Vietnam - Medium Cities Development Project : Additional Financing : Resettlement Plan (Vol. 2) : Updated Resettlement Plan for Phu Ly City Sub-Project (Inglês)

The development objective of the Additional Financing for Medium Cities Development Project for Vietnam is to increase access to improved urban infrastructure services in three selected medium sized cities, Lao Cai, Phu Ly, and Vinh, in a sustainable and efficient manner. Some of the negative impacts are includes : (i) Land users with legal or legalizable rights to use the affected land; (ii) land users with temporary or leased rights to use land that cannot be legalized as long- term land user; (iii) land users without legal rights to use the land; (iv) land acquired with structures built therein and the remaining land is sufficient to rebuild onmarginal or severe impacts; (v) land acquired with structures built therein and the remaining land is not sufficient to rebuild on; (vi) houses or structures located in the project recovered area; (vii) loss of standing crops and trees; (viii) loss of income and business/other productive assets; (ix) temporary loss of agricultural land and residential land; (x) community buildings, structures, community forest/grazing/or other land/ irrigation systems affected by temporary or permanent land acquisition or spoil disposal; Some of the mitigation measures are includes : (i) cash compensation for crops and trees at market price; (ii) cash compensation for acquired land equivalent to remained investment put on the land; or equivalent to 30 percent of replacement cost; (iii) compensation for loss of trees and crops at full replacement cost; (iv) cash compensation for land at 100 percent of replacement cost of the land acquired to the legal/legalize users; cash compensation equivalent to the remaining values invested in such lands, or equivalent to 50 percent of replacement prices of land to the users having no legal land use rights; (v) compensation for land with replacement cost and and an amount of cash for building infrastructure so they can arrange the new location; (vi) no deduction will be made for depreciation or salvageable materials; (vii) compensation in cash at market value on the basis of type, age, and productive value; (viii) restoration of land to its previous or better quality by providing measures to improve land quality in cases of land being adversely affected or acidified; (ix) replacement in areas identified in consultation with affected communities and relevant authorities;
