The resettlement policy principles to be followed in the Vietnam Mekong Transport Infrastructure Development Project are: Acquisition of land and other assets, and resettlement of people will be minimized as much as possible. All displaced persons residing, working, doing business or cultivating land within the recovered area under the Project as of the cut-off-date are entitled to be provided with rehabilitation measures sufficient to assist them to improve or at least maintain their pre-Project living standards, income earning capacity, and production levels. Lack of legal rights to the assets lost will not bar displaced persons from entitlement to such rehabilitation measures. Rehabilitation measures include: (1) compensation at replacement cost without deduction for depreciation or salvage materials for houses and other structures; (2) priority given to in-kind compensation, for example, agricultural land-for-land of equal productive capacity acceptable to the displaced person; (3) transportation and subsistence allowances, and (4) business loss or income rehabilitation allowances. If there is no land available for "land for land" compensation or if the displaced person so chooses, then cash compensation may be given. If displaced persons lose more than 20 percent of their agricultural land holdings, the project will also provide rehabilitation assistance. The resettlement transition period will be minimized and the rehabilitation measures provided to displaced persons no later than one month prior to the expected start-up date of civil works in the respective Project site. Plans for acquisition of land and other assets and provision of rehabilitation measures will be carried out in consultation with displaced persons to ensure minimal disturbance. Entitlements will be provided to displaced persons no later than one month prior to the expected start-up of civil works at the respective project site. The previous level of community services and resources will be maintained or improved.
