministry of Justice , Attorney General Office, Supreme Court), and in the absence of sufficient Government vision and approach on legal/judicial review, is not delivering results, but that a scaled down Project that is more narrowly focused – both in terms of activities and institutions its supports – could still be useful. The restructuring will involve the following Proposed Changes: Project design (components): The restructured Project design will focus on discrete and well-defined components by scaling back or eliminating activities on the basis of the following criteria: (i) feasibility of execution of Project activities within the remaining implementation timeframe (approximately 18 months from finalization of Restructuring); (ii) their impact; (iii) and consistency with overall reforms (agreed institutional changes the Project should target). The limited remaining implementation time requires that that the new Project design build on successful ongoing activities rather than new interventions, which will not be considered. Implementation arrangements: Implementation arrangements will be adjusted: (i) by decreasing the number of beneficiaries and implementing agencies to reflect revised/consolidated Project design (activities), i.e. justice institutions no longer relevant to Project implementation will no longer be part of the Project; and (ii) to consolidate Project management into one single Project Management Unit (JSDP PMU) integrating the staffing resources of the remaining justice institutions. The JSDP PMU would report to and act as secretariat to the Project Oversight Committee (POC). Project cost: Consolidation of both Project activities and implementation arrangements will reduce the Project cost (currently US$40 million) by potentially up to US$20 million, with the remaining balance to be cancelled. This will significantly reduce the Component costs. . Results Framework: There is a need to reformulate the Results Framework to better reflect the narrowed scope of the Project. Consequently, changes to the Result Framework will attempt to focus the Project on meaningful results that can be achieved in the remaining implementation period. This includes: (i) simplification: dropping/ revising indicators that have proved difficult to measure and/or attribute to the Project; (ii) changes in design/components: introducing new and/or revising existing indicators to reflect changes in design and scope of Project components. In parallel to these changes, the Government and its partners will work to identify a way forward on overall judicial sector reform to which the World Bank and other partners could contribute through a more programmatic approach. This would not be a single financing mechanism such as JSDP, but an approach with one vision and results framework into which all activities fit. All involved stakeholders understand that the “Unsatisfactory” rating of the Project does not allow the extension of the closing date (beyond June 1st 2017).
