Lebanon - Urban Transport Development Project : resettlement plan (Inglês)

The Project requires land expropriation, directly affecting families, businesses, and landowners. This resettlement action plan (RAP) reviews Lebanese law, whose principle is full compensation for land, and assets expropriated; however, a special provision for roads and highways, permits land appropriation without compensation for the first twenty five percent of the original lot area, on the presumption that compensation will be received through the value accruing to the property. Under the project, this provision is not fully applicable, since prior roads already created compensatory value added, and, the additional expropriation to adjust to the right-of-way, will not generate further value added automatically. The RAP determines, and provides additional measures to ensure that owners receive equitable compensation on the value of their losses, stipulating that lost assets without automatic entitlement to compensation, shall be estimated by the Expropriation Committees, who will provide equitable compensation in accordance with Bank policies, and, a Displaced Persons Fund, and grievance mechanisms will be established. Compensation for land will be valued at current local market rates; buildings shall be valued by the square meter, taking conditions, materials, etc., into consideration; businesses will be valued based on accounts, loss of productive time, etc.; and, transition costs will cover relocation costs.
