China - Hubei Shiman Highway Project : resettlement action plan (Vol. 2) : Resettlement policy framework (English)

The Hubei Shiman Highway Project entails extensive construction works, in particular, the construction of the Shiman expressway, aimed at promoting an integrated development for sustainable transportation systems within the north-western Hubei Province. This resettlement action plan (Volume 1) and policy framework (volume 2), sets the standards to minimize relocation, and social impacts that will occur as a result of land acquisition, based on the country's legal framework, and the Bank's policy requirements regarding resettlement. Displaced persons losing agricultural land, will be entitled to reallocation compensation, and to benefit from collective investment of land compensation. Wherever land reallocation is not possible, displaced persons shall be provided with employment wages, at minimum equal to income lost, or, may be paid a resettlement subsidy, equivalent to at least six times the average annual production output value of the land in the previous three years. Should this not be sufficient to restore livelihoods, the subsidy may be raised to as much as fourteen times the average annual output value. Provided land compensation, and resettlement subsidies paid are still insufficient, resettlement subsidies may be further increased upon approval by the municipal government. Displaced persons whose land in temporarily taken to facilitate construction works, will be compensated for their income losses, crop losses, and for the cost of soil restoration, and damaged infrastructures. Housing and structural losses will be compensated through the provision of replacement housing of equivalent value, at full replacement cost, and/or replacement or restoration of facilities, and services. Moving expenses will be provided, and, special measures, or preferential treatment will enable the poor and vulnerable households to replacement housing that meets minimum community standards. Business, or employment losses will be compensated through alternative business sites, cash compensation, and transitional payment for moving expenses, and loss of sales or income, while alternative employment at equivalent wages will be provided, or, cash settlement equivalent to at least three years of lost wages. A transitional payment for re-training, relocation or other measures, will be provided. Grievance mechanisms will be in place, should conflict occur.
